BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. CLARK, MAYOIq'ATE : December 15, 1995 FILE AND MEMBERS OF THE CITY COMMISSION SUBJECT: Seven Appointments Needed to the Commission on the Status of Women FROQ_�) REFERENCES: Walter J. an January 25 Agenda City Clerk ENCLOSURES: The Commission on the Status of Women has 25 members. Each member of the Commission is to have five appointments to said board, but only Mayor Clark has made his five appointments. Vice Mayor Gort has made one appointment. Commissioner Plummer has made one appointment. Commissioner Dawkins has made two appointments. Former Commissioner De Yurre made two appointments. The remaining 14 members were appointed by the City Commission from a slate presented by the board's coordinator, Betty Kaynor. The approval of 14 members at large on July 14, 1994 made it unclear as to how one determines each Commissioner's appointments. City Code Section 2-429 states, in part: "...When the nominating commissioner leaves office the board member's term shall expire." Former Commissioner De Yurre had nominated Nancy Minett and Josefina Sanchez-Pando, who were appointed by the City Commission as board members to the Commission on the Status of Women. Since the aforementioned nominating Commissioner has left office, Ms. Minett's and Ms. Sanchez-Pando's terms have expired. The term(s) of office of board members shall run concurrently with the term of office of the Commissioner that nominates each member. Therefore, the nominations for appointments needed to fill the seats currently held by Ms. Minett and Ms. Sanchez-Pando are to be made by Commissioner Carollo. Rosario Roman and Marian M. Smith, who had been appointed at large from the aforementioned slate, have resigned (copy of letters attached). It is unclear which Commissioner should make the nominations for these two appointments. Lisa Gold, nominated by Commissioner Plummer and appointed by the Commission, has declined to serve on the board. City Code Section 2-430, entitled "Attendance requirement," reads as follows: "Notwithstanding any other provision of this Code, any board member shall be automatically removed if, in a given calendar year; (i) he or she is absent from three (3) consecutive meetings; or, (ii) if he or she is absent from four (4) of the board's meetings; (III) provided that regardless of their compliance with subsection (i) and (ii) hereinabove, members must attend at least fifty (50) percent of all the board meetings held during a year. A member of a city board shall be deemed absent from a meeting when he or she is not present at the meeting at least seventy-five (75) percent of its duration. The provisions of this section may be waived by a four -fifths (4/5) vote of the members of the full city commission." 96- 21 Marie Rodriguez, nominated by Mayor Clark and appointed by the Commission, has been absent from four meetings within a calendar year (1995). Audrey Stoeckel -Gomez, nominated by Mayor Clark and appointed by the Commission, has been absent from three consecutive meetings within a calendar year (1995). Betty Kaynor, Coordinator for the Commission on the Status of Women, is recommending that the Mayor renominate for reappointment by the Commission Ms. Rodriguez. Ms. Stoeckel -Gomez is unable to continue serving on the board due to conflicting business schedules. Ms. Kaynor is recommending that the Mayor renominate Sonia Yahr-Schneider (resume attached) to fill the vacancy left by Ms. Stoeckel -Gomez. By copy of this memorandum, we are requesting that the Agenda Office place this issue on the January 25, 1996 Commission agenda.
