RESOLUTION NO. 96- 103
A RESOLUTION, BY A FOUR -FIFTHS (4/5THS)
AFFIRMATIVE VOTE OF THE MEMBERS OF THE CITY
COMMISSION, AFTER A DULY ADVERTISED PUBLIC
HEARING, RATIFYING, APPROVING AND CONFIRMING
THE CITY MANAGER'S FINDING OF SOLE SOURCE;
WAIVING THE REQUIREMENT FOR COMPETITIVE
SEALED BIDDING; AND APPROVING THE
RETROFITTING OF THE FUEL HARVESTER TUB
GRINDER USED FOR THE GRINDING OF MULCH AT THE
VIRGINIA KEY YARD/TRASH MANAGEMENT FACILITY
FROM FUEL HARVESTER EQUIPMENT, INC., FOR THE
DEPARTMENT OF GENERAL SERVICES ADMINISTRATION
AND SOLID WASTE, AT A TOTAL COST NOT TO
EXCEED $25,000.00; ALLOCATING FUNDS THEREFOR
FROM THE FY 196 SOLID WASTE REDUCTION,
RECYCLING AND EDUCATION SPECIAL GRANT FUND,
ACCOUNT CODE NO. 421305-840, PROJECT NO.
197007; AUTHORIZING THE CITY MANAGER TO
INSTRUCT THE CHIEF PROCUREMENT OFFICER TO
ISSUE A PURCHASE ORDER FOR SAID RETROFITTING
OF EQUIPMENT.
WHEREAS, the Department of General Services Administration
and Solid Waste wishes to retrofit the Fuel Harvester Tub Grinder
with new hammers, 2 1/2 inches thick, weighing several times as
much as the older style hammers, with the capability of creating
much more centrifugal force and grinding power for handling tough
materials such as small stumps and logs at the Virginia Key
Yard/Trash Management Facility; and
WHEREAS, retrofitting of said machine will eliminate the
need for hammer welding completely by utilizing reversible and
replaceable bolt -on cutting tips which would improve maintenance,

and require fewer hammer changes, resulting in a substantial cost
savings and increased productivity by fifty percent (50%); and
WHEREAS, the need to engage outside vendors to grind heavier
materials (14 inches in diameter or larger) will be reduced
substantially with the upgrading of the necessary features on
said equipment; and
WHEREAS, the Chief Procurement Officer has adopted a finding
that Fuel Harvester Equipment, Inc. is the sole source provider
for the retrofitting of the Fuel Harvester Tub Grinder as
requested by the Department of General Services Administration
and Solid Waste; and
WHEREAS, the findings of the Chief Procurement Officer have
been approved and adopted as the findings of the City Manager;
and
WHEREAS, the City Manager and the Chief Procurement Officer
recommend that the requirement for competitive sealed bidding be
waived and the retrofitting of said equipment from Fuel Harvester
Equipment, Inc., the sole source provider, be approved; and
WHEREAS, funds for said retrofitting are available from the
FY '96 Solid Waste Reduction; Recycling and Education Grant Fund,
Account Code No. 421305-840, Project No. 197007;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the
Preamble to this Resolution are hereby adopted by reference
thereto and incorporated herein as if fully set forth in this
Section.

Section 2. By a four -fifths (4/5ths) affirmative vote of
the members of the City Commission, after a duly advertised
public hearing, the City Manager's finding that Fuel Harvester
Equipment Inc. is the sole source provider for the retrofitting
of the fuel harvester tub used for grinding of mulch at the
Virginia Key Yard/Trash Management Facility, is hereby ratified,
approved and confirmed.
Section 3. The requirement for competitive sealed
bidding is hereby waived and the Department of General Services
Administration/Solid Waste Division's request for the
retrofitting of the fuel harvester tub grinder from Fuel
Harvester Equipment Inc. is hereby approved, with funds therefor,
at a total proposed cost of $25,000.00, hereby allocated from the
FY '96 Recycling and Education Grant Fund, Account Code
No. 421305-840, Project No. 197007.
Section 4. The City Manager is hereby authorized to
instruct the Chief Procurement Officer to issue a purchase order
for said retrofitting.
Section 5. This Resolution shall become effective
immediately upon its adoption.

RECOMMENDATION
It is respectfully recommended that the City Commission waive
competitive bids and approve the sole source retrofitting of a Fuel
Harvester Tub Grinder for the Virginia Key Yard/Trash Management
Facility.
This vendor is deemed a sole source purchase because Fuel Harvester
Equipment, Inc. is the manufacturer of this piece of equipment, and
therefore is the only company authorized to do this work.
RACKaRnumn
The General Services Administration and Solid Waste Division
presently has one (1) Fuel Harvester Tub Grinder located at the
Virginia Key Yard/Trash Management Facility. This facility has
developed over the past five (5) years into a first class composting
and mulching facility for all residential yard and garden trash and
is available for use by other municipalities and commercial
businesses in the City of Miami who will be charged tipping fees for
their material. However, this piece of equipment is in need of the
retrofitting of various parts to upgrade the machine. With the
requested retrofit, the facility will have the potential to realize
increased productivity of approximately 50%. When completed the
machine will be able to grind large stumps and logs and reduce the
need for outside vendors for grinding purposes of material 14
inches in diameter or larger. All grinding of material delivered
to the facility could be processed in-house.
Additionally, with a more efficient grinder our end product of mulch
and compost will be of better quality for sale. Revenue from the
sale of the material will be increased significantly.

An investigation was conducted by the Procurement Management staff to determine whether Fuel
Harvesters Equipment, Inc., a non-minority/non-local vendor is the sole source vendor for the
retrofitting of the Fuel Harvester Tub Grinder at the Virginia Key Yard/Trash Managemenn Facility
located at 3851 Rickenbacker Causeway. Fuel Harvesters Equipment, Inc. is the designer and
manufacturer of this equipment and sole supplier of the parts.
It is therefore recommended that the requirements for competitive bidding be waived and the
purchase be awarded to Fuel Harvesters Equipment, Inc. the sole source supplier of the required
service.

PLEASE ALL TAKE NOTICE THAT a public hearing will be held by the
City Commission of the City of Miami, Florida, on
February_ 29, 1996 at 9:00 a.m., in the City Commission
