ORDINANCE NO. 11394
AN ORDINANCE ESTABLISHING A NEW SPECIAL
REVENUE FUND ENTITLED: "CLEAN VESSEL ACT
GRANT PROGRAM - MIAMARINA", AND APPROPRIATING
FUNDS FOR THE OPERATION OF SAME IN THE AMOUNT
OF $39,900.00 CONSISTING OF A GRANT FROM THE
FLORIDA DEPARTMENT OF ENVIRONMENTAL
PROTECTION (DEP); AUTHORIZING THE CITY
MANAGER TO ACCEPT SAID GRANT AWARD FROM DEP
AND TO EXECUTE THE NECESSARY DOCUMENT (S) , IN
A FORM ACCEPTABLE TO THE CITY ATTORNEY, FOR
THIS PURPOSE; CONTAINING A REPEALER PROVISION
AND A SEVERABILITY CLAUSE.
WHEREAS, the Florida Department of Environmental Protection
(DEP) is authorized, pursuant to Chapter 16A-11, Florida
Statutes, to provide grants to local governments to construct
pumpout facilities and purchase appropriate equipment for such
facilities; and
WHEREAS, the DEP has notified the Department of Public
Facilities that it is eligible to receive a grant in the amount
of $39,900.00, from the "Clean Vessel Act Grant Program"; and
WHEREAS, the Department of Public Facilities has identified
the need for a pumpout facility as part of the reconstruction
being done by the Department of Public Works at the Miamarina to
ensure and enhance environmental preservation, navigation, public

health and safety and/or the aesthetic condition of the general
vicinity;
NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the
Preamble to this Ordinance are hereby adopted by reference
thereto and incorporated herein as if fully set forth in this
Section.
Section 2. The following Special Revenue Funds is hereby
established and resources are hereby appropriated as described
herein:

RESOURCES: STATE OF FLORIDA DEPARTMENT OF $39,900
ENVIRONMENTAL PROTECTION
APPROPRIATION: CLEAN VESSEL ACT GRANT PROGRAM $39,900
MIAMARINA
Section 3. This appropriation is contingent upon the
approval of the City's application for said grant by the DEP, and
the City Manager's acceptance thereof.
Section 4. The City Manager is hereby authorized) to
accept said grant as set forth in the Preamble to this Ordinance
and to execute the necessary document(s), in a form acceptable to
the City Attorney, for this purpose.
The herein authorization is further subject to compliance with all requirements that may be imposed by the City
Attorney, including but not limited to those prescribed by applicable City Charter and Code provisions.

Section 5. All ordinances or parts of ordinances insofar
as they are inconsistent or in conflict with the provisions of
this Ordinance are hereby repealed.
Section 6. If any section, part of section, paragraph,
clause, phrase or word of this Ordinance is declared invalid, the
remaining provisions of this Ordinance shall not be affected.
Section 7. This Ordinance shall become effective thirty
(30) days after final reading and adoption thereof.

REFERENCPESotection for Construction of Pumpout
Station at Miamarina
ENCLOSURES.
It is respectfully recommended that the City Commission adopt the attached Ordinance authorizing
the City Manager to accept a grant in the amount of $39,900.00 from the Florida Department of
Environmental Protection, execute the necessary documents to implement acceptance of said
grant, and appropriate funds to the special revenue fund entitled: "Clean Vessel Act Grant
Program."
BACKGROUND:
The Department of Conferences, Conventions and Public Facilities has obtained a grant in the
amount of $39,900.00 from the Florida Department of Environmental Protection, which provides
funds to local governments to construct pumpout facilities and purchase appropriate equipment for
such facilities. The Department has identified the need for a pumpout facility at Miamarina to
provide the necessary services to vessels to ensure compliance with the Clean Vessel Act and to
provide for environmental preservation, public health and safety and the aesthetic condition of the
general vicinity.
