HomeMy WebLinkAboutO-11402J-96-1038 8/21 /96 ORDINANCE NO. 11402 AN EMERGENCY ORDINANCE AMENDING SECTION V OF ORDINANCE NO. 11337, AS AMENDED, ADOPTED JANUARY 25, 1996, THE CAPITAL IMPROVEMENTS APPROPRIATIONS ORDINANCE, THEREBY INCREASING THE APPROPRIATIONS TO EXISTING CAPITAL IMPROVEMENT PROJECT NO. 418402, ENTITLED: "MERRILL STEVENS GROUNDS & PARKING AREA" FROM $110,400 TO $249,400; CONTAINING A REPEALER PROVISION AND A SEVERABILITY CLAUSE AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the City Commission, pursuant to Ordinance No. 11337, adopted January 25, 1996, established appropriations for Capital Improvements, continue previously approved Capital Improvement Projects, to begin during Fiscal Year 1995-96; and WHEREAS, the City of Miami has received additional funds from the Federal Emergency Management Agency and Off -Street Parking for Capital Improvement Project No. 418402, entitled "Merrill Stevens Grounds and Parking Area"; and WHEREAS, it is urgent for the preservation of public property to include said additional appropriations in an amount not to exceed $249,400 for this Capital Project scheduled to commence during Fiscal Year 1995-96; NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: 11402 Section 1. The recitals and findings contained in the Preamble to this Ordinance are hereby adopted by reference thereto and incorporated herein as if fully set forth in this Section. Section 2. Section V of Ordinance No. 11337, as amended, adopted January 25, 1996, is hereby amended in the following particulars:I, "Section 1. The herein appropriations are hereby made for implementation of all municipal Capital Improvements of the City of Miami, including new Capital Improvement Projects scheduled to begin during fiscal year 1995-1996. The herein appropriations which are hereby designated by reference to describe project title and number also include appropriations for previously approved scheduled projects as well as reappropriations of prior fund appropriations. The source of revenues to support the herein appropriations is hereby identified by fund and project with the project appropriations with revenues therefor being set forth for seven program (I - VII) areas based upon use or functional category within said areas, as follows: Total Appropriations ($X000) V. All ordinances or parts of ordinances insofar as they are inconsistent or in conflict with the provisions of this Ordinance are hereby repealed. Section 4. If any section, part of section, paragraph, clause, phrase or word of this Ordinance is declared invalid, the remaining provisions of this Ordinance shall not be affected. Section 5. This Ordinance is hereby declared to be an emergency measure on the grounds of urgent public need for the preservation of peace, health, safety, and property of the City of Miami, and upon the further grounds of the necessity to make the required and necessary payments to its employees and officers, payment of its debts, necessary and required purchases of goods and supplies, and to generally carry on the functions and duties of municipal affairs. Section 6. The requirement of reading this Ordinance on two separate days is hereby dispensed with by an affirmative vote of not less than four -fifths of the members of the Commission. accomplish such intention. BACKGROUND The area west of Merrill Stevens and Grove Key Marina was used as a debris staging area for debris removed from the south Grove after Hurricane Andrew. A Damage Survey Report was prepared by the Federal Emergency Management Agency (F.E.M.A.) for the restoration of this lot back to Its pre -disaster condition, with a value of $11o,400.00. In order to meet all existing codes and standards, which are paid for by F.E.M.A. a supplemental Damage Survey Report was written. for $ 74,000.00 to cover these expenses. In)provements that supersede restoring the lot to its pre -disaster condition will cost $65,000.00 to be funded by Off Street Parking.
