ORDINANCE NO.
AN ORDINANCE RELATING TO FEE CALCULATIONS
FOR MULTIPLE VARIANCES; AMENDING "ARTICLE VI.
ZONING AND PLANNING FEES," OF CHAPTER 62 OF
THE CITY CODE BY CHANGING THE TEXT OF SECTION
62-61.(3) TO ESTABLISH A NEW METHOD FOR THE
CALCULATION OF SAID FEES FOR MULTIPLE
VARIANCES FOR ONE STRUCTURE; CONTAINING A
REPEALER PROVISION AND A SEVERABILITY CLAUSE;
AND PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, new methods implemented by the building and zoning department
have increased the efficiency of the review process, and
WHEREAS, the proposed reduction in fees for variance application will make the
process more cost effective for the applicant and thus will tend to promote development
within the City; and
WHEREAS, the text setting forth the method for the calculation of variance fees,
as it presently exists, is outdated with regard to its cross-reference; and
WHEREAS, the City Commission, after careful consideration of this matter
deems it advisable and in the best interest of the general welfare of the City of Miami
and its inhabitants to amend the City Code as hereinafter set forth;
NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:

Section 1. The recitals and findings contained in the Preamble to this
Ordinance are hereby adopted by reference thereto and incorporated herein as if fully
set forth in this Section.
Section 2. Article VI. Zoning and Planning Fees, of the Miami City Code, as
amended, is hereby amended by the implementation of changes to its text as follows:''-'

ARTICLE VI. ZONING AND PLANNING FEES
Sec. 62-61. Schedule of fees.
(3) Variances:
All applications for variances relating to the same structure shall be
assessed a single fee to be calculated per square foot of gross
floor area of the proposed structure or addition, based upon the
definition of gross floor area found in section 2502 of Zoning
Ordinance No. 1_1.000, as amended.........................................0.07.

Section 3. All ordinances or parts of ordinances insofar as they are
inconsistent or in conflict with the provisions of this Ordinance are hereby repealed.
Section 4. If any section, part of section, paragraph, clause, phrase or word of
this Ordinance is declared invalid, the remaining provisions of this Ordinance shall not
be affected.
Section 5. This Ordinance shall become effective thirty (30) days after final
reading and adoption thereof.

SECOND READING
PETITION Consideration of amending the Code of the City of Miami, as amended, by amending
"Article VI. Zoning and Planning Fees," of Chapter 62 of the City Code, in order to
provide a new method for the calculation of fees when multiple variances are
requested for one structure.

RECOMMENDATION
BACKGROUND AND The present method for calculation of variance fees, as set forth in the City Code,
ANALYSIS requires that the cost for each variance be calculated individually as a factor of
the square footage of the whole structure and a base cost per squre foot. Due to
the increased efficiency of the review methods implemented by the Building and
Zoning Department as well as the increase in staff resources, it is felt that the
replacement of the aforementioned formula with a new one which will calculate the
cost of the variances not individually but per structure, allowing all variances
for any one structure to come under a single fee, will make the review process more
cost effective for the applicant and thus will tend to promote development within
the City.
