HomeMy WebLinkAboutO-11359J-96-162 3/11/96 ORDINANCE NO. 11359 AN ORDINANCE AMENDING THE ZONING ORDINANCE BY AMENDING SECTION 401, "SCHEDULE OF DISTRICT REGULATIONS," TO ALLOW "VEHICLE RENTAL FACILITIES" AS A "CONDITIONAL PRINCIPAL USE" IN THE "C-1" RESTRICTED COMMERCIAL ZONING DISTRICTS; BY ADDING A NEW SECTION 947, "VEHICLE RENTAL FACILITIES," PROVIDING FOR REGULATION AND IMPLEMENTATION OF SAID USE; PROVIDING DEFINITIONS; CONTAINING A REPEALER PROVISION AND A SEVERABILITY CLAUSE; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the Miami Planning Advisory Board, at its meeting of February 21, 1996, Item No. 6, following an advertised hearing, adopted Resolution No. PAB 10-96, by a vote of six to two (6-2), RECOMMENDING APPROVAL of amending Zoning Ordinance No. 11000 as hereinafter set forth; and WHEREAS, the City Commission after careful consideration of this matter deems it advisable and in the best interest of the general welfare of the City of Miami and its inhabitants to amend Ordinance No. 11000 as hereinafter set forth; NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. Ordinance No. 11000, as amended, the Zoning Ordinance of the City of Miami, Florida, is hereby amended by 11359 amending the text of said Ordinance as follows:l/ "ARTICLE 4. ZONING DISTRICTS Sec. 401. Schedule of District Regulations. C-1 Restricted Commercial. Conditional Principal Uses: Same as for O district and in addition: 25. Vehicle rental facilities, by Special Exception subject to applicable regulations set forth in Section 947 of this Ordinance. ARTICLE 9. GENERAL AND SUPPLEMENTARY REGULATIONS Sec. 947. Vehicle rental facilities. The following standards, limitations and requirements shall apply to vehicle rental facilities as conditional principal uses: 947.1. Definition of vehicle rental facilities. Vehicle rental facilities shall be defined as establishments where motor vehicles are kept and maintained for lease, where such vehicles are dropped off or picked up and where customers complete all transactions necessary for the short term lease of such vehicles. i� Words and/or figures stricken through shall be deleted. Potentiallv adverse characteristics of use The following characteristics associated with vehicle rental facilities are of concern to the public interest. For this reason the applicant shall address each category graphically in the plans submitted for review and/or in written fashion in a statement attached to the plans. This documentation shall in turn be carefully considered when reviewing any and all applications for the implementation of this use: (a) negative visual impact• b) hours of operation- c) customer safety; d) traffic generation• e) lighting spillover; f) on -site services and g) vehicle circulation patterns. 947.3 Limitations on vehicle rental facilities. The conditions under which this use is permitted include, but are not limited to• a) All transactions shall take place indoors b) The building designated for customer service shall be located where it can easily and clearlv be seen from the site access point(s). c) Ingress and egress for the site shall be located on a primary arterial road as designated in Dade County's Comprehensive Plan. d) Areas where vehicles are stored shall be well -lit• however, such lighting shall be arranged and buffered so that no spillover occurs onto abutting properties e) Servicing of vehicles on -site shall be limited to minor repairs and regular maintenance work and shall be conducted in enclosed or completely screened areas For the purposes of this section minor repairs shall be deemed to include the following activities and no others- 1. servicing related to sparkplugs batteries and distributors and distributors parts; 2. tire servicing and repair, but not recapping or regrooving; 3. replacement of water hoses fanbelts brake fluid, lightbulbs, fuses floor mats wiper blades, grease retainers wheel bearings 11359 mufflers, shock absorbers mirrors and the like; 4. provision of water, supplements for radiator fluids, and the like; 5. washing and polishing limited to facilities for washing one (1) car at a time• 6. repair of fuel pumps and lines• 7. minor servicing and repair of carburetors• 8. minor servicing of automotive air conditioners, not involving removal of units• 9. emergency wiring repairs; l0.adiusting and emergency repair of brakes• ii.minor motor adjustments not involving removal of the head or crankcase, and 12.greasing and lubrication. f. Parking and vehicle storage areas shall conform to the City of Miami off-street parking standards and guidelines. Special Exception review shall place special emphasis on the landscaping and other screening devices used to buffer and minimize the negative visual impact of these areas. g. Parking ratios shall be as follows for the uses included under this category: 1. van and truck lease or rental: facilities which rent or lease trucks and vans for cargo transport purposes shall provide one (1) space per employee and one (1) space per eight (8) vehicles stored for lease The quantity of the vehicles stored for lease shall be specified in the certificate of use to be obtained by the establishment. 2. car or utility vehicle lease or rental• facilities which rent or lease cars and utility vehicles primarily for as passenger vehicles shall provide ten (10) parking spaces for the first one thousand (1000) square feet and one (1) parking space for each additional five hundred 11369 (500) scruare feet. Employee parking is considered to be included in the above calculations. 3. satellite facilities: satellite facilities which rent or lease vehicles without storage on site and which function as counters or booths ancillary to another primary use or within a commercial retail or other service major facility shall provide Parking spaces at the rate of one (1) space per three hundred (300) square feet. i) In addition to these restrictions, upon individual evaluation of each proposed vehicle rental facility, appropriate measures may be required to minimize any potential adverse effects brought about by the implementation of the use with regards to the above or other pertinent concerns. ARTICLE 25. DEFINITIONS Sec. 2502. Specific definitions. Variance.... Vehicle rental facilities. An establishment where motor vehicles are kept and maintained for lease where such vehicles are dropped off or picked up and where customers complete all transactions necessary for the short term lease of such vehicles. Section 2. All ordinances or parts of ordinances insofar as they are inconsistent or in conflict with the provisions of this Ordinance are hereby repealed. 5 11359 Section 3. If any section, part of section, paragraph, clause, phrase or word of this Ordinance is declared invalid, the remaining provisions of this Ordinance shall not be affected. Section 4. The recitals and findings contained in the Preamble to this Ordinance are hereby adopted by reference thereto and incorporated herein as if fully set forth in this Section. Section 5. LEGAL DESCRIPTION N/A. PETITION Consideration of amending the text of Ordinance 11000, as amended, the Zoning Ordinance of the City of Miami, by amending Article 4 to permit, subject to Special Exception review, the implementation in C-1 Restricted Commercial zoning districts of vehicle rental facilities; Article 9, to codify regulations for such uses and Article 25 to provide a definition for vehicle rental facilities. PLANNING Approval RECOMMENDATION BACKGROUND AND Car and truck rental facilities are presently permitted as conditional principal ANALYSIS uses in C-1 Restricted Commercial zoning districts. The implementation of this use is regulated by zoning determination no. 95-013 issued on August 18, 1995, which requires proposals for such facilities to undergo Special Exception review. The proposed amendment to Zoning Ordinance 11000, seeks to incorporate the intent of this determination by incorporating the provisions of zoning determination 95-013 and providing additional conditions and limitations, as well as a definition. 9 PLANNING ADVISORY BOARD Approval. Luft, Direc 95-013 Department of Community Planning ENCLOSURES: & Revitalization Pursuant to Section 904, Determinations Concerning Uses Not Specified of Zoning Ordinance 11000, and in response to your memorandum of.August 4, 1995, it is hereby determined that: There are no provisions for automobile and/or truck rental facilities in Zoning Ordinance 11000. Zoning Ordinance 11000 currently allows for the sale of new vehicles by right, and the sale of used vehicles by Special Exception in the C-1 Restricted Commercial Zoning District; Zoning Ordinance 11000 also allows for the sale of new and used vehicles by right in the C-2 Liberal Commercial Zoning District. In considering how to address the use of facilities involving the rental of vehicles (automobiles and/or trucks) within the Zoning Ordinance of the City of Miami, the Department of Community Planning and Revitalization has made the following findings: 1. Vehicle rental facilities are similar in impact to facilities involving the sale of used vehicles; as previously stated, Zoning Ordinance 11000 allows the sale of used vehicles by Special Exception Permit within C-1 Restricted Commercial Zoning Districts and by right in C-2 Liberal Commercial Zoning Districts. 2. It is therefore concluded that "Vehicle Rental Facilities" shall be permissible by Special Exception within the C-1 Restricted Commercial Zoning District and by right within the C-2 Liberal Commercial Zoning District. In considering the permissibility of vehicle rental facilities, specifically in the C-1 Restricted Commercial Zoning District where a Special Exception is required, the following criteria and standards, in addition to those already listed in Section 1305 of Zoning Ordinance 11000, shall be applied: Page 1•. of 2 1�1�5� 1. Accessibility; Vehicle rental facilities shall only be permitted along major arterial roadways which are suitable for truck access and high volume capacities. 2. Circulation; vehicular circulation patterns shall be designed in such a way so as to minimize, if not completely eliminate, any impact on adjacent side streets, particularly if said side streets lead into bordering residential areas. 3. Limitations on servicing; servicing of vehicles to be kept on - site, shall be limited to those minor in nature and regular maintenance; all said work shall be conducted within enclosed buildings or shall be screened. 4. Aesthetics/visual impact; outdoor parking areas for the storage of vehicles to be kept onsite shall be appropriately screened; any security lighting shall be directed away from adjacent residential areas; and sign limitations shall be as specified in the C-1 Restricted Commercial Zoning District regulations. At the next opportunity, this department will amend the zoning ordinance to appropriately reflect this determination. Until such amendment, this determination shall govern regulation of this particular use.
