A RESOLUTION, BY A FOUR -FIFTHS (4j5THS)
AFFIRMATIVE VOTE OF THE MEMBERS OF THE CITY
COMMISSION, AFTER A DULY ADVERTISED PUBLIC
HEARING, RATIFYING, APPROVING AND CONFIRMING
THE CITY MANAGER'S WRITTEN FINDING THAT AN
EMERGENCY EXISTS; WAIVING THE REQUIREMENTS
FOR COMPETITIVE SEALED BIDDING; AND APPROVING
THE ACQUISITION OF REPAIR SERVICES FOR THE
DEPARTMENT OF PUBLIC FACILITIES, MARINAS
DIVISION, FROM CAYON SERVICE CENTER, INC. FOR
THE TAYLOR MODEL #TY520 FORKLIFT MACHINE, AT
A PROPOSED COST OF $19,000; ALLOCATING FUNDS
THEREFOR FROM THE MARINE STADIUM MARINA'S
OPERATING BUDGET, ACCOUNT CODE NO 350508-340;
AUTHORIZING THE CITY MANAGER TO INSTRUCT THE
CHIEF PROCUREMENT OFFICER TO ISSUE A PURCHASE
ORDER FOR SAID ACQUISITION.
WHEREAS, forklifts used at Marine Stadium Marina operate on
a daily, seven days per week basis; and
WHEREAS, damaged caused by their constant exposure to
saltwater and other corrosive elements require maintenance and
repair in order to maintain the forklifts operational; and
WHEREAS, the operation of the facility, used to store over
three hundred vessels, will entirely cease pending the repair of
the Miami Marine Stadium' Marina Taylor Model #TY520 Forklift
Machine; and
WHEREAS, based upon informal quotes solicited, Cayon Service
Center responded as the lowest most responsive and responsible
bidder; and

WHEREAS, funds are available for said repairs from the Miami
Marine Stadium Marina's Operating Budget; and
WHEREAS, the City Manager recommends that the requirement
for competitive sealed bidding be waived and the acquisition of
said emergency repair services be approved;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:
Section 1. The .recitals and findings contained in the
Preamble to this Resolution are hereby adopted by reference
thereto and incorporated herein as if fully set forth in this
Section.
Section 2. By a four -fifths (4/5ths) affirmative vote of
the members of the City Commission, after a duly advertised
public hearing, the City Manager's written finding that an
emergency exists concerning the repair of the Miami Marine
Stadium Marina's Taylor Model #TY520 Forklift Machine, is hereby
ratified, approved and confirmed.
Section 3. The requirement for competitive sealed
bidding is hereby waived and the request of the Department of
Public Facilities, Marinas Division, for the acquisition of
services from Cayon Service Center, Inc. for the emergency
repairs of said Forklift, at a proposed cost of $19,000, is
hereby approved, with funds therefor hereby allocated from the
Marine Stadium Marina's Operating Budget, Account Code
No. 350508-340.

Section 4. The City Manager is hereby authorized to
instruct the Chief Procurement Officer to issue a purchase order
for said services.
Section 5. This Resolution shall become effective
immediately upon its adoption.

It is respectfully recommended that the City Commission pass the attached resolution
ratifying, approving and confirming the emergency repair services of "Cayon Service
Center, Inc.", 8161 N.W. 91 Terrace, Medley, Florida 33166, a minority vendor, on an
emergency basis.
BACKGROUND
The forklifts at Marine Stadium Marina, Department of Public Facilities, operate on a
daily basis and are frequently damaged due to their constant exposure to salt water and
other corrosive elements. Major repairs are required to maintain the Taylor Model
forklift operational for the boating season ahead. Due to the critical need of these repairs
and in the interest of expediency, it is recommended that the City waive the requirements
for competitive sealed bids and award this service to "Cayon Service Center". Failure to
maintain this machine operational may result in the shut down of this facility.
"Cayon Service Center" has proven to be reliable in providing repair services in the past.
Additionally, it is currently the lowest and most responsive bidder. Funds for these
services are available from the Marine Stadium Marina's operating budget, account
number 350508, minor object code 340 (outside contractual services).

Emergency repair services are required to keep this facility operational. Due to the

(13) PRIME AND PAINT CARRIAGE.
(14) REMOVE MAST ASSEMBLY AND BRING IT TO OUR SHOP.

(16) REBUILD ALL ROLLERS AS NEEDED.

NOTICE TO THE PUBLIC
PLEASE AL TAKE NOTICE THAT a public hearing will be held by the City
Commission of the City of Miami, Florida, on February 29. 1996 at 00 a.m., in the
City Commission Chambers at City Hall, 3500 Pan American Drive, Miami, Florida, for
the purpose of considering a waiver of requirements for the formal sealed bids for the
emergency repair of the City's Taylor Model #TY250 forklift machine, by "Cayon
Service Center", 8161 NW 91 Terrace, Medley, F1 33166, at a total cost of $19,000.00.
Inquiries from other potential sources of such services who feel that they might be able to
satisfy the City's requirements for this item may contact Raul de la Torre, Marinas
Manager, at Dinner Key Marina at 579-6950.
All interested persons are invited to appear and may be heard concerning this item.
Should any person desire to appeal any decision of the City Commission with respect to
any matter considered at this hearing, that the person shall ensure that a verbatim record
of the proceedings is made, including all testimony and evidence upon which may appeal
may be based.
