HomeMy WebLinkAboutO-11367J-96-323 4/25/96 ORDINANCE NO. 11367 AN EMERGENCY ORDINANCE ESTABLISHING A NEW SPECIAL REVENUE FUND ENTITLED: "SUMMER FOOD SERVICE PROGRAM FOR CHILDREN - 1996" AND APPROPRIATING FUNDS FOR THE OPERATION OF SAME IN THE AMOUNT OF $299,760.00, CONSISTING OF A GRANT FROM THE UNITED STATES DEPARTMENT OF AGRICULTURE THROUGH THE FLORIDA DEPARTMENT OF EDUCATION; AUTHORIZING THE CITY MANAGER TO ACCEPT SAID GRANT AWARD AND TO EXECUTE THE NECESSARY DOCUMENTS, IN A FORM ACCEPTABLE TO THE CITY ATTORNEY, FOR SAID PURPOSE; CONTAINING A REPEALER PROVISION AND A SEVERABILITY CLAUSE. WHEREAS, the Florida Department of Education, Food and Nutrition Management Division, with funding from the United States Department of Agriculture, has agreed to allow the City of Miami to participate in its Summer Food Program; and WHEREAS, said State agency will reimburse the City at a rate of $2.1675 per summer lunch, and $.5700 per supplement, which the City provides to those children attending the parks of the City of Miami; and WHEREAS, each $2.1675 reimbursement will provide $1.99 for operational and actual lunch costs, and $.1700 for administrative costs of the program, and each $.5700 reimbursement will provide $0.5550 for operational and actual supplement costs, and $0.04525 for administrative costs of the program; and 11367 WHEREAS, an estimated 103,729 lunches and 122,175 supplements will be served during the project period commencing June 17 and ending August 18, 1996; and WHEREAS, an estimated $299,760.00 will be received from the State of Florida for carrying out said program; NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Ordinance are hereby adopted by reference thereto and incorporated herein as if fully set forth in this Section. Section 2. The following new Special Revenue Fund is hereby established and resources are hereby appropriated as described herein: FUND TITLE: SUMMER FOOD SERVICE FOR CHILDREN-1996 RESOURCES: Grant Reimbursements from the United States Department of Agriculture through the Florida Department of Education $299,760 APPROPRIATION: Summer Food Service Program for Children-1996 $299,760 Section 3. Said appropriation is contingent upon the approval of the City's application for said grant, in the amount of $299,760.00 by the Florida Department of Education and the City Manager's acceptance thereof. 2 - 11367 Section 4. The City Manager is hereby authorized-/ to accept the aforementioned grant and execute the necessary documents, in a form acceptable to the City Attorney, with the Florida Department of Education to implement acceptance of said grant. Section 5. All ordinances or parts of ordinances insofar as they are inconsistent or in conflict with the provisions of this Ordinance are hereby repealed. Section 6. If any section, part of section, paragraph, clause, phrase or word of this Ordinance is declared invalid, the remaining provisions of this Ordinance shall not be affected. Section 7. This Ordinance is hereby declared to be an emergency measure on the grounds of urgent public need for the preservation of peace, health, safety, and property of the City of Miami, and upon the further grounds of the necessity of the City of Miami to make the required and necessary payments to its employees and officers, payment of its debts, necessary and required purchases of goods and supplies, and to generally carry on the functions and duties of municipal affairs. i� The herein authorization is further subject to compliance with all requirements that may be imposed by the City Attorney, including but not limited to those prescribed by applicable City Charter and Code provisions. - 3 - 11.36'7 Section 8. The requirements of reading this Ordinance on two separate days is hereby dispensed with by an affirmative vote of not less than four -fifths of the members of the Commission. Section 9. CLARK, MAYOR - 4 - 357 CITY OF MIAMI, FLORIDA INTER -OFFICE MEMORANDUM TO : Honorable Mayor and Members of the City Commission FROM Ces City ger RECOMMENDATION: 35 DATE : March 13, 1996 FILE : SUBJECT : Ordinance for the Summer Food Service Program for Children -1996 REFERENCES: ENCLOSURES: It is respectfully recommended that the City Commission adopt the attached ordinance to create a new Special Revenue Fund and to appropriate grant funds in the amount of $299,760.00, to be received from the United States Department of Agriculture to conduct a summer food service program for youth aged 18 and under from June 17, 1996 through August 16, 1996. BACKGROUND: Each year since 1968, the Department of Parks and Recreation has sponsored a Summer Food Service Program for children. Under this program, the City provides nutritional meals in conjunction with its comprehensive recreational program featuring arts and crafts, sporting activities, field trips and special events. This year, we plan to serve up to 2,305 lunches and 2,715 snacks per day using no less than twenty-eight (28) sites throughout the City. The Florida Department of Education will reimburse the City at a fixed rate of $2.1675 per lunch, and $.5700 per snack. This rate will provide sufficient funds to cover the meal cost and to hire the necessary temporary, part-time recreation aides to operate the program. Based upon the estimated number of participants and 45 service days in the program, the total grant amount is expected to be $299,760.00. This Ordinance is being presented as an emergency item because the department was just recently informed of the availability of grant funds, the need to meet the State of Florida established time constraints and deadlines for contract execution and to ensure that funds are in place prior to the start of the Summer Program on June 17, 1996.
