HomeMy WebLinkAboutO-11404J-96-567 6/29/96 ORDINANCE NO. 11404 AN ORDINANCE AMENDING ARTICLE IV, CHAPTER 54, OF THE CODE OF THE CITY OF MIAMI, FLORIDA, AS AMENDED, BY AMENDING SECTION 54-84 ENTITLED: "NAMES OF DRIVES AND ROADS", BY CHANGING THE NAME OF SOUTH BAYSHORE DRIVE BETWEEN SOUTHEAST 8TH STREET AND SOUTHEAST 15TH ROAD TO BRICKELL BAY DRIVE; DIRECTING THE CITY CLERK TO TRANSMIT A COPY OF THIS ORDINANCE TO THE HEREIN DESIGNATED AGENCIES; CONTAINING A REPEALER PROVISION AND A SEVERABILITY CLAUSE; PROVIDING FOR AN EFFECTIVE DATE AND PROVIDING FOR INCLUSION IN THE CITY CODE. WHEREAS, at the October 26, 1995 City Commission meeting, a property owner requested the City Commission to change the name of South Bayshore Drive between Southeast 8th Street and Southeast 15th Road to Brickell Bay Drive; and WHEREAS, the City Commission, after careful consideration of this matter, deems it advisable and in the best interest of the general welfare of the City of Miami and its inhabitants to amend the Code of the City of Miami, Florida, as amended, as set forth herein; NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: If 404 Section 1. The recitals and findings contained in the Preamble to this Ordinance are hereby adopted by reference thereto and incorporated herein as if fully set forth in this Section. Section 2. Section 54-84 of the Code of the City of Miami, Florida, as amended, is hereby amended in the following particulars:l' Sec. 54-84. "CHAPTER 54 STREETS AND SIDEWALKS n Names of drives and roads. The thoroughfares now known as North River Drive and South River Drive shall continue to be called North River Drive and South River Drive. All The thoroughfares lying and being next adjoining Biscayne Bay between Southeast 8th Street and Southeast 15th Road shall be called ni__a ne Tom= B_rickell Bav Drive. All roads shall derive their names from the streets or avenues at which they shall commence." Section 3. The City Clerk is hereby directed to transmit a copy of this Ordinance to the United States Postal Authority, the Traffic and Transportation Section of the Metropolitan Dade County Public Works Department, the City of Miami Police Department, Public Works Department, and the Fire -Rescue Department. i� Words and/or figures stricken through shall be deleted. All ordinances or parts of ordinances insofar as they are inconsistent or in conflict with the provisions of this Ordinance are hereby repealed. Section 5. If any section, part of section, paragraph, clause, phrase or word of this Ordinance is declared invalid, the remaining provisions of this Ordinance shall not be affected. Section 6. It is the intention of the City Commission that the provisions of this ordinance shall become and be made a part of the Code of the City of Miami, Florida, as amended, which provisions may be renumbered or relettered and that the word "ordinance" may be changed to "section", "article", or other appropriate word to accomplish such intention. BACKGROUND At the October 26, 1995, City Commission meeting, property owners requested the City Commission to change the name of South Bayshore Drive between Southeast 81h Street and Southeast 15th Road to "Brickell Bay Drive". Unlike a street codesignation, this request is for an entire name change of a roadway, and as such, official mailing addressed and all legal documentation must reflect the proposed new name, including all utility and government accounts, records and signage. Existing name association with this roadways will be lost and the effect on the conduct of business will be considerable. Article Iv of Chapter 54 of the City code entitled "Naming of streets and numbering of buildings" establishes the names of City streets. If the City Commission determines it is advisable, and in the best interest of the general welfare of the city and its residents, to change the name of this roadway, an Ordinance amending Chapter 54 of the City Code must be adopted. The expenses incurred by the City associated with this name change include an advertising cost of $923.60 and, of approved, changing street identification signs at seven (7) intersections at an estimated cost of $1,000.
