ORDINANCE NO. 1136 8
AN EMERGENCY ORDINANCE ESTABLISHING A NEW
SPECIAL REVENUE FUND ENTITLED: "BAYWOOD PARK
SHORELINE ENHANCEMENT PROJECT" AND
APPROPRIATING FUNDS, IN THE AMOUNT OF
$75,590.00, RECEIVED AS A RESULT OF A GRANT
AWARD FROM THE FLORIDA INLAND NAVIGATION
DISTRICT, UNDER THE 1995-1996 WATERWAYS
ASSISTANCE PROGRAM PROJECTS, FOR A SHORELINE
ENHANCEMENT PROJECT TO BAYWOOD PARK, LOCATED
AT 890 NORTHEAST 69TH STREET, MIAMI, FLORIDA;
FURTHER AUTHORIZING THE CITY MANAGER TO
ACCEPT SAID GRANT AWARD AND TO EXECUTE THE
NECESSARY DOCUMENTS, IN A FORM ACCEPTABLE TO
THE CITY ATTORNEY, TO IMPLEMENT SAID
ACCEPTANCE; CONTAINING A REPEALER PROVISION
AND A SEVERABILITY CLAUSE.
WHEREAS, the Department of Parks and Recreation submitted an
application to the Florida Inland Navigation District seeking
grant funds under the 1995-1996 Waterways Assistance Program
Projects for a shoreline enhancement project at Baywood Park,
located at 890 Northeast 69th Street, Miami, Florida; and
WHEREAS, said program provides funds to local governments
for problems associated with construction and continued
maintenance, for the benefit of inland navigation channels and
waterways for the use and benefit of the general public; and
WHEREAS, said grant will be applied to Capital Improvements
Project No. 33139, "Baywood Park Shoreline Enhancement Project",
by providing funds for the shoreline enhancement, stabilization
and landscaping; and

WHEREAS, funds in the amount of $100,000, to be provided to
the City by Metropolitan Dade County's Department of
Environmental Resources Management (DERM), constitute the
required local match for said grant;
NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the
Preamble to this Ordinance are hereby adopted by reference
thereto and incorporated herein as if fully set forth in this
Section.
Section 2. The following new Special Revenue Fund is
hereby established and resources are hereby appropriated as
described herein:
FUND TITLE: BAYWOOD PARK SHORELINE ENHANCEMENT PROJECT
RESOURCES: Florida Inland Navigation District
1995-1996 Waterways Assistance
Program $75,590
APPROPRIATION: BAYWOOD PARK SHORELINE
ENHANCEMENT PROJECT $75,590
Section 3. The City Manager is hereby authorized!' to
accept the grant from the Florida Inland Navigation District,
under the 1995-1996 Waterways Assistance Program Projects, and to
execute the necessary documents, in a form acceptable to the City
Attorney, to implement acceptance of said grant.
i� The herein authorization is further subject to compliance
with all requirements that may be imposed by the City
Attorney, including but not limited to those prescribed by
applicable City Charter and Code provisions.

Section 4. All ordinances or parts of ordinances insofar
as they are inconsistent or in conflict with the provisions of
this Ordinance are hereby repealed.
Section 5. If any section, part of section, paragraph,
clause, phrase or word of this Ordinance is declared invalid, the
remaining provisions of this Ordinance shall not be affected.
Section 6. This Ordinance is hereby declared to be an
emergency measure on the grounds of urgent public need for the
preservation of peace, health, safety, and property of the City
of Miami, and upon the further grounds of the necessity of the
City of Miami to make the required and necessary payments to its
employees and officers, payment of its debts, necessary and
required purchases of goods and supplies, and to generally carry
on the functions and duties of municipal affairs.
Section 7. The requirements of reading this Ordinance on
two separate days is hereby dispensed with by an affirmative vote
of not less than four -fifths of the members of the Commission.
Section 8. This Ordinance shall become effective
immediately upon its adoption.

RECOMMENDATION
It is respectfully recommended that the City Commission adopt the attached Ordinance.
authorizing the City Manager to accept grant funds in the amount of $75,590.00 from the
Florida Inland Navigation District, under its Waterways Assistance Program for the
Baywood Park Shoreline Enhancement Project and establishing a new Special Revenue
Fund Entitled: `Baywood Shoreline Enhancement Project". The legislation would further
authorize the City Manager to execute the attached agreement with said agency.
BACKGROUND
The Parks and Recreation Department was awarded this grant from the Florida Inland
Navigation District. The Baywood Park Shoreline Enhancement Project, on a
comprehensive basis, will involve the modification of the existing collapsed seawall by
constructing a mangrove planter, the installation of additional lime rock boulders to
stabilize the remaining seawall and the construction of an artificial reef off the seawall, as
funds permit. This project has received the endorsement of area residents during
community meetings held January 11 and March 3, 1994.
The total estimated cost of the project is $199,992, the remainder of the funding is
currently available from the Biscayne Bay Environmental Enhancement Trust Fund
through Dade County`s Department of Environmental Resources Management pursuant
to Resolution No. 93-614.
