HomeMy WebLinkAboutO-11366r J-96-319 4/17/96 ORDINANCE NO. 11366 AN EMERGENCY ORDINANCE AMENDING ORDINANCE NO. 11261, ADOPTED MAY 11, 1995, WHICH ESTABLISHED INITIAL RESOURCES AND INITIAL APPROPRIATIONS FOR A SPECIAL REVENUE FUND ENTITLED "GEOGRAPHICAL TARGETING PROGRAM"; BY INCREASING THE APPROPRIATIONS TO SAID FUND, IN THE AMOUNT OF $24,000.00; AUTHORIZING THE CITY MANAGER TO ACCEPT A GRANT, IN THE AMOUNT OF $24,000.00, FROM THE MONROE COUNTY SHERIFF'S OFFICE, AND TO EXECUTE ANY NECESSARY DOCUMENTS FOR ACCEPTANCE AND IMPLEMENTATION OF SAID GRANT; CONTAINING A REPEALER PROVISION AND SEVERABILITY CLAUSE. WHEREAS, the City of Miami Police Department continues to investigate narcotics trafficking; and WHEREAS, there is a need to target specific geographical areas; and WHEREAS, the Monroe County Sheriff's Office has approved an award in the amount of $24,000.00, to be used for the payment of overtime, with no matching funds required from the City of Miami to accomplish said investigations; and WHEREAS, any purchases must comply with applicable City Charter and Code procurement procedures; NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: _4 1136 0 Section 1. The recitals and findings contained in the Preamble to this Ordinance are hereby adopted by reference thereto and incorporated herein as if fully set forth in this Section. Section 2. Section 2 of Ordinance No. 11261, adopted May 11, 1995, is hereby amended in the following particulars:V "Section 2. The following Special Revenue Fund is hereby established and resources are hereby appropriated as described herein: FUND TITLE: GEOGRAPHICAL TARGETING PROGRAM RESOURCES Monroe County Sheriff's Office $49,999 $64,000 APPROPRIATIONS: Personnel Overtime $35,999 $59,000 Equipment $ 3,000 Miscellaneous $ 2,000" Section 3. The City Manager is hereby authorized-/ to accept a grant from the Monroe County Sheriff's Office, in the amount of $24,000, and to execute any necessary documents, in a form acceptable to the City Attorney, for acceptance and implementation of said grant. Section 4. All Ordinances or parts of Ordinances insofar as they are inconsistent or in conflict with the provisions of this Ordinance are hereby repealed. i� Words and/or figures stricken through shall be deleted. Underscored words and/or figures shall be added. The remaining provisions are now in effect and remain unchanged. The herein authorization is further subject to compliance with all requirements that may be imposed by the City Attorney, including but not limited to those prescribed by applicable City Charter and Code provisions. - 2 - 11366 Section 5. If any section, part of section, paragraph, clause, phrase, or word of this Ordinance is declared invalid, the remaining provisions of this Ordinance shall not be affected. Section 6. This Ordinance is hereby declared to be an emergency measure on the grounds of urgent public need for the preservation of peace, health, safety, and property of the City of Miami, and upon the further grounds of the necessity of the City of Miami to make the required and necessary payments to its employees and officers, payment of its debts, necessary and required purchases of goods and supplies, and to generally carry on the functions and duties of municipal affairs. Section 7. The requirements of reading this Ordinance on two separate days is hereby dispensed with by an affirmative vote of not less than four -fifths of the members of the Commission. Section 8. BACKGROUND: The Miami Police Department is continuing its efforts at combating narcotics trafficking. The Monroe County Sheriff's Department, has awarded the City of Miami Police Department an additional grant of $24,000.00 as a continuing incentive to target organizations involved in narcotics trafficking based on geographic location.
