ORDINANCE NO. 11338
AN EMERGENCY ORDINANCE AMENDING SECTION 2 OF
ORDINANCE NO. 11038, AS AMENDED, WHICH
ESTABLISHED A SPECIAL REVENUE FUND ENTITLEDC
"TRANSPORTATION PLANNING AND COORDINATION",
BY APPROPRIATING $50,000.00 IN ADDITIONAL
FUNDS CONSISTING OF $40,500.00 AS A GRANT
FROM THE METROPOLITAN PLANNING ORGANIZATION
FOR THE MIAMI URBANIZED AREA (MPO), AND
$9,500.00 AS THE CITY'S REQUIRED MATCHING
FUNDS, SAID FUNDS TO BE USED FOR THE
TRANSPORTATION PORTION OF THE COCONUT GROVE
PLANNING STUDY; FURTHER AUTHORIZING THE CITY
MANAGER TO ACCEPT SAID GRANT AND TO EXECUTE
ALL REQUIRED DOCUMENTS, IN A FORM ACCEPTABLE
TO THE CITY ATTORNEY; CONTAINING A REPEALER
PROVISION AND A SEVERABILITY CLAUSE.
WHEREAS, the Metropolitan Planning Organization for the
Miami Urbanized Area (MPO) is the recipient of federal
transportation planning funds under Section 9 of the Intermodal
Surface Transportation Efficiency Act; and
WHEREAS, the MPO, pursuant to Resolution No. 90-92, adopted
June 12, 1992, directed that some of these planning funds be used
to assist the municipalities of Dade County in coordination of
their transportation planning with that of the MPO; and
WHEREAS, pursuant to Ordinance No. 11038, adopted
February 25, 1993, the City Commission established a Special
Revenue Fund entitled "Transportation Planning and Coordination";
and

WHEREAS, on March 27, 1995, the City Commission adopted
Resolution No. 95-237 authorizing the City Manager to apply for
additional grant funds from the MPO in the amount of $40,500.00,
said grant to be matched by City funds in the amount of $9,500.00
and to be used for the transportation component of the Coconut
Grove Planning Study; and
WHEREAS, it is necessary to amend Ordinance No. 11038 to
appropriate these additional funds to the "Transportation
Planning and Coordination" fund so as to allow use of said funds
by June 30, 1996;
NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the
Preamble to this Ordinance are hereby adopted by reference
thereto and incorporated herein as if fully set forth in this
Section.
Section 2. Section 2 of Ordinance No. 11038, as amended,
adopted February 25, 1993, is hereby amended in the following
particulars:I/
"Section 2. The following Special Revenue Fund
is hereby established and resources are hereby
appropriated as described herein:

remaining provisions are now in effect and remain unchanged.

The City Manager is hereby authorized�/to
accept the grant in the amount of $40,500.00 to execute the
necessary documents, in a form acceptable to the City Attorney.
Section 4. All ordinances or parts of ordinances insofar
as they are inconsistent or in conflict with the provisions of
this Ordinance are hereby repealed.
Section 5.
If
any section, part
of section, paragraph,
clause, phrase or
word
of this Ordinance
is declared invalid, the
remaining provisions of this Ordinance shall not be affected.
Section 6. This Ordinance is hereby declared to be an
emergency measure on the grounds of urgent public need for the
preservation of peace, health, safety, and property of the City
of Miami, and upon the further grounds of the necessity to make
the required and

payments
to its employees and
officers, payment of
its debts,

and required purchases
The herein authorization is further subject to compliance
with all requirements that may be imposed by the City
Attorney, including but not limited to those prescribed by
applicable City Charter and Code provisions.

Section. 7. The requirement of reading this Ordinance on
two separate days is hereby dispensed with by an affirmative vote
of not less than four -fifths of the members of the Commission.
Section 8. This Ordinance shall become effective
immediately upon its adoption.
PASSED AND ADOPTED BY TITLE ONLY this 29th day of
February 1996.

It is respectfully recommended that the City Commission adopt the attached ordinance
increasing appropriations in the amount of $50,000 to the Special Revenue Fund .
entitled "Transportation Planning and Coordination", consisting of $40,500 in grant
funds from the Dade County Metropolitan Planning Organization (MPO) and $9,500 as
the City's required match. This funding is to be used for the Transportation Component
of the Coconut Grove Planning Study.
BACKGROUND:
The Department of Community Planning and Revitalization, Development Division, has
prepared the attached legislation.
Federal transportation planning funds, under Section 9 of the Intermodal Surface
Transportation Efficiency Act, have been made available to the City through the Dade
County MPO.
By -Ordinance No. 11038, adopted February 25, 1993, the City Commission established
a special revenue fund entitled "Transportation Planning and Coordination" for the use
of these funds.
By Resolution No. 95-237, adopted March 27, 1995, the city Manager was authorized
to apply for additional funds to be used specifically for the transportation component of
the Coconut Grove Planning Study. A grant in the amount of $40,500 was duly awarded
for this purpose. That amount, along with the required match must now be appropriated
as an increase to the special revenue fund so that we may begin the study.
