AN EMERGENCY ORDINANCE AMENDING SECTION 53-161(4) OF THE CODE OF THE CITY OF MIAMI, FLORIDA, AS AMENDED, ENTITLED "SCHEDULE OF FEES" THEREBY ESTABLISHING REVISED PARKING RATES AT THE JAMES L. KNIGHT INTERNATIONAL CENTER PUBLIC PARKING FACILITY; CONTAINING A REPEALER PROVISION AND A SEVERABILITY CLAUSE. WHEREAS, the City Commission has declared that a financial emergency exists; and WHEREAS, the Trust Indenture for the James L. Knight International Center requires that recommendations for revisions of rates for the facility be prepared each year and submitted to the Director of the Convention Center; and WHEREAS, a parking study of comparable parking lots in the major buildings and flat, open lots in downtown Miami was conducted and indicates that changes in parking rates are necessary at Miami Convention Center Parking Garage (Garage No. 4) to remain competitive with other parking facilities and increase revenues for the City of Miami; and WHEREAS, the Department of Off -Street Parking and the Director of the Convention Center recommend changes to certain rates; NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: 11427 Section 1. Section 53-161 (4) of the Code of the City of Miami, Florida, as amended, is hereby amended in the following particularsl/: "Sec. 53-161. Schedule of fees. The schedule of rents, rates, fees and charges for the use or occupancy of and for the services furnished or to be furnished in connection with the Convention Center of the City of Miami/University of Miami James L. Knight International Center, also known as the "Miami Convention Center," is established as follows: (4) Convention Center Parking Garage (including state sales tax) . Rate Category Rate Half-hour....................................$1.50 (in by 9.^-00 a.m., eut b 7*90 ......$ 4.50 Maximum ............................$12-00. .$15.00 Special event (pre -arranged) ........ $4.00.. .55.00 Monthly (plus state sales tax).......$ 95.00 11 Section 2. All ordinances or parts of ordinances insofar as they are inconsistent or in conflict with the provisions of this Ordinance are hereby repealed. Section 3. If any section, part of section, paragraph, clause, phrase or word of this Ordinance is declared invalid, the remaining provisions of this Ordinance shall not be affected. This Ordinance is hereby declared to be an emergency measure on the grounds of urgent public need for the preservation of peace, health, safety, and property of the City of Miami. Section 5. The requirement of reading this Ordinance on two separate days is hereby dispensed with by an affirmative vote of not less than four -fifths of the members of the Commission. Section 6. The rates provided for by this Ordinance shall become effective as of February 1, 1997. Section 7. This Ordinance shall become effective immediately upon adoption thereof.
