HomeMy WebLinkAboutO-11370J-96-501 6/3/96 ORDINANCE NO. 11370 AN EMERGENCY ORDINANCE AMENDING ORDINANCE NO. 11127, ADOPTED MARCH 24, 1994, WHICH ESTABLISHED INITIAL RESOURCES AND INITIAL APPROPRIATIONS FOR A SPECIAL REVENUE FUND ENTITLED 'I "HAITIAN NARCOTICS ENFORCEMENT;" BY INCREASING THE APPROPRIATIONS TO SAID FUND, IN THE AMOUNT OF $50,000; AUTHORIZING THE CITY MANAGER TO ACCEPT A GRANT, IN THE AMOUNT OF $50,000.00, FROM THE BUREAU OF JUSTICE ASSISTANCE, AND TO EXECUTE THE NECESSARY DOCUMENTS FOR ACCEPTANCE AND IMPLEMENTATION OF SAID GRANT; CONTAINING A REPEALER PROVISION AND SEVERABILITY CLAUSE. WHEREAS, the City of Miami Police Department continues to investigate narcotics trafficking; and WHEREAS, there is a need to target specific geographical areas; and WHEREAS, the Bureau of Justice Assistance has approved an award in the amount of $50,000.00, to be used for the payment of overtime, with no matching funds required from the City of Miami, to accomplish these investigations; and WHEREAS, any purchases would have to comply with applicable City Charter and Code purchasing requirements; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: 11370 Section 1. The recitals and findings contained in the preamble to this Ordinance are hereby adopted by reference thereto and incorporated herein as if fully set forth in this Section. Section 2. Section 2 of Ordinance No. 11127, adopted March 24`", 1994, is hereby amended in the following particulars:' "Section 2. The following Special Revenue Fund is hereby established and resources are hereby appropriated as described herein: FUND TITLE: HAITIAN NARCOTICS ENFORCEMENT RESOURCES: Bureau of Justice Assistance $275,000 $325,000 APPROPRIATIONS: Personnel Overtime $1-73,360 $223,360 Travel $101,640" Section 3. The City Manager is hereby authorized to accept a grant from the Bureau of Justice Assistance, in the amount of $50,000, and to enter into the necessary documents, in a form acceptable to the City Attorney, for acceptance and implementation of said grant. Section 4. All Ordinances or parts of Ordinances insofar as they are inconsistent or in conflict with the provisions of this Ordinance are hereby repealed. Section 5. If any section, part of section, paragraph, clause, phrase, or word of this Ordinance is declared invalid, the remaining provisions of this Ordinance shall not be affected. Section 6. This Ordinance is hereby declared to be an emergency measure on the grounds of urgent public need for the preservation of peace, health, safety, and property of the City of Miami, and upon the further grounds of the necessity of the City of Miami to make the required ' Words and/or figures stricken through shall be deleted. Section 7. The requirements of reading this Ordinance on two separate days is hereby dispensed with by an affirmative vote of not less than four -fifths of the members of the Commission. Section 8. BACKGROUND: The Miami Police Department is continuing its efforts at combating narcotics trafficking and has received assistance in this endeavor from the Federal Government, through High Intensity Drug Trafficking Area grants. These grants provide an additional incentive for the City -of Miami Police Department to target organizations involved in narcotics based on geographical location. This specific grant targets narcotics trafficking in the Haitian community. To accomplish this task, the Bureau of Justice Assistance has authorized an additional $50,000.00, to be used towards the payment of overtime. No matching funds are required by the City of Miami.
