HomeMy WebLinkAboutO-11380J-96-678 7/11/96 ORDINANCE NO. 11380 AN EMERGENCY ORDINANCE AMENDING SECTION 1 OF ORDINANCE NO. 11337, AS AMENDED, ADOPTED JANUARY 25, 1996, THE CAPITAL IMPROVEMENTS APPROPRIATIONS ORDINANCE, THEREBY INCREASING THE APPROPRIATION TO EXISTING CAPITAL IMPROVEMENT PROJECT NO. 331364, ENTITLED: "TACOLCY PARK C.D. IMPROVEMENTS" FROM $315,000 TO $415,000; CONTAINING A REPEALER PROVISION AND A SEVERABILITY CLAUSE. WHEREAS, the City Commission adopted Ordinance No. 11337 on January 25, 1996, to establish appropriations for Capital Improvements, continue previously approved Capital Improvement Projects, and establish new Capital Improvement Projects to begin during Fiscal Year 1995-96; and WHEREAS, said ordinance appropriated $315,000 to Project No. 331364, entitled "Tacolcy Park C.D. Improvements to provide structural and capital improvements to City -owned property located at 6161 Northwest 9th Avenue, Miami, Florida; and WHEREAS, pursuant to Resolution No. 96-53, the City Commission reallocated unexpended 21st Year Community Development Block Grant funds, in the amount of $100,000, from the project entitled "Edison Market Place" (Project No 702608) to the "Belafonte Tacolcy Center" (Project No 702701) to assist in providing structural improvements to the property; and 11380 WHEREAS, in order to complete structural repairs and renovations to the Belafonte Tacolcy Center prior to the United Way Kickoff Party scheduled for August 29, 1996, it is necessary to appropriate the reallocated 21st Year CDBG funds to said Capital Improvement Project; NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Ordinance are hereby adopted by reference thereto and incorporated herein as if fully set forth in this Section. Section 2. Section 1 of Ordinance No. 11337, as amended, adopted January 25,1996, is hereby further amended in the following particulars:l/ "Section 1. The herein appropriations are hereby made for implementation of all municipal Capital Improvements of the City of Miami, including new Capital Improvement Projects scheduled to begin during fiscal year 1995-1996. The herein appropriations which are hereby designated by reference to descriptive project title and number also include appropriations for previously approved scheduled projects as well as reappropriations of prior fund appropriations. The source of revenues to support the herein appropriations is hereby identified by fund and project with the project appropriations with revenues therefor being set forth for seven program (I - VII) areas based upon use or functional category within said areas, as follows: 1/ Words and/or figures stricken through shall be deleted. Underscored words and/or figures shall be added. The remaining provisions are now in effect and remain unchanged. Asterisks indicate omitted and unchanged material. All ordinances or parts of ordinances insofar as they are inconsistent or in conflict with the provisions of this Ordinance are hereby repealed. Section 4. If any section, part of section, paragraph, clause, phrase or word of this Ordinance is declared invalid, the remaining provisions of this Ordinance shall not be affected. Section 5. This Ordinance is hereby declared to be an emergency measure on the grounds of urgent public need for the preservation of peace, health, safety, and property of the City of Miami, and upon the further grounds of the necessity to make the required and necessary payments to its employees and officers, payment of its debts, necessary and required purchases of goods and supplies and to generally carry on the functions and duties of municipal affairs. - 3 - t1380 Section. 6. The requirement of reading this Ordinance on two separate days is hereby dispensed with by an affirmative vote of not less than four -fifths of the members of the Commission. Section 7.
