HomeMy WebLinkAboutO-11431J-96-412 12/12/96 ORDINANCE NO. 11431 AN ORDINANCE, WITH ATTACHMENT (S), AMENDING THE ZONING ATLAS OF THE ZONING ORDINANCE OF THE CITY OF MIAMI, FLORIDA, ARTICLE 4, SECTION 401, SCHEDULE OF DISTRICT REGULATIONS, BY CHANGING THE ZONING CLASSIFICATION FROM R-1 SINGLE-FAMILY RESIDENTIAL TO SD-2 COCONUT GROVE CENTRAL COMMERCIAL DISTRICT FOR THE PROPERTY LOCATED AT 3240 FLORIDA AVENUE, MIAMI, FLORIDA; AND BY MAKING ALL THE NECESSARY CHANGES ON PAGE NO. 46 OF SAID ZONING ATLAS; CONTAINING A REPEALER PROVISION, A SEVERABILITY CLAUSE, AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the Miami Zoning Board at its meeting of June 17, 1996, Item No. 6, following an advertised hearing, adopted Resolution No. ZB 69-96, by a seven to zero (7-0) vote, RECOMMENDING DENIAL of a change of zoning classification, as hereinafter set forth; and WHEREAS, the City Commission, notwithstanding the Zoning Board's recommendation, after careful consideration of this matter, deems it advisable and in the best interest of the general welfare of the City of Miami and its inhabitants to grant this change of zoning classification as hereinafter set forth; NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: iATTACHMENT (g)I CONTAINED 1 41 Section 1. The Zoning Atlas of Ordinance No. 11000, as amended, the Zoning Ordinance of the City of Miami, Florida, Article 4, Section 401, Schedule of District Regulations, is hereby amended by changing the zoning classification from R-1 Single -Family Residential to SD-2 Coconut Grove Central Commercial District for the property located at 3240 Florida Avenue, Miami, Florida, legally described in Exhibit "Al' attached hereto and made a part hereof. Section 2. It is hereby found that this zoning classification change: (a) is in conformity with the adopted Miami Comprehensive Neighborhood Plan; (b) is not contrary to the established land use pattern; (c) will not create an isolated district unrelated to adjacent and nearby districts; (d) is not out of scale with the needs of the neighborhood or the City; (e) will not materially alter the population density pattern or increase or overtax the load on public facilities such as schools, utilities, streets, etc.; (f) is necessary due to changed or changing conditions; (g) will not adversely influence. living conditions in the neighborhood; (h) will not create or excessively increase traffic congestion or otherwise affect public safety; (i) will not create a drainage problem; -2- 11431 (j) will not seriously reduce light and air to adjacent area; (k) will not adversely affect property value in the adjacent area; (1) will not be a deterrent to the improvement or development of adjacent property in accord with existing regulations; and (m) will not constitute a grant of special privilege to an individual owner so as to compromise the protection of the public welfare. Section 3. Page No. 46 of the Zoning Atlas, made a part of Ordinance No. 11000, as amended, the Zoning Ordinance of the City of Miami, Florida, by reference and description in said Ordinance, is hereby amended to reflect the changes made necessary by this Amendment. Section 4. All ordinances or parts of ordinances insofar as they are inconsistent or in conflict with the provisions of this Ordinance are hereby repealed. Section 5. If any section, part of section, paragraph, clause, phrase, or word of this Ordinance is declared invalid, the remaining provisions of this Ordinance shall not be affected. Section 6. This Ordinance shall become effective concurrently with the effective date of its companion Comprehensive Plan amendatory ordinance (J#96-431)which is now being considered by this City Commission for the same parcel of property. Further, this ordinance shall not take effect until such time as said companion ordinance, J#96-431, also takes -3- 11431 effect, after final reading and adoption thereof, pursuant to Section 163.3189, Florida Statutes (1995). The Complainants are the owners and residents of homes located in close proximity to that property more particularly located at 3240 Florida Avenue, City of Miami, Florida (the "subject property") which is the subject matter of the City of Miami Ordinance No. 11448 ("Ordinance") and companion Ordinance No. (currently unnumbered) (collectively, the "subject development orders").' The final hearing on the subject development orders occurred on February 27, 1997. True and correct copies of the subject development orders are attached to this ' As of the date of this verified complaint, the City of Miami has not rendered the unnumbered Ordinance attached hereto. When such ordinance is rendered and assigned a number, the Complaints shall amend this complaint to include same. SHUBIN & BASS, P.A. verified complaint as composite Exhibit "A" and incorporated herein. 2. The City of Miami is a municipal corporation within the State of Florida. The City of Miami is subject to the requirements of Section 163, part 2, Florida Statutes, the "Local Government Comprehensive Planning and Land Development Act (the "Act")." 3. The City of Miami has previously adopted its Comprehensive Neighborhood Plan pursuant to the Act. 4. The subject property is located at approximately 3240 Florida Avenue. It is owned by Farmer's Market at Coconut Grove, L.C., a Florida limited liability company, whose members are H.W. Allen Sweeny, Sky Smith, and Thomas Sherman, As Trustee, according to the disclosure of ownership submitted by the applicants and maintained in the public records by the City of Miami. 5. The subject development orders materially alter the use, density, and intensity of use on the subject property so as to be not consistent with the City of Miami Comprehensive Development Master Plan adopted pursuant to the Act. 6. The Complainants will suffer, to a greater extent than the community at large, economic damage, which will have a negative impact on the value of their homes; negative traffic and parking impacts; the intrusion of the noise, lights, and exhaust which are -2- SHUBIN & BASS, P.A. typical of commercial uses and such uses will change the residential character of the neighborhood; and disruption of normal family life in the Complainants' homes if development pursuant to the subject development orders is accomplished. Specifically, the subject development orders propose to amend the Comprehensive Neighborhood Plan by changing the land use designation of property located at approximately 3240 Florida Avenue from single family residential to restricted commercial. 7. The subject development orders are inconsistent with the following goals, objectives, and policies of the Miami Comprehensive Neighborhood Plan (MCNP) for the reasons set forth herein: (a) The increased densities of the commercial activities intruding into the existing residential neighborhood created by the subject development orders are not consistent with the future low density residential use pattern proposed for the area actually designated Single Family Residential; (b) The subject development orders are in conflict with MCNP Land Use Policy 1.1.3 which requires that all the areas of the City be protected from encroachment of incompatible land uses; (c) The subject development orders are in conflict with MCNP Housing Policies 1.1.5 and 1.2.7 which require the City to preserve -3- SHUBIN & BASS, P.A. and enhance the general apearance of the character of the City's neighborhood; (d) The Restricted Commercial areas, south and southeast of the subject property have sufficient capacity to accommodate commercial uses. WHEREFORE, Complainants demand that the City of Miami rescind the subject development orders, as well as any other action taken with it, or subsequent to it, in accordance with it, including, but not limited to any building permits, as being inconsistent with the MCNP. The Florida Avenue Homeowners of the 3200 Block and in all adjoining areas of West Grove/Black Grove are adamantly opposed to have this block rezoned from R-1 Single -Family Residential for any purpose or reason. Somewhere, somehow, the continuous petitions from rich white developers to build parking lots next to our quiet residential areas have got to stop. We are not and -business, but someone has to have the decency and common sense to find a balance of interest ber4reen longtime homeowners and reasonable business interest in residential neighborhoods. This has been my home block for 36 years. We are opposed to rezoning this block for commercial uses and destroying our residential neighborhood. We do not want to live behind a parking lot and we do not want or need Townhouses in this block. We are opposed to having the frontside of Florida Avenue cut into a 40 feet strip for Townhouses and 60 feet on the backside for parking. This type zoning will create real undesirable problems and will discriminate against our constitutional rights to live in a safe neighborhood environment. We live less than 50 feet from this site. The block will become overcrowded. Also, this type of zoning would open the flood gates to commercilation of residential streets throughout West Grove, replacing R- 1 Single Family Residential homes with a parking lot and .39q some cheap Townhouses. Townhouses with no yards and garages. Townhouses where motorcycle gangs and other undesirables will live. The Rezoning of the 3200 block of Florida Avenue from R-1 Single -Family Residential to SD-2 Coconut Grove Commercial District will positively destroy living conditions in our neighborhood. The Zoning will not be in scale with the needs of our neighborhood and the zoning will not be in harmony with the present or established land use pattern in this block. The change in zoning on this block will affect the sewage. The sewage will be filled with millions of deadly germs and will seep through the ground and damage our water supply. The 3200 block on Florida Avenue is not in the target area of West Grove. Therefore, the residents are not seeking welfare work or affordable housing. We are very sure that the proposed zoning will excessively increase traffic congestion and effect our safety and health. We will get a high percentage of Air Pollution from the cars in and out our neighborhood. Carbon Monoxide gases will affect our health. Our living conditions will be damaged with new crime and new criminals, noise from car alarms, loud music and glaring lights. Would you want to live in this type neighborhood?
