RESOLUTION NO. 9 `' _ 220
A RESOLUTION AUTHORIZING THE CITY MANAGER TO
SUBMIT AN APPLICATION FOR ASSISTANCE TO THE
FLORIDA INLAND NAVIGATION DISTRICT ("FIND")
FOR GRANT FUNDING UNDER THE FIND WATERWAYS
ASSISTANCE PROGRAM, IN THE ESTIMATED AMOUNT
OF $34,500.00, FOR MORNINGSIDE SEAWALL
IMPROVEMENTS; FURTHER AUTHORIZING THE CITY
MANAGER TO EXECUTE THE NECESSARY DOCUMENTS,
IN A FORM ACCEPTABLE TO THE CITY ATTORNEY,
FOR THIS PURPOSE.
WHEREAS, certain seawall improvement projects are included
in the City of Miami's six year Capital Improvement Program to
correct seawall problems under the City's jurisdiction; and
WHEREAS, the Florida Legislature has made funding available
to municipalities for such projects under the Florida Inland
Navigation District's ("FIND") Waterways Assistance Program on a
50-50 cost -share basis; and
WHEREAS, the needed improvements to the seawalls located at
the ends of Northeast 55th Terrace and Northeast 59th Street, in
the Morningside neighborhood, Miami, Florida, satisfy the
criteria for grant funding under the Program; and
WHEREAS, the City's matching share of the project cost, in
the estimated amount of $34,250, is available from Local Option
Gas Tax Funds;

NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the
Preamble to this Resolution are hereby adopted by reference
thereto and incorporated herein as if fully set forth in this
Section.
Section 2. The City Manager is hereby authorized to
submit an application for assistance to the Florida Inland
Navigation District ('FIND") for grant funding under the FIND
Waterways Assistance Program, in the estimates amount or
$34,500.00, approximately 50% of the estimated total cost, for
the Morningside Seawall Improvement Project, located at the ends
of Northeast 55th Terrace and Northeast 59th Street, Miami,
Florida.
Section 3. The City Manager is hereby authorized) to
execute the necessary documents, in a form acceptable to the City
Attorney, for application of said grant, subject to the following
provisions:
a. The City will accept the terms and conditions set
forth in FIND Rule 16T-2 F.A.C.
b. The City is in complete accord with the grant
proposal and will carry out the project in the
manner described in said proposal, and any plans
and specifications attached thereto, unless prior
approval for any change has been received from
FIND.
c. The City has the ability and intention to finance
its share of the cost of said project and that the
project site will be operated and maintained at the
expense of the City for public use.
' The herein authorization is further subject to compliance with all requirements that may be imposed by the City
Attorney, including but not limited to those prescribed by applicable City Charter and Code provisions.

d. The City will not discriminate against any person
on the basis of race, color, creed, national
origin, sec or handicap in the use of any property
or facility acquired or developed pursuant to the
grant proposal and will comply with the terms and
intent of Title VI of the Civil Rights Act of 1964,
P.L. 88-352 (1964) and will design and construct
all facilities to comply with statutes relating to
accessibility by handicapped persons as well as
other federal, state and local laws, rules and
requirements.
e. The City will maintain adequate financial records
on said project to substantiate claims for
reimbursement.
f. The City will make available to FIND, if requested,
a post -audit of expenses incurred on said project
prior to or in conjunction with its request for the
final 10% of the grant funding provided by FIND.
Section 4. This Resolution shall become effective
immediately upon its adoption.

RECOMMENDATION:
It is respectfully recommended that the attached Resolution be adopted
authorizing the City of Miami to request assistance under the Fiscal Year 1996
Waterways Assistance Program administered by the Florida Inland Navigation
District for City Seawall Improvements.
BACKGROUND:
Certain seawall improvement projects are included in the City's six year Capital
Improvement Program to correct seawall problems under the City's jurisdiction.
The Florida Legislature has made funding available for such projects and has
empowered the Florida Inland Navigation District to administer these funds by
entering into cost -share agreements, on a 50-50 basis, with municipalities. The
City has identified a necessary project within the Morningside neighborhood,
totaling $68,500 that qualifies for these funds and a successful Proposal for a
cost -share agreement would provide $34,250 (50%) of State funds for this project.
Funds are available for the City's share of the cost from Local Option Gas Tax
Funds.
The attached Resolution, in a form required by the District, authorizes the City
to apply for these funds.

Attached is a resolution that authorizes the City to request assistance under the Waterways
Assistance Program administered by the Florida Inland Navigation District (FIND). The specific
request is for the rebuilding of two (2) seawalls in the Morningside Neighborhood at the street
ends of NE •55 Terrace and NE 59 Street. This approved resolution must accompany the grant
package that is due in the District's offices in Jupiter, Florida, on April 1, 1996. We are therefore
requesting that this resolution be placed on the March 26, 1996 City Commission agenda for
consideration and approval.
