HomeMy WebLinkAboutR-96-0215J-95-774 1/16/96 RESOLUTION NO. 9 6- 215 A RESOLUTION, WITH ATTACHMENT(S) AUTHORIZING THE CITY MANAGER TO EXECUTE AN AMENDMENT TO AN EXISTING AGREEMENT, IN SUBSTANTIALLY THE ATTACHED FORM, BETWEEN THE CITY OF MIAMI ("CITY") AND MIAMI-DADE COMMUNITY COLLEGE (M.D.C.C.) FOR THE CITY'S RENDERING OF IN-SERVICE FIRE TRAINING, THEREBY EXTENDING THE TERM OF SAID AGREEMENT FROM AUGUST 1, 1995 TO JULY 31, 1996; ALLOCATING FUNDS THEREFOR FROM THE GENERAL OPERATING BUDGET OF THE DEPARTMENT OF FIRE -RESCUE, ACCOUNT NO. 280201-180, FOR PAYMENT OF STUDENT CONTACT HOURS, PURSUANT TO THE TERMS AND CONDITIONS SET FORTH IN SAID AGREEMENT. WHEREAS, an agreement exists between the City of Miami ("City") and Miami -Dade Community College ("M.D.C.C.") which allows the City to receive revenues from the State of Florida through M.D.C.C. for its ongoing "In -Service Fire Training Programs" ("Program") conducted by the Department of Fire -Rescue; and WHEREAS, said Program is conducted in accordance with the State of Florida guidelines and M.D.C.C. level of occupational instruction, program coordination, registration, monitoring, and reporting activities; and WHEREAS, revenues/services will be received by the Department of Fire -Rescue for ongoing training instructors ($12.00 per instructor hour), for use of facilities equipment, material, and support personnel ($1,200 per Full Time Equivalent ATTACHMENT '(S) (ONTANED CITY COMMISSION MEETING OF MAR 2 6 1996 Reso44ipp No. 96- 21S (FTE) student (900 student contact hours equals one FTE student); and WHEREAS, the Department of Fire -Rescue agrees to pay M.D.C.C. at the current contact hour rate established by M.D.C.C. Board of Trustees ($1.09 per student contact hour for 1995-196) not to exceed a total of 36,000 student hours during the duration of the agreement; and WHEREAS, said Agreement will provide the Department of Fire -Rescue with official State and College level recognition of In -Service Fire Training; and WHEREAS, the Department of Fire -Rescue has the distinction of being the first fire department in the South Florida community to receive revenue/services for Full-time Equivalent (FTE) students; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are hereby adopted by reference thereto and incorporated herein as if fully set forth in this Section. Section 2. The City Manager is hereby authorized!' to execute an amendment to an existing agreement, in substantially the attached form, between the City of Miami ("City") and Miami -Dade Community College (M.D.C.C.) for the City's rendering i� The herein authorization is further subject to compliance with all requirements that may be imposed by the City Attorney, including but not limited to those prescribed by applicable City Charter and Code provisions. - 2 - 96- 21 of In -Service Fire Training, thereby extending the term of said agreement from August 1, 1995 to July 31, 1996, with funds therefor hereby allocated from the General Operating Budget of the Department of Fire -Rescue, Account No. 280201-180, for payment of student contact hours, pursuant to the terms and conditions set forth in said Agreement. RECITAL F WHEREAS, pursuant to Resolution the City Commission authorized the City Manager to extend the existing contract between the City and the College for the City's rendering of In -Service Fire Training fc-)r the period of August 1, 1995 through July 31, 1996. NOW, THEREFORE, the City and College, for the considerations hereinafter set forth, agrees to amend the Agreement as follows: 1. Section I. Duration of Agreement shall be amended to read as follows: "The agreement shall begin on August 1, 1995 and terminate at the close of business on July 31, 1996, unless renewed by mutual agreement of both agencies." 2. Section IV. Terms of payment by the Collette shall be amended as follows: "The College further agrees to pay the City of Miami Fire Department for the use of its facilities, equipment, materials, and support 96- 215 kr_. personnel at a rate of Twelve Hundred Dollars ($1,200) per non-credit full time equivalent student. 3. Section V. Terms of payment by the City of Miami Fire Department shall be amended to read as follows: "The City of Miami Fire Department agrees to pay the COLLEGE at the current contact hour rate established by Miami -Dade Community College Board of Trustees (1.09 per student contact hour for 95-96) not to exceed a total of 36,000 student contact hours during the duration of the agreement. Payment will be made based on a properly submitted monthly invoice for services rendered by the COLLEGE to the City." 4. The Agreement entered into between the City and College dated June 2, 1989, shall remain in full force and effect and shall not be deemed to be modified except as modified herein. Ces 4' City RECOMMENDAITON SUBJECT : MDCC Resolution Contract Extension REFERENCES: ENCLOSURES: It is respectfully recommended that the City Commission adopt a Resolution authorizing the City Manager to extend the existing between the City and Miami- Dade Community College (MDCC) for the City's rendering of In Service Fire Training thereby extending the period of said contract from August 1, 1995 through July 31, 1996. BACKGROUND The Department of Fire -Rescue has reviewed the attached documents and has determined that they are now in order for acceptance by the City Commission. This contract allows the City to receive revenues from the State of Florida through MDCC or in-service Training provided on an on -going basis. f There are two changes in the terms of the agreement: ! 1. The Full Time Equivalent (FTE) rate of $500 will increase to $1,200. 2. The maximum number of student contact hours will not exceed 36,000.
