ORDINANCE NO. 113 7 3
AN EMERGENCY ORDINANCE RELATING TO THE TERMS
OF OFFICE OF THE MEMBERS OF CITY BOARDS,
THEREBY AMENDING THE CODE OF THE CITY OF
MIAMI, FLORIDA, AS AMENDED, TO PROVIDE THAT
ALL MEMBERS OF CITY BOARDS SHALL SERVE FOR A
TERM OF ONE (1) YEAR OR UNTIL THE NOMINATING
COMMISSIONER LEAVES OFFICE, WHICHEVER OCCURS
FIRST; MORE PARTICULARLY BY AMENDING SECTIONS
2-238, 2-276, 2-422, 2-429, 14-26, 14-27, 29-
63, 35-193, 38-73, 45.5-2, 52.6-3, 54-95, 54-
172, 62-47, 62-71, 62-78 AND 62-84 OF SAID
CODE; CONTAINING A REPEALER PROVISION AND A
SEVERABILITY CLAUSE AND PROVIDING FOR AN
EFFECTIVE DATE.
WHEREAS, Chapter 2, Article XIII of the Code of the City of
Miami, Florida, as amended, provides the standards for the
creation and review of boards generally; and
WHEREAS, all the requirements contained in said Article
apply to all boards of the City of Miami, unless there is any
statutory or City Charter provision to the contrary; and
WHEREAS, Section 2-429 of the Code of the City of Miami,
Florida, as amended, mandates that the terms of office of the
members of each board shall run concurrently with the term of
office of the Commissioner that nominates each member; and
WHEREAS, the City Commission wishes to limit the terms of
office of board members to one (1) year or until the nominating
Commissioner leaves office, whichever occurs first.

NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the
Preamble to this Ordinance are hereby adopted by reference
thereto and incorporated herein as if fully set forth in this
Section.
Section 2. Section 2-238 of the Code of the City of
Miami, Florida, as amended, concerning the Miami Audit Advisory
Committee, is hereby amended in the following particulars:l/
"Sec. 2-238. Composition; terms.
The composition of the Miami Audit Advisory
Committee shall be as follows:

(2) All members appointed by the city commission shall
serve for a period of twe—(2) one (1) years or until
the nominating commissioner leaves office, whichever
occurs first.

All committee members shall continue to serve
until their successors are duly appointed."
Section 3. Section 2-276 of the Code of the City of
Miami, Florida, as amended, concerning the City Affirmative
Action Advisory Board, is hereby amended in the following
particulars:l/
"Sec. 2-276. Established; members, terms of office.

remaining provisions are now in effect and remain unchanged.

There is hereby established a board to be known as
the city affirmative action advisory board, hereinafter
called the "board". The board shall consist of
fourteen (14) members, ten (10) members to be appointed
by the city commission, and four (4) members, one (1)
each, to be selected by each certified bargaining
representative of city employees, as follows:
Fraternal Order of Police, Miami Lodge No. 20;
International Association of Firefighters, Local
No. 587;
Sanitation Employees Assn., Inc.;
Miami General Employees, American Federation of
State and County Municipal Employees, Local
No. 1907.
Persons so selected shall become members of the
board when confirmed by the city commission.
The terms of the board members shall be as

The city
commission may remove any member of the board for
cause, upon stating in writing the reasons for removal,
allowing him or her to be heard by the city commission
in his or her own defense. Any vacancy on the board
shall be filled by the commission for the unexpired
term; provided, however, that members of the board en
September 1, 1980—, shall continue to serve until their
successors have been selected and qualified."

Section 4. Section 2-422 of the Code of the City of
Miami, Florida, as amended, concerning the International Trade
Board, is hereby amended in the following particulars:l/
"Sec. 2-422, Membership.

(b) The board shall be constituted as follows:
(1) Sixteen (16) members for terms of office as
provided herein. Such members may be re -appointed for
three -(3+ seven ( 7 ) additional terms. One (1) member
of the city commission shall be the chairperson of the
board and the sixteenth member thereof. The
chairperson shall have the power to appoint all members
serving on the various committees which the board shall
establish from time to time. The mayor and each city
commissioner shall each have the right to nominate
three (3) persons to serve as board members. Members
shall be eligible for reappointment as provided herein.
The terms of office for these members shall be for
periods of twe (2) one (1) years or until the
nominating commissioner leaves office, whichever occurs
first. No member shall be eligible for reappointment
if such reappointment results in the member serving for
more than eight (8) consecutive years.
Section 5. Section 2-429 of the Code of the City of
Miami, Florida, as amended, concerning the Standards for Creation
and Review of Boards Generally, is hereby amended in the
following particulars:l/
"Sec. 2-429. Terms of office.
(a) The terms of office of the members of each
board shall be of one (1) year or until the nominating
commissioner leaves office, whichever occurs first run

or employee of the city other than one (1) member of the
city commission shall be eligible for appointment to the

office, each appointed member shall qualify by taking and
subscribing to the oath of office required of officials of
the city."
Section 7. Section 29-63 of the Code of the City of
Miami, Florida, as amended, concerning the Miami Waterfront
Advisory Board, is hereby amended in the following particulars:l/
"Sec. 29-63. Composition; terms; appointment; removal.

(b) All members shall serve without compensation for terms
of office a-:r4:n64:eatea hereunder of one (1) year or until
the nominating commissioner leaves office, whichever occurs
first, and shall be subject to removal by the commission for
any cause. A member's absence from four (4) of the
cumulative meetings within any one (1) calendar year period
or from three (3) consecutive meetings of the board within a
calendar year shall result in the member's removal from the
board upon the chairperson's filing of a certificate of such
ttnemettseel absences with the city clerk. Any vacancy
occurring during such term shall be filled for the remainder
of the term in the same manner as the original appointment.

Miami, Florida, as amended, concerning the Coconut Grove Parking
Advisory Committee, is hereby amended in the following

Section 9. Section 38-73 of the Code of the City of
Miami, Florida, as amended, concerning the Bayfront Park

Section 10. Section 45.5-2 of the Code of the City of
Miami, Florida, as amended, concerning the Nuisance Abatement
Board, is hereby amended in the following particulars:l/
"Sec. 45.5-2. Nuisance abatement board.
(a) Created; membership; terms; vacancies; compensation.

(1) The nuisance abatement board of the city is hereby
created to serve as a quasijudicial forum in which
controversies over the existence of public nuisances may be
resolved in the public interest with due process of law.
This board shall consist of five (5) individuals who reside,
own real property or maintain a business office within the
City of Miami and who are appointed by the City commission.

The committee shall consist of five (5) members. Each
member of the committee shall reside, own real property or
have its principal place of business in the Coconut Grove
area of the city and shall be an individual of outstanding
reputation for integrity, responsibility and commitment to
serving the community. One (1) city commissioner may be an
ex-officio nonvoting member of the committee. Each member
of the city commission shall appoint one (1) member to the
committee. The terms of office of the i-'4�= membership of

the appointing commissioner leaves office, whichever occurs
first.

consist of nine (9) members and one (1) alternate member to
be appointed by the city commission in the manner and under
the standards hereinafter set out. Each member and

Section 15. Section 62-71 of the Code of the City of
Miami, Florida, as amended, concerning the City of Miami Historic
and Environmental Preservation Board, is hereby amended in the
following particulars:l/
"Section 62.71. Membership
The historic and environmental preservation board
(hereinafter referred to as the "board") shall consist of
nine (9) members and one (1) alternate member, to be
appointed by the city commission.

(3) Terms of office. Members and alternate members of
the board shall be appointed for three ye one-year terms
or until the nominating commissioner leaves office,
whichever occurs first. Members and alternate members may
be reappointed to consecutive terms, subject to the
procedures set forth in part (2) above.
Section 16. Section 62-78 of the Code of the City of
Miami, Florida, as amended, concerning the Latin Quarter Review
Board, is hereby amended in the following particulars:i/
"Section 62-78. Membership.

board shall be appointed for two year one-year terms, or
until the nominating commissioner leaves office, whichever

"Section 62-84. Membership.
The urban development review board shall consist of
nine (9) members and one (1) alternate, to be appointed by
the city commission.

(2) Terms of office. Members of the urban development
review board shall be appointed to serve a term of )
one (1) years or until the nominating commissioner leaves
office, whichever occurs first. Notwithstanding the above,
individual members may serve until their successor is

appointed and qualified. After the initial term of
appointment, no member of the board shall be reappointed to
more than twe--(2) five (5) consecutive terms, thereafter.

Section 18. All ordinances or parts of ordinances insofar
as they are inconsistent or in conflict with the provisions of
this Ordinance are hereby repealed.
Section 19. If any section, part of section, paragraph,
clause, phrase or word of this Ordinance is declared invalid, the
remaining provisions of this Ordinance shall not be affected.
Section 20. This Ordinance is hereby declared to be an
emergency measure on the grounds of urgent public need for the
preservation of peace, health, safety, and property of the City
of Miami, and upon the further grounds of the necessity to make
the required and necessary payments to its employees and
officers, payment of its debts, necessary and required purchases
of goods and supplies and to generally carry on the functions and
duties of municipal affairs.
Section 21. The requirement of reading this Ordinance on
two separate days is hereby dispensed with by an affirmative vote
of not less than four -fifths of the members of the Commission.
Section 22. This Ordinance shall become effective
immediately upon its adoption.
