HomeMy WebLinkAboutO-11358J-95-989 2/16/96 ORDINANCE NO. 113 5 8 AN ORDINANCE AMENDING THE ZONING ORDINANCE BY AMENDING SECTION 608, "SD-8 DESIGN PLAZA COMMERCIAL -RESIDENTIAL DISTRICT," TO MODIFY REQUIREMENTS FOR MIXED USE PROJECTS WHICH INCORPORATE A RESIDENTIAL COMPONENT; AND SECTION 617, "SD-17 SOUTH BAYSHORE DRIVE OVERLAY DISTRICT," TO MODIFY AND CLARIFY HEIGHT LIMITATIONS; CONTAINING' A REPEALER PROVISION AND A SEVERABILITY CLAUSE; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the Miami Planning Advisory Board, at its meeting of November 15, 1995, Item No. 6, following an advertised hearing, adopted Resolution No. PAB 57-95, by a vote of seven to zero (7-0), RECOMMENDING APPROVAL of amending Zoning Ordinance No. 11000 as hereinafter set forth; and WHEREAS, the City Commission after careful consideration of this matter deems it advisable and in the best interest of the general welfare of the City of Miami and its inhabitants to amend Ordinance No. 11000 as hereinafter set forth; NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Ordinance are hereby adopted by reference 11358 thereto and incorporated herein as if fully set forth in this Section. Section 2. Ordinance No. 11000, as amended, the Zoning Ordinance of the City of Miami, Florida, is hereby amended by amending the text of said Ordinance as follows:l/ "ARTICLE 6. SPECIAL DISTRICTS GENERAL PROVISIONS Sec. 608. SD-8 Design Plaza Commercial -Residential District. Sec. 608.4. Permitted principal uses and structures. 608.4.1. Permitted generally. As for C-1 except that: 1. Multiple dwellings and residence hotels shall be permitted only by Speer! Emeeptien Class II Special Permit in a mixed use building where the commercial uses occupy a minimum of f4:fty—E'�9� sixty-five (65) percent of the ground floor street frontage, and a minimum of thirty (30) percent of the total area of 1' Words and/or figures stricken through shall be deleted. Sec. 617. SD-17 South Bayshore Drive Overlay District. Sec. 617.2. Effect of SD-17 district designation. 617.2.4. Special height limits. Section 3. All ordinances or parts of ordinances insofar as they are inconsistent or in conflict with the provisions of this Ordinance are hereby repealed. Section 4. If any section, part of section, paragraph, clause, phrase or word of this Ordinance is declared invalid, the remaining provisions of this Ordinance shall not be affected. - 3 - 11358 Section 5. PETITION Consideration of amending Ordinance 11000, as amended, the Zoning Ordinance of the City of Miami, by amending Article 6, Section 608. SO-8 Design Plaza Commercial -Residential District, in order to modify the requirements for mixed use projects which incorporate a residential component, and Section 617. SO-17 South Bayshore Drive Overlay District in order to modify and clarify regulations pertaining to height requirements. PLANNING Approval. RECOMMENDATION BACKGROUND AND The proposed amendments to Zoning Ordinance 11000 in this petition are to clarify ANALYSIS the height requirements in the SD-17 District and to modify the regulations pertaining to residential uses in the SO-8 District. The SD-8 Design Plaza Commercial -Residential District is intended to promote an atmosphere which encourages the development of "design -oriented service uses" within the district. The regulations currently put a 50% limitation on the percentage of a mixed use structure which may be devoted to a residential component. Such a limitation is not necessary as long as the ground floor street frontage remains primarily devoted to commercial uses; the Planning Division further contends that a more substantial residential component within the district may serve as a catalyst for future businesses. The Class II Special Permit process will also ensure that any such proposed mixed use project is reviewed for compliance with the intent of the district. PLANNING ADVISORY BOARD Approval. VOTE: 7-0.
