RESOLUTION, WITH ATTACHMENT, AUTHORIZING THE
TY MANAGER TO ACCEPT A GRANT FROM
TROPOLITAN DADE COUNTY, FLORIDA IN THE AMOUNT
$77,774.05, FOR THE DESIGN AND CONSTRUCTION
A WHEEL -CHAIR ACCESSIBLE TRAIL AT MERRIE
RISTMAS PARK, THE PURCHASE OF TWO
ANSPORTATION VANS FOR PROGRAMS FOR PERSONS
TH DISABILITIES, AND FOR THE PRODUCTION AND
SSEMINATION OF PUBLIC INFORMATION MATERIALS
OMOTING AN AWARENESS OF SERVICES AVAILABLE TO
RSONS WITH DISABILITIES AT A LOCAL LEVEL;
RTHER AUTHORIZING THE CITY MANAGER TO EXECUTE
AN INTERLOCAL AGREEMENT, IN SUBSTANTIALLY THE
ATTACHED FORM, WITH METROPOLITAN DADE COUNTY,
FLORIDA, FOR SAID GRANT ACCEPTANCE.
WHEREAS, Section 316.1967 Florida Statutes and

Section 30-447, Code of Metropolitan Dade County, Florida,

authorize the charging of fines for misuse of specially

marked parking spaces for people with disabilities; and }
WHEREAS, Metropolitan Dade County proposes to
distribute said fine revenues under the provisions of
Section 30-447 of the Code of Metropolitan Dade County; and
WHEREAS, Metropolitan Dade County, Florida, in
conformance with the distribution provisions of said fine
revenues, has awarded the City of Miami a grant in the j
amount of $77,774.05 for the design and construction of a

wheel -chair accessible trail at Merrie Christmas Park, the
purchase of two transportation vans for the Department of
Parks and Recreation Programs for Persons With Disabilities,
and for the production and dissemination of public
information materials promoting an awareness of services
available to persons with disabilities at a local level; and
WHEREAS, Capital Improvement Program will provide
fifty percent (50%) matching fund for the design and
construction of a wheel -chair accessible trail at Merrie
Christmas Park up to the amount of the portion of the grant
award allocated for that purpose, $20,000;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF
THE CITY OF MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the
Preamble to this Resolution are hereby adopted by reference
thereto and incorporated herein as if fully set forth in
this Section.
Section 2. The City Manager is hereby authorized to
accept a grant from Metropolitan Dade County, Florida, in
the amount of $77,774.05 for the design and consrtruction of
a wheel -chair accessible trail at Merrie Christmas Park, the
purchase of two transportation vans for the Department of
Parks and Recreation Programs for Persons With Disabilities,
and and for the production and dissemination of public
information materials promoting an awareness of services
available to persons with disabilities at a local level.

Section 3. The City Manager is further authorized to
execute an Interlocal Agreement, in substantially the
attached form, with Metropolitan Dade County, Florida for
said grant acceptance.
Section 4. This Resolution shall become effective
immediately upon its adoption.

It is respectfully recommended that the City Commission pass the attached resolution authorizing the City
Manager to accept a grant award in the amount of $77,774.05 for the design and construction of a wheel-
chair accessible trail at Morrie Christmas Park, the purchase of two transportation vans for the Department
of Parks and Recreation Programs for Persons With Disabilities, and for the production and dissemination of
pubic information materials that promote awareness of services available at the local level to persons with
disabilities.
BACKGROUND
On March 15, 1995 the Finance Department and Parks and Recreation Department submitted a proposal to
the Office of ADA Coordination, Metro -Dade County, requesting a grant of $77,774.05 for purposes relating
to compliance with the ADA provisions concerning access to public facilities and services for persons with
disabilities. The grant proposal contained three request items: funding for designing and building a
wheelchair -accessible trail at Morrie Christmas Park, buying two transportation vans for Programs for
Persons with Disabilities, and developing and disseminating informational materials on the requirements of
the Americans with Disabilities Act as well as related State and local legislation. This item also called for
developing informational materials on services offered by the City to persons with disabilities and the specific
activities offered through Programs for Persons with Disabilities. The portion of the grant designated for
capital improvements -- $20,000 -- is subject to a dollar -for -dollar match from the Capital Improvement
Program.
The City has been notified of a grant award by Metro -Dade of the full amount requested. City Commission
ratification of the attached resolution is recommended.

INTER -LOCAL AGREEMENT
This agreement is entered into this 30 day of November 1995 year, by and
between Dade County, Florida, a political subdivision of the State of Florida (the "County") and
City 6f Miami" (the "City"), a municipal corporation organized and existing under the laws of
the'State of Florida. i.
W ITNESSETH
WHEREAS, Section 316 1967, Florida Statutes, and Section 30-447. Code of Metropolitan
Dade County, authorizes the charging of fines for misuse of specially marked parking spaces for
people with disabilities; and
WHEREAS, Dade County proposes to distribute said fines under the provisions of Section
30-447 of the Code of Metropolitan Dade County, Florida,
NOW THEREFORE in consideration of the covenants contain herein, the parties agree as
follows

2. The allocation of the disabled parking fine monies shall be used to provide funds to
improve accessibility and equal opportunity to qualified physically disabled persons and to
provide funds to conduct public awareness programs concerning physically disabled
persons

of Americans with Disabilities Act Coordination, hereinafter knowrnas the "ADA Office"

application assessment, monitoring and management evaluation and performance
review for organizations providing community services as specified by
Administrative Order 3-15
f Future funding is contingent upon proper completion and reporting of previous }
programs or projects

a. The percentages for distribution shall be calculated by the County annually. 1

By December 1st of each year the County shall notify all municipalities of the t

percentages for distribution of the disabled permit parking fine money for the
upcoming annual period commencing February I The percentage for distribution
to the County and to municipalities are based on a percentage of total revenue
which is determined by calculating the total amount paid on tickets in a
municipality divided by the total number of tickets paid county -wide Funding
estimates include a percentage of the monies which were not distributed
to any municipalities in the previous year

b. The City agrees to render services in accordance with the Scope of Se

c. The County agrees to pay the City under this agreement based on a payment
schedule agreed upon by the Office of ADA Coordination, accompanied by such
documentation as requested.
d. In no event shall County funds be advanced to any subcontractor hereunder
e Within thirty (30) days after the annual commencement period of this
Agreement, an annual report of expenditures is to be submitted to the ADA Office_
If after receipt of such annual repon, the ADA Office determines that the City
inadvertently has been paid funds not in compliance with the Agreement, and to
which it is not entitled, the City will be required to return such funds to the
County or submit appropriate documentation The County shall have sole
discretion to determine if the City is entitled to such funds and the County's
decision on this matter shall be binding

k successfully completed and shall allow the Office of ADA Coordination to audit
projects and conduct site visits Any such audits or inspections shall be conducted

in such manner and at such times so as not to unreasonably interfere with the. day j
to day operation of the parties
g. The County may amend the terms of this agreement from time to time as it
may deem necessary.
IN WITNESS WHEREOF, the parties have caused this agreement to be executed by their
respective and duly authorized officers on the date hereinabove first mentioned.
