AN ORDINANCE AMENDING THE ZONING ORDINANCE BY AMENDING SECTION 926 TO ALLOW SEALS AND EMBLEMS AS A MEANS OF BUILDING IDENTIFICATION; PROVIDING LIMITATIONS ON SUCH SIGNS; CONTAINING A REPEALER PROVISION AND A SEVERABILITY CLAUSE; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the Miami Planning Advisory Board, at its meeting of March 20, 1996, Item No. 6, following an advertised hearing, adopted Resolution No. PAB 18-96, by a vote of seven to zero (7-0), RECOMMENDING APPROVAL of amending Zoning Ordinance No. 11000 as hereinafter set forth; and WHEREAS, the City Commission after careful consideration of this matter deems it advisable and in the best interest of the general welfare of the City of Miami and its inhabitants to amend Ordinance No. 11000 as hereinafter set forth; NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Ordinance are hereby adopted by reference thereto and incorporated herein as if fully set forth in this Section. 11376 R Section 2. Ordinance No. 11000, as amended, the Zoning Ordinance of the City of Miami, Florida, is hereby amended by amending the text of said Ordinance as follows:l/ °ARTICLE 9. GENERAL AND SUPPLEMENTARY REGULATIONS Sec. 926. Signs; specific limitations and requirements. Sec. 926.16. Limitations on onsite signs above a height of fifty (5) feet above grade. For onsite signs above a height of fifty (50) feet above grade, the following regulations shall apply: 1. Building sign content shall be limited to the name of the building or the name of up to two (2) major tenant(s) of the building occupying more than five (5) percent of the gross leasable building floor area. 2. Signs shall consist only of individual letters and/or graphic logotype. No graphic embellishments such as borders, or backgrounds shall be permitted. 3. The maximum height of a letter shall be as follows: If Any Portion of a Sign is Maximum Letter Height (feet) Over four hundred (400) feet above grade ................. 9 The maximum height of a logo may exceed the maximum letter height by up to fifty (50) percent if its width does not exceed its height. The remaining provisions are now in effect and remain unchanged. Asterisks indicate omitted and unchanged material. - 2 - combined in an integrated fashion to form a seal or emblem representative of an institution or corporation, and when this emblem is to serve as the principal means of building identification, the following regulations shall apply. If Any Portion of a Sign is Over fifty (50) feet but but less than two hundred (200) feet above grade.... Over two hundred (200) feet but less than three hundred (300) feet above grade.... Over three hundred (300) feet but less than four hundred (400) feet above grade.... Maximum Sign Surface (sq. ft) 200 300 400 Over four hundred (400) feet above grade. 500 Section 3. All ordinances or parts of ordinances insofar as they are inconsistent or in conflict with the provisions of this Ordinance are hereby repealed. Section 4. If any section, part of section, paragraph, clause, phrase or word of this Ordinance is declared invalid, the remaining provisions of this Ordinance shall not be affected. Section 5. This Ordinance shall become effective thirty (30) days after final reading and adoption thereof. APPLICATION NUMBER 94-241 March 20, 1996 04/01/96 Item # 6 Page 1 11376 ANALYSIS FOR AMENDMENT TO ARTICLE 9, SECTION 926.16., OF THE ZONING ORDINANCE TO AMEND EXISTING SIGNAGE REGULATIONS The attached amendment to Article 9, Section 926.16. "Limitations on onsite signs above a height of fifty (50) feet above grade" seeks to allow corporate and institutional seals and emblems as a means of building identification, and further provide regulations and limitations for such signs. Section 926.16. functions presently as the sole regulatory provision for signs to be erected above a height of fifty (50) feet above grade. This section, as it presently reads, does not allow emblems, seals or crests to be implemented as a means of building identification. This proposal seeks to leave this option open while setting forth guidelines to regulate their implementation. It is felt that emblems and seals, both corporate and institutional, often have an ornamental character that text -only signs lack. Additionally, certain uses are more readily identified by their emblems than by text or graphic logotype. All such emblems or seals proposed at heights above fifty (50) feet would undergo Class II Special Permit review with compulsory referral to the City of Miami Urban Development Review Board.
