HomeMy WebLinkAboutO-11416J-96-1264 12/3/96 ORDINANCE NO. 11416 AN EMERGENCY ORDINANCE AMENDING SECTION 5 OF ORDINANCE NO. 6145, ADOPTED MARCH 19, 1958, AS AMENDED, WHICH ESTABLISHED FEES FOR BUILDING, PLUMBING, ELECTRICAL, MECHANICAL, (INCLUDING BOILER AND ELEVATOR) INSPECTION, PERMIT AND CERTIFICATE FEES, THEREBY ADDING AND INCREASING REQUIRED FEES TO COVER COSTS FOR THE ENFORCEMENT OF THE SOUTH FLORIDA BUILDING CODE; CONTAINING A REPEALER PROVISION, SEVERABILITY CLAUSE, AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, Section 5 of Ordinance No. 6145, adopted, March 19, 1958, as amended, provides fees for building, plumbing, electrical, and mechanical (including boiler and elevator) inspection permit and certificate fees; and WHEREAS, the City Manager recommends that Ordinance No. 6145, as amended, be amended to increase certain fees and establish certain additional fees to cover the cost for the enforcement of the South Florida Building Code in order to provide much needed services for the operation of the City of Miami; NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: 11416 Section 1. The recitals and findings set forth in the Preamble to this Ordinance are hereby adopted by reference thereto and incorporated herein as if fully set forth in this Section. Section 2. Section 5 of Ordinance No. 6145, adopted March 19, 1958, as amended, which provides fees for building, plumbing, electrical, mechanical (including boiler and elevator) inspection, permit and certificate fees, is hereby amended in the following particulars:l/ "Sec. 5 - FEE SCHEDULE. b. GENERAL FEES: (2) REINSPECTION OF EXISTING BUILDINGS AND INSPECTION FOR CERTIFICATE OF COMPLIANCE FEE: For the processing of the initial application for structural glazing recertification and each subsequent application under Sections 104.9 and 3315 of the South Florida Building Code $100.00 $250.00 (3) RECERTIFICATION OF PLANS AND REVISED PLANS FEE, AND PERMIT CARD REPLACEMENT: (c) Review of plans (per discipline) $50.00 (after second review) 1� Words and/or figures stricken through shall be deleted. All ordinances or parts of ordinances insofar as they are inconsistent or in conflict with the provisions of this Ordinance are hereby repealed. Section 4. If any section, part of section, paragraph, clause, phrase or word of this ordinance is declared invalid, the remaining provisions of this Ordinance shall not be affected. Section 5. This Ordinance is hereby declared to be an emergency measure on the grounds of urgent public need for the preservation of peace, health, safety, and property of the City of Miami. Section 6. The requirement of reading this Ordinance on two separate days is hereby dispensed with by an affirmative vote of not less than four -fifths of the members of the Commission. Section 7. The adoption of the attached emergency ordinance is required in order for the City of Miami to continue to provide the level of service the citizens of Miami deserve, as well as protect lives. The cost of properly enforcing the South Florida Building Code continues to increase, and it has become necessary to increase some fees to reflect the true cost of providing the service. The urgency of the increase is to cover the costs as quickly as possible for the remaining of the fiscal year. The Building and Zoning Department has found that various fees need to be properly identified in our fee schedule. These fees are required by code and are already a part of fee schedules in other municipalities throughout the County.
