HomeMy WebLinkAboutO-11377J-96-599 6/27/96 ORDINANCE NO. 11,377 AN EMERGENCY ORDINANCE ESTABLISHING A SPECIAL REVENUE FUND ENTITLED: "ANTI -GANG INITIATIVE" AND APPROPRIATING FUNDS FOR THE OPERATION OF SAME, IN THE AMOUNT OF $500,000.00 RECEIVED BY THE CITY AS A GRANT FROM THE UNITED STATES DEPARTMENT OF JUSTICE; AUTHORIZING THE CITY MANAGER TO ACCEPT SAID GRANT AND TO EXECUTE THE NECESSARY DOCUMENTS, IN A FORM ACCEPTABLE TO THE CITY ATTORNEY, TO IMPLEMENT ACCEPTANCE OF SAID GRANT; CONTAINING A REPEALER PROVISION AND A SEVERABILITY CLAUSE. WHEREAS, the City of Miami Police Department will take a comprehensive approach to eradicate the most violent and influential gangs operating within the City; and WHEREAS, said task will be long term, complicated, and will demand extraordinary resources from most units within the Police Department; and WHEREAS, the United States Department of Justice has approved an award, in the amount of $500,000.00, to be used for the payment of overtime, equipment, consultants and other related expenses, with no matching funds required from the City of Miami, to accomplish said investigations; and WHEREAS, any purchases shall comply with established procurement procedures; NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: 11377 Section 1. The recitals and findings contained in the Preamble to this Ordinance are hereby adopted by reference thereto and incorporated herein as if fully set forth in this Section. Section 2. The following new Special Revenue Fund is hereby established and resources are hereby appropriated as described herein: FUND TITLE: ANTI -GANG INITIATIVE RESOURCES: U.S. Department of Justice $500,000. APPROPRIATIONS: Personnel Overtime $289,502. Travel $ 15,015. Equipment $ 80,000. Consultants/Contracts $ 25,000. Other Related Expenses $ 90,483. Section 3. The City Manager is hereby authorized'/ to accept a grant, in the amount of $500,000, and execute the necessary documents, in a form acceptable to the City Attorney, from the United States Department of Justice to implement acceptance of said grant. Section 4. All ordinances or parts of ordinances insofar as they are inconsistent or in conflict with the provisions of this Ordinance are hereby repealed. Section 5. If any section, part of section, paragraph, clause, phrase or word of this Ordinance is declared invalid, the remaining provisions of this Ordinance shall not be affected. The herein authorization is further subject to compliance with all requirements that may be imposed by the City Attorney, including but not limited to those prescribed by applicable City Charter and Code provisions. - 2 - 11377 Section 6. This Ordinance is hereby declared to be an emergency measure on the grounds of urgent public need for the preservation of peace, health, safety, and property of the City of Miami, and upon the further grounds of the necessity to make the required and necessary payments to its employees and officers, payment of its debts, necessary and required purchases of goods and supplies and to generally carry on the functions and duties of municipal affairs. Section. 7. The requirement of reading this Ordinance on two separate days is hereby dispensed with by an affirmative vote of not less than four -fifths of the members of the Commission. Section 8. Odio City Manager RECOMMENDATION: REFERENCES: Anti -Gang Initiative ENCLOSURES: It is respectfully recommended that an Emergency Ordinance establishing a Special Revenue Fund entitled: "Anti -Gang Initiative," accepting a grant from the U.S. Department of Justice, in the amount of $500,000.00, and appropriating said funds for the operation of same, be adopted. BACKGROUND: The Miami Police Department is taking a comprehensive approach to eradicate the most violent and influential gangs operating within our City. The eradication of a gang is not an easy task. It is long term, complicated, and demands extraordinary resources from various units within the Police Department. The methods used are varied, but the core component will be to treat gangs as emerging organized crime groups and to target them as such. To accomplish this task, the U.S. Department of Justice has authorized a grant, in the amount of $500,000.00, to be used towards the payment of overtime, equipment, consultants, and other related expenses. No matching funds are required by the City of Miami.
