ORDINANCE NO. 11425
AN EMERGENCY ORDINANCE, AMENDING SECTION 42-8
OF THE CODE OF THE CITY OF MIAMI, FLORIDA, AS
AMENDED, ENTITLED* "SPECIAL DEPARTMENTAL
SERVICES; FEES", THEREBY ESTABLISHING THE FEES
THAT MAY BE CHARGED FOR SPECIAL DEPARTMENTAL
SERVICES; CONTAINING A REPEALER PROVISION AND A
SEVERABILITY CLAUSE; AND PROVIDING FOR AN
EFFECTIVE DATE.
WHEREAS, pursuant to Florida Statutes, the City of Miami is authorized to establish fees
be charged for special departmental services; and
WHEREAS, the Department of Police has recommended these increases;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF
MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the preamble to this Ordinance are
hereby adopted by reference thereto and incorporated herein as if fully set forth in this Section.
Section 2. Section 42-8 of the Code of the City of Miami, Florida, as amended, is hereby
amended in the following particulars:'
Words and/or figures stricken through shall be deleted. Underscored words and/or figures shall be added.
The remaining provisions are now in effect and remain unchanged. Asterisks indicate omitted and
unchanged material.

Sec 42-8. Special departmental services; fees
(a) Record checks. The Police Department may furnish, to any person upon
request, a written statement certifying that the files of the department have been
checked and fail to reveal any criminal record under the name of that person. The
statement may be furnished for the sum of ten dollars ($10.00)
for each such statement.
(b) Accident reports and photographs. The records unit of the police department
shall furnish upon request:
(1) An original copy of any accident or offense report which is on file with the
Records Unit, for the sum of one dollar ($1.00) per
certified page
(e) Miscellaneous documents. Miscellaneous documents not enumerated above
shall be furnished for a sum of fifteen cents
($0.15) for a one-sided page and twenty cents $0.20) for a two-sided page for
copies of a maximum size of 8 1/2" by 14", or as otherwise provided in Section
119.07 1), Florida Statutes.
Fees for storing transporting and publishing notice for lost/ ound property.
The Property Unit of the Police Department shall collect $100.00 from the
rightful owner of lost/found property upon the return by the Police
Department of lost/found property taken into custody pursuant to Section
705.102 Florida Statutes. This fee covers the cost of transporting, storing
and publishing the lost/found property by the Police Department. In instances
where the property is valued at $100.00 or under, such property maw
redeemed by the owner by pang a fee equal to the value of the property
returned. If the rightful owner does not pay such fees within 30 days of the
claim, title to the property vests in the Police Department.

(h) Administrative fee for police conducted inspections and for processing
transaction forms by the Pawn Shop Detail. Each pawn shop conducting
business within the Citv of Miami shall pay a yearly fee of two hundred fifty
dollars $250.00) for police inspections of pawn shops and other related
functions by the Police Department's Pawn Shop Detail. In addition thereto
each pawn shop operator will nay a $1.50 fee per pawn form submitted to the
Police Department for the review and processing of all forms submitted b, the
Pawn Shop Detail. The finance department is hereby authorized empowered
and directed to establish the proper procedure for the handling of all monies
collected."
Section 3. All ordinances or parts of ordinances insofar as they are inconsistent or in
conflict with the provisions of this Ordinance are hereby repealed.
Section 4. If any section, part of section, paragraph, clause, phrase, or word of this
Ordinance is declared invalid, the remaining provisions of this Ordinance shall not be affected.
Section 5. This Ordinance is hereby declared to be an emergency measure on the grounds
of urgent public need for the preservation of peace, health, safety, and property of the City of
Miami, and upon the further grounds of the necessity of the City of Miami to make the required
and necessary payments to its employees and officers, payment of its debts, necessary and
required purchases of goods and supplies, and to generally carry on the functions and duties of
municipal affairs.
Section 6. The requirements of reading this Ordinance on two separate days is hereby
dispensed with by an affirmative vote of not less than four -fifths of the members of the
Commission.

Section 7. This Ordinance shall be come effective immediately upon adoption.

ENCLOSURES:
It is respectfully recommended that an Ordinance amending Section 42-8, of the Code "of the City
of Miami, establishing the maximum rates that may be charged for special departmental service
fees, be adopted.
BACKGROUND:
The Department of Police has recommended that the fees for special departmental services, such as
certified reports and good conduct letter, be increased. In addition, they are recommending that a
fee be instituted for storing, transporting and publishing notice for lost/found property and an
administrative fee for police conducted inspections and processing transaction forms for Pawn
Shops.
