A RESOLUTION, BY A FOUR -FIFTHS (4/5THS) AFFIRMATIVE VOTE OF THE MEMBERS OF THE CITY COMMISSION, AFTER A DULY ADVERTISED PUBLIC HEARING, RATIFYING, APPROVING AND CONFIRMING THE CITY MANAGER'S FINDING OF SOLE SOURCE; WAIVING THE REQUIREMENT FOR COMPETITIVE SEALED BIDDING; AND APPROVING THE ACQUISITION FOR THE DEPARTMENT OF GENERAL SERVICES ADMINISTRATION AND SOLID WASTE, OF A WEIGH-TRONIX MODEL DATA MANAGEMENT SYSTEM FROM SCALEMEN OF FLORIDA, INC., TO BE USED IN DIRECT INTERFACE WITH THE WEIGH-TRONIX W1-130 DATA ACQUISITION SYSTEM WHICH IS CURRENTLY LOCATED AT THE VIRGINIA KEY YARD/TRASH MANAGEMENT FACILITY, AT A TOTAL PROPOSED COST NOT TO EXCEED $5,350.00; ALLOCATING FUNDS THEREFOR FROM THE FY 196 SOLID WASTE RECYCLING AND EDUCATION SPECIAL GRANT FUND, ACCOUNT CODE NO. 421305-840, PROJECT NO. 197007; AUTHORIZING THE CITY MANAGER TO INSTRUCT THE CHIEF PROCUREMENT OFFICER TO ISSUE A PURCHASE ORDER FOR SAID ACQUISITION. WHEREAS, over the past five (5) years, the City of Miami has developed a state-of-the-art composting and mulching facility at the Virginia Key Yard/Trash Management Facility for residential yard and garden trash, as well as for other municipalities and commercial businesses, which will be charged tipping fees for disposal; and WHEREAS, the Department of General Services Administration and Solid Waste Department is requesting approval of automating the existing scale at the facility with a PDOX Data Management CITY COM USSION MEETING OF, FEB 2 9 1996 Resolution No. 96- 104 System for the purpose of managing the weight tickets, invoices and reports; and WHEREAS, said acquisition will assist the Solid Waste Division with its ongoing efforts to reduce cost through the diversion of trash to the Virginia Key Yard/Trash Management Facility; and WHEREAS, the Chief Procurement Officer has adopted a finding that Scalemen of Florida, Inc. is the sole source provider of the Weight-Tronix Model Data Management System which is required for the automation of the scale at the Virginia Key Yard/Trash Facility as requested by the Department of General Services Administration and Solid Waste; and WHEREAS, the findings of the Chief Procurement Officer have been approved and adopted as the findings of the City Manager; and WHEREAS, the City Manager and the Chief Procurement Officer recommend that the requirement for competitive sealed bidding be waived and the purchase from Scalemen of Florida, Inc. the sole source provider, be approved; and WHEREAS, funds for said purchase are available from the FY '96 Solid Waste Recycling and Education Grant Fund, Account Code No. 421305-840, Project No. 197007; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: - 2 - 96-- 104 Section 1. The recitals and findings contained in the Preamble to this Resolution are hereby adopted by reference thereto and incorporated herein as if fully set forth in this Section. Section 2. By a four -fifths (4/5ths) affirmative vote of the members of the City Commission, after a duly advertised public hearing, the City Managers finding that Scalemen of Florida, Inc. is the sole source provider of the Weigh-Tronix Model Data Management System to be used in direct interface with the Weigh-Tronix W1-130 Data Acquisition System which is located at the Virginia Key Yard/Trash Management Facility, is hereby ratified, approved and confirmed. Section 3. The requirement for competitive sealed bidding is hereby waived and the Department of General Services Administration/Solid Waste Division's request for the acquisition of a Weigh-Tronix Model Data Management System from Scalemen of Florida, Inc. is hereby approved, with funds therefor, at a total proposed cost of $5,350.00, hereby allocated from the FY '96 Recycling and Education Grant Fund, Account Code No. 421305-840, Project No. 197007. Section 4. The City Manager is hereby authorized to instruct the Chief Procurement Officer to issue a purchase order for said acquisition. Section 5. Scalemen of Florida, Inc., a non -local, non -minority owned company located at 2280 SW 71 Terrace, Davie, FL 33317 is the sole distributor of this software. BACKGROUND The 'Department of General Services and Solid Waste requests approval to automate the existing scale at this facility. In an ongoing effort to maximize all areas of potential revenue at this site, the purchase of the PDOX Data Management System for vehicle weighing operations is a computer -based software data management system that will enhance the existing equipment to fully automate the weighing of in -bound and out -bound vehicles, to produce weight tickets, customer invoicing and required management reports. This improvement will provide accurate calculations of diverted cost savings as well as revenue generation from other municipalities and commercial businesses in the City of Miami who will be charged tipping fees for disposal.
