HomeMy WebLinkAboutO-11353J-96-113 3/22/96 ORDINANCE NO. 1135 3 AN ORDINANCE AMENDING CHAPTER 2, SECTIONS 2-75 AND 2-76 OF THE CODE OF THE CITY OF MIAMI, FLORIDA:, AS AMENDED, WHICH SET FORTH THE FEES_ FOR ZONING CERTIFICATES OF USE AND FOR INSPECTION AND EXAMINATION OF PLANS; BY AMENDING SAID FEES TO COVER THE COST FOR THE ENFORCEMENT OF ORDINANCE NO. 11000, THE ZONING ORDINANCE OF THE CITY OF MIAMI, FLORIDA, AS AMENDED, AND OF THE SOUTH FLORIDA BUILDING CODE; CONTAINING A REPEALER PROVISION, A SEVERABILITY CLAUSE, AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the City Manager recommends that, in order to provide much needed services for the operation of the City of Miami, fees be increased to cover the cost for the enforcement of Ordinance No. 11000, the Zoning Ordinance of the City of Miami, Florida, as amended, and of the South Florida Building Code; NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Ordinance are hereby adopted by reference thereto and incorporated herein as if fully set forth in this Section. 11353 Section 2. Section 2-75 of the Code of the City of Miami, Florida, as amended, is hereby amended in the following particulars: 1 / "Sec. 2-75. Zoning certificate of use required; annual reinspection of buildings and premises; fees for inspections and issuance of certificates. (A) Inspection and Service Fees for Certificate of Use. All persons applying for a certificate of use for the use of vacant or improved land or for a change of use of the land or for a change in the use of an existing building shall pay the following inspection and service fees: (1) Retail: Up to 2,000.......................... $250.00 Each additional 1,000 square feet or part in excess of 2,000 square feet ................. $'� $50.00 (2) Wholesale (including warehouse and shops): First 2,000 square feet or less $250.00 Each additional 1,000 square feet or part in excess of 2,000 square feet ................ $25.OG $50.00 (3) (a) Restaurants including bars, lounges, theaters, etc.: First 100 seats .................. $250.00 Each additional 25 seats or portion thereof .......................... $25-00 $50.00 (b) Take-out restaurants (no seats); First 2,000 square feet ............ $250.00 Each additional 1,000 square feet or part in excess of 2,000 square feet .............. $'—moo $50.00 I/Words and/or figures stricken through shall be deleted. 1Underscored words and/or figures shall be added. Fees for Accessory Use Certificates. (1) All persons desiring to use a residential building structure located within a residential zone permitting a home occupation shall apply to the building and zoning department for an accessory use certificate, which shall be granted upon payment of an annual fee of fifty dellar-s—($ 50.00 ) -seventy-five ( $75 .00 ) dollars to the City and when issued shall be valid through the following September 30. In instances where a person sixty-five (65) years of age or over is engaged in the conduct of home occupation, there shall be no required payment of an accessory fee in conjunction with the issuance of an accessory use certificate or the subsequent renewal of such certificate. All renewals of accessory use certificates shall be made on (the subsequent renewal of such certificate) or before October 1 of each calendar year. (2) Those owners of private pleasure craft and housebarges on the Miami River on October 24, 1991, which qualify under sections 940 and 2502 of Zoning Ordinance 11000, shall apply to the PlaRRiRgr building and zoning department for a housebarge/private pleasure craft accessory use certificate,*which subject to inspection and compliance with applicable regulations, shall be granted upon the payment of an annual fee of twe h••^dr^'' dollars 4200.004 two hundred and fifty dollars ($250.00); all required renewals shall be made on or before January 1 of each year hereafter. Section 3. Section 2-76 of the Code of. the City of Miami, Florida, as amended, is hereby amended in the following particulars: 1/ 1/Words and/or figures stricken through shall be deleted. GG $200.00 Section 4. All ordinances or parts of ordinances insofar as they are inconsistent or in conflict with the provisions of this Ordinance are hereby repealed. Section 5. If any section, part of section, paragraph, clause, phrase, or word of this Ordinance is declared invalid, the remaining provisions of this Ordinance shall not be affected. Section 6. This Ordinance shall become effective thirty (30) days after final reading and adoption thereof. Background In order for the City of Miami to continue to provide the level of service the citizens of Miami deserve, the proposed amendment increasing and clarifying fees is required. The cost of properly enforcing the Zoning Ordinance and the South Florida Building Code continue to increase, yet the fees for the services provided remained the same for many years. Thus, it has become necessary to bring the cost up to the level of service that is being provided year after year.
