HomeMy WebLinkAboutO-11365J-96-318 4/17/96 ORDINANCE NO. 1 1 3 6 5 AN EMERGENCY ORDINANCE AMENDING ORDINANCE NO. 11262, ADOPTED MAY 11, 1995, WHICH ESTABLISHED INITIAL RESOURCES AND INITIAL APPROPRIATIONS FOR A SPECIAL REVENUE FUND ENTITLED*- "HIDTA ASSET FORFEITURE RESEARCH;" BY INCREASING THE APPROPRIATIONS TO SAID FUND, IN THE AMOUNT OF $21,000.00; AUTHORIZING THE CITY MANAGER TO ACCEPT A GRANT, IN THE AMOUNT OF $21,000.00, FROM THE MONROE COUNTY SHERIFF'S OFFICE, AND TO EXECUTE ANY NECESSARY DOCUMENTS FOR ACCEPTANCE AND IMPLEMENTATION OF SAID GRANT; CONTAINING A REPEALER PROVISION AND SEVERABILITY CLAUSE. WHEREAS, the City of Miami Police Department continues to investigate narcotics trafficking and money laundering; and WHEREAS, there is a need to target specific geographical areas; and WHEREAS, the Monroe County Sheriff's Office has approved an award in the amount of $21,000.00, to be used for the payment of overtime and travel/training expenses, with no matching funds required from the City of Miami to accomplish said investigations; and WHEREAS, any purchases must comply with applicable City Charter and Code procurement procedures; NOW, THEREFORE, BE IT ORDAINFD BY TIDE COMMISSION OF THE CITY OF MIAMI, FLORIDA: il365 Section 1. The recitals and findings contained in the Preamble to this Ordinance are hereby adopted by reference thereto and incorporated herein as if fully set forth in this Section. Section 2. Section 2 of Ordinance No. 11262, adopted May 11, 1995, is hereby amended in the following particulars:l/ "Section 2. The following Special Revenue Fund is hereby established and resources are hereby appropriated as described herein: FUND TITLE: HIDTA ASSET FORFEITURE RESEARCH RESOURCES Monroe County Sheriff's Office $25,999 $46,000 APPROPRIATIONS: Personnel Overtime $14,99 $32,000 Travel/Training $--8,999 $11,000 Equipment $ 2,000 Miscellaneous $ 1,000" Section 3. The City Manager is hereby authorized/ to accept a grant from the Monroe County Sheriff's Office, in the amount of $21,000, and to execute any necessary documents, in a form acceptable to the City Attorney, for acceptance and implementation of said grant. i/ Words and/or figures stricken through shall be deleted. Underscored words and/or figures shall be added. The remaining provisions are now in effect and remain unchanged. The herein authorization is further subject to compliance with all requirements that may be imposed by the City Attorney, including but not limited to those prescribed by applicable City Charter and Code provisions. - 2 - 11365 Section 4. All Ordinances or parts of Ordinances insofar as they are inconsistent or in conflict with the provisions of this Ordinance are hereby repealed. Section 5. If any section, part of section, paragraph, clause, phrase, or word of this Ordinance is declared invalid, the remaining provisions of this Ordinance shall not be affected. Section 6. This Ordinance is hereby declared to be an emergency measure on the grounds of urgent public need for the preservation of peace, health, safety, and property of the City of Miami, and upon the further grounds of the necessity of the City of Miami to make the required and necessary payments to its employees and officers, payment of its debts, necessary and required purchases of goods and supplies, and to generally carry on the functions and duties of municipal affairs. Section 7. The requirements of reading this Ordinance on two separate days is hereby dispensed with by an affirmative vote of not less than four -fifths of the members of the Commission. Section 8. BACKGROUND: The Miami Police Department is continuing its efforts at combating narcotics trafficking and money laundering, through High Intensity Drug Trafficking Area Grants (HIDTA). These grants provide an additional incentive for the City of Miami Police Department to target organizations involved in narcotics based on geographical location. This specific grant is being administered by the Monroe County Sheriff's Office. The Miami Police Department's role will be to provide public records research, perform public records searches, perform analytical investigations, and assist in the analytical and forfeiture process through public records research for all HIDTA members in need of such information. To accomplish this, the Monroe County Sheriff's Office has authorized an additional $21,000.00 towards the payment of overtime and travel/training expenses.
