A RESOLUTION, WAIVING BY A 4/5THS AFFIRMATIVE VOTE OF THE MEMBERS OF THE CITY COMMISSION, AFTER A DULY ADVERTISED PUBLIC HEARING, THE PROHIBITION CONTAINED IN CITY CODE SECTIONS 2-301 THROUGH 2-304, AS SUCH PROHIBITION APPLIES TO MARY FRANCES WELDON, WHO SERVES ON THE CITY OF MIAMI HOUSING OPPORTUNITIES FOR PERSONS WITH AIDS (HOPWA) ADVISORY BOARD, IN RELATION TO HER EMPLOYMENT WITH THE CHRISTIAN COMMUNITY SERVICE AGENCY, A SUCCESSFUL PROPOSER FOR THE PROVISION OF SERVICES IN CONNECTION WITH THE CITY'S 1995 HOPWA PROGRAM FUNDED BY THE U.S. DEPARTMENT OF HOUSING AND URBAN DEVELOPMENT. WHEREAS, Mary Frances Weldon is currently serving as a member of the City's I' 1995 HOPWA Advisory Board (HAB) and is employed by Christian Community Service Agency; and i WHEREAS, Christian Community Service Agency is seeking to provide housing related services in connection with the City's 1995 HOPWA Program; and WHEREAS, Christian Community Service Agency has been recommended by the j i f 1995 HAB, the 1995 HOPWA Selection Committee and the City Administration to 1 receive 1995 HOPWA Program funding; and -CITY COMMISSION MEETING OF 96- 43 NOW, THEREFOR, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are hereby adopted by reference thereto and incorporated herein as if fully set forth in this Section. Section 2. The waiver set forth in Section 3 hereof is based upon the recitals and I findings contained in Section 1 hereof and upon the following findings: (a) The City of Miami has determined that Mary Frances Weldon is a member in good standing of the City of Miami Housing Opportunities I for Persons with AIDS (HOPWA) Advisory Board and is currently i employed by Christian Community Service Agency, being the designated sponsor for the provision of services in connection with the City's 1995 HOPWA Program which is funded by the U.S. Department of Housing and Urban Development, which relationship would be in violation of City Code Sections 2-301 through 2-304 were not a waiver of the prohibition contained in said Sections. (b) The herein proposed participation will be in the best interest of the City of Miami in connection with the 1995 HOPWA Program. 2 ti D f�l Section 3. The prohibition contained in Sections 2-301 through 2-304 of the City Code is hereby waived by a 4/5ths affirmative vote of the City Commission, after a duly advertised public hearing. Section 4. BACKGROUND: NET recommends City Commission ratification of the attached resolutions, waiving by 4/5ths affirmative vote of the City Commission, the prohibition contained in City Code Sections 2- 301 through 2-304, to allow three (3) members of the City's HOPWA Advisory Board and their respective organizations to receive funding to provide housing and related services to very low income persons living with AIDS, in connection with. the implementation of the City's 1995 HOPWA Program. In March of 1995, the City of Miami, on behalf of Metropolitan Dade County and the cities of Hialeah and Miami Beach, applied for $7,906,000 in HOPWA Program funding from the U.S. Department of Housing and Urban Development (HUD), as part of the City's 1995 Consolidated Plan. In October of 1995, the *City was notified by U.S. HUD that due to a recission of $15 million in the nationwide HOPWA Program, the City's allocation had been reduced accordingly. This resulted in the City's 1995 HOPWA allocation being $7,268,000, a reduction of $638,000 or 8.1% from the originally applied for $7,906,000. However, it should be emphasized that this is a $2,113,000 or 41% increase above the City's 1994 HOPWA award. 9G-- 43 1 l r x., • r The Honorable Mayor and Members of the City Commission Page 2 In August of 1995, in anticipation of the 1995 HOPWA allocation, the 'city , solicited applications from local area not -for -profit and governmental agencies for the purpose of providing housing and related services to very low income persons living with AIDS in connection with the 1995 HOPWA Program. Subsequently, the 1995 HOPWA Selection Committee evaluated and made recommendations on applications submitted for funding. In November of 1995, the HOPWA Advisory Board recommended that some funding be directly awarded to three agencies which are pro- viding the same services under the 1994 HOPWA Program, but as of November had obligated their entire 1994 allocations. This re- commendation seeks to avoid a gap in services to those in need. The 1995 HOPWA Selection Committee concurs with the HOPWA Advisory Board's recommendations. Based on the proposal's which were received and the recommenda- tions of the Selection Committee, funding has been recommended for three (3) organizations that currently have representatives on the HOPWA Advisory Board.
