ORDINANCE NO.
AN ORDINANCE APPROPRIATING FUNDS, IN THE
AMOUNT OF $16,600.00, TO THE SPECIAL REVENUE
FUND ENTITLED: "DERELICT VESSEL REMOVAL GRANT
AWARD PROGRAM"; AUTHORIZING THE CITY MANAGER
TO ACCEPT A GRANT FROM THE FLORIDA DEPARTMENT
OF ENVIRONMENTAL PROTECTION (DEP) AND TO
EXECUTE THE NECESSARY DOCUMENTS, IN A FORM
ACCEPTABLE TO THE CITY ATTORNEY, TO IMPLEMENT
ACCEPTANCE OF SAID GRANT; CONTAINING A
REPEALER PROVISION AND A SEVERABILITY CLAUSE.
WHEREAS, the Florida Department of Environmental Protection
(DEP) is authorized, pursuant to Chapter 823.11 Florida,
Statutes, to provide grants to local governments to remove
derelict vessels from the waterways; and
WHEREAS, the DEP has notified the North/East Coconut Grove
Neighborhood Enhancement Team (NET), an entity of the City of
Miami, that it is eligible to receive a grant in the amount of
$16,600.00, entitled "Derelict Vessel Removal Grant Program"; and
WHEREAS, the North/East Coconut Grove NET has identified
specific derelict vessels in the Dinner Key Anchorage and
Biscayne Bay area which pose a threat to environmental
preservation, navigation, public health and safety and/or the
aesthetic condition of the general vicinity; and
WHEREAS, the City of Miami desires to remove said hazardous
derelict vessels;

NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the
Preamble to this Ordinance are hereby adopted by reference
thereto and incorporated herein as if fully set forth in this
Section.
Section 2. The following resources are hereby
appropriated to the Special Revenue Fund as described herein:

ENVIRONMENTAL PROTECTION

APPROPRIATION: DERELICT VESSEL REMOVAL $16,600
GRANT AWARD PROGRAM
Section 3. The appropriation is contingent upon the
approval of the City's application for a grant by the DEP, and
the City Manager's acceptance thereof.
Section 4. The City Manager is hereby authorizedl/ to
accept the aforementioned grant and execute the necessary
documents, in a form acceptable to the City Attorney, with the
Florida Department of Environmental Protection to implement
acceptance of said grant.
Section 5. All ordinances or parts of ordinances insofar
as they are inconsistent or in conflict with the provisions of
this Ordinance are hereby repealed.
1 The herein authorization is further subject to compliance
with all requirements that may be imposed by the City
Attorney, including but not limited to those prescribed by
applicable City Charter and Code provisions.

Section 6. If any section, part of section, paragraph,
clause, phrase or word of this Ordinance is declared invalid, the
remaining provisions of this Ordinance shall not be affected.
Section 7. This Ordinance shall become effective thirty
(30) days after final reading and adoption thereof.

Recommendation
It is respectfully recommended that the City of Miami Commission adopt the attached
ordinance appropriating additional funds from a grant received from the Florida Department
of Environmental Protection in the amount of $16,600. A Special Revenue fund has already
been established entitled "Derelict Vessel Removal Grant Program."
Background
The North/East Coconut Grove NET Office , recommends ratification of the attached
ordinance. A number of derelict vessels have been identified in the City of Miami
waterways. These abandoned boats are a threat to the environment, public health and safety ,
navigation and the aesthetic condition in the area. The acceptance of these grant funds will
allow us to commence the removal of these hazardous vessels.
City Commission ratification of the attached ordinance is highly recommended.
