HomeMy WebLinkAboutO-11347J-96-102 2/1/96 ORDINANCE NO. 11347 AN ORDINANCE ESTABLISHING A SPECIAL REVENUE FUND ENTITLED:"ELECTRONIC MESSAGE CENTER" AND APPROPRIATING FUNDS THEREFOR, IN THE AMOUNT OF $50,000, SAID MONIES RECEIVED PURSUANT TO THE TERMS AND CONDITIONS SET FORTH IN THE REVOCABLE PERMIT ISSUED TO MCCAW COMMUNICATIONS OF FLORIDA AS AUTHORIZED BY RESOLUTION NO. 95-614, ADOPTED SEPTEMBER 14, 1995; CONTAINING A REPEALER PROVISION AND A SEVERABILITY CLAUSE. WHEREAS, Resolution No. 95-614, adopted September 14, 1995, authorized the City Manager to issue a Revocable Permit to McCaw Communications of Florida, Inc. ("McCaw"), for the installation of an unmanned mobile telephone equipment station on the roof of the Miami Police Department's parking garage; and WHEREAS, McCaw agreed to prepay the use fee for a period of five (5) years at a cost of $10,000 per annun, for a total of $50,000; and WHEREAS, said funds were designated by the Revocable Permit for use by the Police Department to purchase an Electronic Message Center; NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: 1.13.4 Section 1. The recitals and findings contained in the Preamble to this Ordinance are hereby adopted by reference thereto and incorporated herein as if fully set forth in this Section. Section 2. The following Special Revenue Fund is hereby established and resources are hereby appropriated as described herein: FUND TITLE: Electronic Message Center RESOURCES: McCaw Communications $50,000 of Florida, Inc. - Revocable Permit APPROPRIATIONS: Electronic Message Center $50,000 Section 3. The Police Department is hereby authorized to expend monies from said Fund for necessary costs to purchase and install an Electronic Message Center, Subject to compliance with all established procurement procedures. Section 4. All ordinances or parts of ordinances insofar as they are inconsistent or in conflict with the provisions of this Ordinance are hereby repealed. Section 5. If any section, part of section, paragraph, clause, phrase or word of this Ordinance is declared invalid, the remaining provisions of this Ordinance shall not be affected. Section 6. This Ordinance shall become effective thirty (30) days after final reading and adoption thereof. BACKGROUND: Resolution No. 95-614 authorized the City Manager to issue a Revocable Permit to McCaw Communications of Florida, Inc. The permit allows McCaw to utilize roof space on the Miami Police Department's parking garage for an unmanned mobile telephone equipment station. In consideration of said permit, McCaw agreed to prepay five (5) years of use fees, in the amount of $10,000 per annum, for a total cost of $50,000.
