A RESOLUTION AUTHORIZING THE CITY
MANAGER TO EXECUTE AN AMENDMENT,
IN A FORM ACCEPTABLE TO THE CITY
ATTORNEY, TO THE MEMORANDUM OF
AGREEMENT, DATED JULY 1, 1995, WITH
METROPOLITAN DADE COUNTY,
DEPARTMENT OF HUMAN RESOURCES
(OFFICE OF COMMUNITY SERVICES), FOR
THE USE OF $12,573.56 IN FISCAL YEAR 1993
HOUSING OPPORTUNITIES FOR PERSONS
WITH AIDS ("HOPWA") PROGRAM
FUNDING, SAID FUNDING TO PROVIDE
UTILITIES ASSISTANCE TO ELIGIBLE
PERSONS WITH HIV/AIDS, OR RELATED
DISEASES.
WHEREAS, in February, 1993, the City of Miami responded to the U.S,
Department of Housing and Urban Development (HUD) Notice of Funding Availability
for the Fiscal Year 1993 HOPWA program, on behalf of, and in conjunction with, Dade
County, and the cities of Hialeah, Miami Beach, and local area AIDS service providers,
and
WHEREAS, in April, 1993, the City received notice of funding approval from
U.S. HUD under the HOPWA program, for $4,697,000; and

WHEREAS, in May, 1993, the City Commission adopted Resolution No. 93-287,
which authorized the City Manager to accept the $4,697,000 in 1993 HOPWA funds, to
execute the necessary contracts to implement the HOPWA program, and to execute
contracts with agencies to provide services under the HOPWA program, subject to said
contracts being acceptable to the City Attorney, City Commission approval, and applicable
City Code provisions; and
WHEREAS, in June, 1993, the City Commission adopted Ordinance No. 11075,
which established a Special Revenue fund entitled, "Housing Opportunities for Persons
With AIDS (HOPWA) Grant Program (FY 1993)", and appropriated $4,697,000 from
U.S. HUD for the implementation and administration of the 1993 HOPWA program, and
WHEREAS, in September, 1993, the City Commission approved Resolution No.
93-600 which funded five sponsors to provide services under the 1993 HOPWA program;
and
WHEREAS, the abovementioned five sponsors have completed the services for
which they were contracted and have unexpended funds in the amount of $12,573.56
which can only be used by service providers; and
WHEREAS, all fiscal year 1993 HOPWA funds must be expended before June 4,
1996, or they may be recaptured by U.S. HUD; and
WHEREAS, in order to expend the remaining FY 1993 HOPWA funds before
June 4, 1996, the HOPWA Advisory Board and the City Administration recommend
awarding said funding to Metropolitan Dade County's Department of Human Resources

(Office of Community Services) for the provision of utilities assistance to very low income
persons with AIDS;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE
CITY OF MIAMI, FLORIDA;
Section 1. The recitals and findings contained in the Preamble to this Resolution
are hereby adopted by reference thereto and incorporated herein as if fully set forth in this
Section.
Section 2. The City Manager is hereby authorized ' to execute an amendment, in a
form acceptable to the City Attorney, to the Memorandum of Agreement with
Metropolitan Dade County, dated July 1, 1995, for the use of $12,573.56 of Fiscal Year
1993 HOPWA Program funding to provide utilities assistance to eligible persons with
HIV/AIDS, or related diseases.
Section 3. This Resolution shall become effective immediately upon its adoption.

It is respectfully recommended that the City Commission adopt the attached Resolution
authorizing the City Manager to execute a contract amendment with Metropolitan Dade
County's Department of Human Resources (Office of Community Services), for the provision of
utilities assistance to very low income individuals with HIV/AIDS or related diseases. Funding
for this service is being provided by the U.S. Department of Housing and Urban Development
from the fiscal year 1993 Housing Opportunities for Persons With AIDS (HOPWA) Grant
Program.
BACKGROUND:
NET recommends that the City Commission adopt the attached resolution authorizing the City
Manager to execute a contract amendment with Metropolitan Dade County's Department of
Human Resources (Office of Community Services) in connection with the provision of utilities
assistance to very low income individuals with HIV/AIDS or related diseases.
On June 4, 1993, the City's Grant Agreement with U.S. HUD was executed. This event
commenced the three (3) year time frame whereby the City must expend the $4,697,000
HOPWA Grant Program funds. Over the last two and a half years, the City has funded various
nonprofit and governmental agencies to provide housing and related services to very low income
persons with AIDS throughout the entire Dade County eligible metropolitan statistical area
(EMSA). The funds for this award are the accumulation of the unused balances of the service
contracts funded from the 1993 HOPWA Grant Program fiscal year. In order to utilize the entire
1993 HOPWA Grant awarded the City, the unused funds must be expended prior to June 4,
1996, otherwise U.S. HUD may recoup the unused funds. Awarding the unexpended balance of
$12, 573.56 to Metropolitan Dade County's Department of Human Resources (Office of
Community Services) will enable complete utilization via an amendment to an existing contract
for utilities assistance with said agency.

It is the recommendation of the HOPWA Advisory Board and the City Administration that
Metropolitan Dade County's Department of Human Resources (Office of Community Services)
be awarded $12,573.56 to provide utilities assistance.
City Commission ratification of the attached resolution is recommended.
