ORDINANCE NO. 11363
AN ORDINANCE AMENDING SECTION V. OF ORDINANCE
NO. 11337, AS AMENDED, ADOPTED JANUARY 25,
1996, THE CAPITAL IMPROVEMENTS APPROPRIATIONS
ORDINANCE, THEREBY INCREASING APPROPRIATIONS
FOR THE CAPITAL IMPROVEMENT PROJECT ENTITLED:
"MIAMARINA", PROJECT NO. 413400, IN AN AMOUNT
NOT TO EXCEED $700,000; CONTAINING A REPEALER
PROVISION AND A SEVERABILITY CLAUSE.
WHEREAS, the City Commission, pursuant to Ordinance No.
11337, adopted January 25, 1996, established appropriations for
Capital Improvements, continue previously approved Capital
Improvement Projects, and establish new Capital Improvement
Projects to begin during Fiscal Year 1995-96; and
WHEREAS, the City of Miami is intending to award a contract
for the construction of the project entitled "Miamarina"; and
WHEREAS, additional funds are needed to cover the cost
required for the project; and
WHEREAS, it is necessary to provide additional
appropriations in an amount not to exceed $700,000 for said
project by reappropriating available funds;
NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:

Section 1. The recitals and findings contained in the
Preamble to this Ordinance are hereby adopted by reference
thereto and incorporated herein as if fully set forth in this
Section.
Section 2. Section V. of Ordinance No. 11337, as
amended, adopted January 25, 1996, is hereby amended in the
following particulars:l/
" Section 1. The herein appropriations are here
hereby made for implementation of all municipal Capital
Improvements of the City of Miami, including new
Capital Improvement Projects scheduled to begin during
fiscal year 1995-1996. The herein appropriations which
are hereby designated by reference to descriptive
project title and number also include appropriations
for previously approved scheduled projects as well as
reappropriations of prior fund appropriations. The
source of revenues to support the herein appropriations
is hereby identified by fund and project with the
project appropriations with revenues therefor being set
forth for seven program (I-VII)areas based upon use
or functional category within said areas, as follows "

Section 3. All ordinances or parts of ordinances insofar
as they are inconsistent or in conflict with the provisions of
this Ordinance are hereby repealed.
Section 4. If any section, part of section, paragraph,
clause, phrase or word of this Ordinance is declared invalid, the
remaining provisions of this Ordinance shall not be affected.
Section 5. This Ordinance shall become effective thirty
(30) days after final reading and adoption thereof.

It is respectfully recommended that the City Commission adopt the attached
Ordinance amending Ordinance No. 11337, by appropriating additional funds
in the amount of $700.0 for the new MIAMARINA REDEVELOPMENT -PHASE IV (new
piers) , Project H-1014D, Capital Improvement Project No. 413400.
BACKGROUND
The Miamarina Redevelopment Piers is a project to replace three (3) original
Miamarina piers that were heavily damaged, with new improved pier facilities.
The new facilities consist of three (3) new heavy concrete fixed piers with a
wave baffling system to protect the marina and upland structures from future
storms. The wave baffling is designed to keep the marina waters calm and to
reduce incoming debris. The construction includes improved piers and upland
utilities and an optional floating dock. The project is funded largely by F.E.M.A.
as an "improvement type" re -building and as a mitigation project. Although
F.E.M.A. is funding a significant portion of the project, the heavier
construction and improved utilities has also increased overall project costs for
which the City is funding the balance. The project was initiated as a hurricane
emergency, and due to the time needed to upgrade the construction plans
and bid out the project, time is now of the essence to utilized the F.E.M.A.
funding and meet our obligations under the Bayside Agreement.
The Public Works Department has identified funds available in the Fiscal Year
1995-96 budget in the amount of S 700,000. Which can be allocated to the
Miamarina Redevelopment Project H-1014D.
