A RESOLUTION, BY A FOUR -FIFTHS (4/5THS) AFFIRMATIVE VOTE OF THE MEMBERS OF THE CITY COMMISSION, AFTER A DULY ADVERTISED PUBLIC HEARING, RATIFYING, APPROVING, AND CONFIRMING THE CITY MANAGER'S FINDING OF SOLE SOURCE, WAIVING THE REQUIREMENTS FOR COMPETITIVE SEALED BIDS, AND APPROVING THE PURCIASE, FOR THE DEPARTMENT OF POLICE, OF A HOSTAGE NEGOTIATOR THROW PHONE SYSTEM FROM RESCUE PHONE, INC. TO BE USED BY THE MIAMI POLICE DEPARTMENT'S HOSTAGE NEGOTIATING TEAM, AT A TOTAL PROPOSED COST NOT TO EXCEED $5,995.00; ALLOCATING FUNDS THEREFOR FROM THE POLICE DEPARTMENT GENERAL OPERATING BUDGET, INDEX CODE 290201-840; AUTHORIZING THE CITY MANAGER TO INSTRUCT THE CHIEF PROCUREMENT OFFICER TO ISSUE A PURCHASE ORDER FOR THIS ACQUISITION. R WHEREAS, the Department of Police requests that competitive bidding be waived for the purchase of a Hostage Negotiator Throw Phone System (System), from Rescue Phone, Inc., at a proposed cost of $5,995.00; WHEREAS, the Department of Police needs to purchase this System to be used by the Miami Police Department's Hostage Negotiating Team; and WHEREAS, this acquisition will be extremely useful by the Miami Police Department during hostage negotiations or barricaded subjects as it will support existing phone lines or may be used as a stand-alone system utilizing its cellular capabilities; and CITY COMNLISSION MEETING OF MAY 2 3 1996 Resolution No. 96- 312 WHEREAS, this purchase is a sole source from Rescue Phone, Inc. as they are the sole distributor of the System with cellular capabilities; and WHEREAS, funds for this purchase are available from the Police Department General Operating Budget, Index Code 290201-840; and WHEREAS, the Chief Procurement Officer has adopted a finding that Rescue Phone, Inc. is the sole source provider of the System with cellular capabilities as requested by the Department of Police; WHEREAS, the findings of the Chief Procurement Officer have been approved and adopted as the findings of the City Manager; and WHEREAS, the City Manager and the Chief Procurement Officer recommend that the requirements for competitive formal sealed bids be waived and the purchase from Rescue Phone, Inc., the sole source, be approved; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are hereby adopted by reference thereto and incorporated herein as if fully set forth in this Section. Section 2. By a four -fifths (4/5ths) affirmative vote of the members of the City Commission, after a duly advertised public hearing, ratifying, approving and confirming the City Manager's finding that Rescue Phone, Inc., is the sole source provider of the Hostage Negotiator Throw Phone System (System) to be used by the Miami Police Department's Hostage Negotiating Team. Section 3. The requirement for competitive sealed bids is hereby waived and the Department of Police's request for the acquisition of the System from Rescue Phone, Inc., is hereby approved, with funds therefor - 2 - 96- 312 hereby allocated, in a total proposed amount of $5,995.00, from the Police Department General Operating Budget, Index Code 290201-840. Section 4. The City Manager is hereby authorized to instruct the Chief Procurement Officer to issue a purchase order for this i acquisition. Funding will be from the Police Department General Operating Fund, Index Code 290201-840. BACKGROUND: i This phone system will be used by the Miami Police Department's Hostage Negotiating Team. It is extremely useful during hostage negotiations or barricaded subjects. The system will support existing phone lines or may be used as a standalone utilizing its cellular capabilities. An additional feature is the "throw phone" which is delivered to the perpetrator when the existing phone is damaged or there is no phone available. It was determi ed that there are a total of three (3) vendors throughout the country that manufacture hostage negotiator throw phone systems, all unique to one another. However, it was determined the cellular phone feature is unique and a sole source for Rescue Phone, Inc. In an attempt to determine whether this was a sole source, contact was made with Rescue Phone, Inc., Television Equipment Associates, Inc., and Lucent Technologies. While the latter two (2) firms sell hostage negotiator throw phone systems, they do not sell phone systems that are cellular, as requested by the Police Department. The estimated amount for this system $ 5995.00, with funds allocated from the Police Department General Operating Fund, Index Code 290201-840. Therefore, I am recommending that the requirements for competitive bidding be waived and the above findings be approved: that Rescue Phone, Inc.
