RESOLUTION NO.
A RESOLUTION ALLOCATING FUNDS IN THE AMOUNT
OF $14,000 FROM 21ST YEAR COMMUNITY
DEVELOPMENT BLOCK GRANT FUNDS, PROJECT
NO. 799613, FOR THE REHABILITATION OF TWO (2)
BUSINESSES LOCATED IN THE ALLAPATTAH TARGET
AREA, IN CONJUNCTION WITH THE COMMERCIAL CODE
COMPLIANCE PROGRAM, SAID ALLOCATION TO BE
BASED UPON A 70%-30% MATCH BETWEEN THE CITY
OF MIAMI AND THE BUSINESS OR PROPERTY OWNER.
WHEREAS, the Commercial Code Compliance Program (the
"Program") was approved in the Twenty-first Year Community
Development Block Grant Application, pursuant to Resolution
No. 95-175, as amended by Resolution No. 95-413; and
WHEREAS, said Program is designed to promote code compliance
in neighborhoods in the City of Miami, and thus is an important
part of the City's economic development strategy; and
WHEREAS, funds for said Program are available from the
Community Development Block Grant Program; and
WHEREAS, the properties to be rehabilitated are located
within the Allapattah Target Area; and
WHEREAS, eligibility for assistance under said Program is
based upon a 70%-30% match, with the City providing 70% and the
business or property owner providing 30% of the costs of
correcting electrical, plumbing and fire violations which shall
not exceed the total amount of $10,000 per participating
business; and

WHEREAS, the Allapattah NET Office has cited said businesses
for electrical, plumbing and fire violations; and
WHEREAS, the properties that require compliance have been
reviewed by the City of Miami Neighborhood Enhancement Team
("NET") and the Allapattah Business Development Authority
("ABDA") and have been found to be eligible for said Program; and
WHEREAS, ABDA has the necessary expertise and will provide
the services necessary for the implementation of said Program and
the disbursement of funds allocated to the participating
businesses, pursuant to an agreement previously executed;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the
Preamble to this Resolution are hereby adopted by reference
thereto and incorporated herein as if fully set forth in this
Section.
Section 2. Funds in the amount of $14,000 are hereby
allocated from 21st Year Community Development Block Grant Funds,
Project No. 799613, for the rehabilitation of two (2) businesses
located in the Allapattah Target Area, in conjunction with the
Commercial Code Compliance Program.
Section 3. The financial assistance to be provided by
the City of Miami for said Program shall be based upon a 70%-30%
match, with the City contributing up to $7,000 per participating
business and the business or property owner contributing up to
$3,000.

Section 4. Upon completion of the Code Compliance
Program, ABDA shall present to NET all documentation and invoices
generated by, or pertaining to, said Project.
Section 5. This Resolution shall become effective
immediately upon its adoption.

RECOMMENDATION:
It is respectfully recommended that the City Commission approve the attached resolution,
allocating fourteen thousand dollars ($14,000.00) towards the City of Miami Commercial
Code Compliance Program, for two (2) businesses within the Allapattah target area.
BACKGROUND:
In an effort to promote code compliance within blighted. City of Miami neighborhoods, the
Code Compliance Program was implemented, per Resolution No. 95-413 on May .25,
1995, during the 21 st Year of Community Development Block Grant (CDBG) Program.
These properties have been cited by the Allapattah NET Office for electrical, plumbing,
and fire violations. The correction of these violations will result in upgraded living
conditions in the affected areas and increased benefits to the community.
Therefore, it is requested that the City of Miami allocate CDBG funds in the amount of
fourteen thousand dollars ($14,000.00) to the Allapattah Business Development Authority
(ABDA), for the implementation -of the Commercial Code Compliance Program for the
following properties:
Allapattah
Salgado Corporation 2323 N.W. 17th Avenue Plumbing and electrical violation
Produce Connection 2260 N.W. 13th Avenue Fireproof walls violations
Each of the aforementioned enterprises would be allocated a maximum of ten thousand
dollars ($10,000.00), with the City of Miami contributing 70%, up to seven thousand dollars
($7,000.00), and the business or property owner contributing 30%, up to three thousand
dollars ($3,000.00). ABDA will assume responsibility for completing all pertinent
documentation, and will forward such information to the City of Miami NET, which will
make sure that the electrical, plumbing, and fire violations have been corrected.

Therefore, per the aforementioned legislation, it is requested that the attached resolution
be adopted.

ENCLOSURES,
This memorandum is in response to some concerns from tt,e City
Commission pertaining to the Commercial Code Compliance Program item
presented at the January 25, 1996 meeting. The City Commission's
concerns were that the City should not assist any business(es)
through the Commercial Code rompliance Program that corrects a
violation, but continues to have a history of other violations. The
athor concern was that the City should make sure that the funding
being provided will bring the business into code compliance.
In the case vt the Salgado Corporatinn, Inc. , 2323 N.W. 17 Avenue,
(a new business in the area) and, according to the Allapattah NET
Off Ice, this business does not have a history of previous
violations, and therefore after Lhe correction of Lhe violations,
the City will assist the business to meet the Code.
In the case of the Produce Connection, Inc., 2260 N.W. 13 Avenue,
violations had innurred from a previous owner. The Produce
Connection wanted to expand their property and in order to ubLai.n a
Certificate of Use (C.U.) they needed to correct their violations.
According to the Allapattah NET Office, this funding will. correct
the violations and bring the business into code compliance.
I will instruct all the NET Administrators to comply with the City
Commi-qsionls concerns and further advise them not to approve any
business(es) unless it is in full conformance with the commercial
Code Compliance Program.
