ORDINANCE NO. 11389
AN ORDINANCE AMENDING CAPITAL
IMPROVEMENTS ORDINANCE NO. 11337, AS
AMENDED, ADOPTED JANUARY 25, 1996 ;
CONTINUING AND REVISING PREVIOUSLY
APPROVED SCHEDULED CAPITAL IMPROVEMENT
PROJECTS AND ESTABLISHING NEW ' CAPITAL
IMPROVEMENT PROJECTS TO BEGIN DURING FISCAL
YEAR 1995-1996; PROVIDING CONDITIONS,
AUTHORIZATIONS AND DIRECTIONS TO THE CITY
MANAGER AND CITY CLERK; CONTAINING A
REPEALER PROVISION AND A SEVERABILITY
CLAUSE AND PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, the administration has designated certain projects proposed to be
undertaken in Fiscal Year 1995-1996 with General Obligation Bond Funds, Revenue
Bond Funds, Enterprise funds, General Fund Revenues, and with some federal and state
funds and private contributions, pursuant to Sections 30 and 34 of the City Charter, and
has included them in this proposed amending ordinance; and
WHEREAS, the City Commission pursuant to Ordinance No. 11337, adopted
January 25,1996, established appropriations for Capital Improvements, continue
previously approved Capital Improvement Projects, and establish new Capital
Improvement Projects to begin during Fiscal Year 1995-96; and

WHEREAS, the City of Miami has received additional funds from various grants
sources for the implementation of new and established Capital Improvement Project; and
NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE
CITY OF MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this
Ordinance are hereby adopted by reference thereto and incorporated herein as if fully set
forth in this Section.
Section 2. Section III., IV, and V. of Ordinance No. 11337, as amended,
adopted January 25,1996, is hereby amended in the following particulars:'
"Section 1. The herein appropriations are hereby made for
implementation of all municipal Capital Improvements of the City of Miami,
including new Capital Improvement Projects scheduled to begin during fiscal year
1995-1996. The herein appropriations which are hereby designated by reference to
descriptive project title and number also include appropriations for previously
approved scheduled projects as well as reappropriations of prior fund
appropriations. The source of revenues to support the herein appropriations is
hereby identified by fund and project with the project appropriations with revenues
therefor being set forth for seven program ( I - VII ) areas based upon use or
functional category within said areas, as follows:
I/ Words and/or figures stricken through shall be deleted. Underscored words and/or figures shall be
added. The remaining provisions are now in effect and remain unchanged. Asterisks indicate omitted and
unchanged material. All figures are rounded to the nearest hundred dollars.

Section 3. All ordinances or parts of ordinances insofar as they are
inconsistent or in conflict with the provisions of this Ordinance are hereby repealed.
Section 4. If any section, part of section, paragraph, clause, phrase or word
of this Ordinance is declared invalid, the remaining provisions of this Ordinance shall
not be affected.
Section 5. This Ordinance shall become effective (30) days after final reading
and adoption thereof.

RECOMMENDATION
It is respectfully recommended that the City Commission adopt the attached Ordinance
amending -Capital Improvement Ordinance No.11337, increasing appropriations for varieltz
Capital Improvements Projects identified therein and establishing new Capital Improvements
Projects to begin during Fiscal Year 1995-96.
BACKGROUND
Reduction in the federal budget, after the Capital improvement Amending Ordinance Item
No. 17 on the July I I" agenda was prepared, necessitates changes to all 22ad year C.D.B.G.
Funding. Therefore these changes are being submitted on first reading so that the a projects
can continue . -- -
The Office of Capital Improvements has prepared this Ordinaance amending Capital
Improvement Ordinance No. 11337 , adopted January 25,1996, in order to be able to
continue or commence the implementation of additional funds received by the City of Miami
from various grants sources, for the implementation -of said Capital Projects.
