RE: Lease agreement between City of Miami and Tony Molina, Inc.
dated Septembez 29, 1977, as amended, (the "Lease") for use
of space at 650 Curtiss Parkway (Niiami Springs Golf Course)
Dear fir. Stierheim:
This letter serves to request an appearance before the City
Commission at its meeting of November 21, 1996 to discuss my

On May 23 and June 13, 1996, I appeared before the City
Commission to request certain modifications to the Lease related
to rent.
At each of these meetings, it appears that there was a

discussion addressed a more long-term solution and did not
address my current situation.
It is respectfully requested at this time that the Commissions
adopt a Recolution:
1) Authorizing continued occupancy of the premises by Tony
Molina, Inc. on a month -to -month basis pursuant to the terms
and conditions of the Lease, except that the minimum annual
gent as provided in said Lease sball remain at $20,000
throughout Tony Molina, Inc.'s use and occupancy of the
premises and such tenancy may be terminated by either party
upon providing 30 days advance written notice to the non -
canceling party;

2) Authorizing a rent credit in an amount not to exceed S10,500
for the furnishing and installation of new carpeting within
the pro shop and common areas of the clubhouse, subject to
Tony Molina, Inc. providing, at Tony Molina, Inc.'s sole
rust, the furnishing and installation of carpeting to the
leased areas;
3) Authorizing the non-exclusive use of the patio area located
on the east side of the clubhouse for the purpose of serving
refreshments.

The Office of Asset Management has reviewed the request by Tony Molina, Inc. and
recommends the following:
1) Approval of Tony Molina's request to continue occupying the premises located
at 650 Curtiss Parkway on a month -to -month basis pursuant to the terms and
conditions of the lease dated September 29, 1977, as amended, while
maintaining the minimum annual rent at $20,000 or 12% of gross receipts,
whichever is greater. It is recommended that Mr. Molina's month -to -month tenancy
continue until such time as the City determines the ultimate disposition of the Miami
Springs Golf Course. In the event the City does not sell the property, then the future
use of the property will have to be reevaluated. Additionally, based on the current
use of the facility, it is recommended the minimum annual rent be maintained at
$20,000. As the lease further provides for the City to receive twelve percent (12%) of
Mr. Molina's gross receipts, the City will continue to benefit in any increase in
business activity.
2) Disapproval of a rent credit in an amount not to exceed $10,600 for the
furnishing and installation of new carpeting within the pro shop and common
areas of the clubhouse. In order to alleviate a dangerous condition in the pro shop
and reduce the City's potential liability, the City has begun the process of procuring
new carpet in the pro shop. While it would be desirable to replace the carpet in the
common areas with the same Mr. Molina intends to utilize in replacing, at his
expense, the carpet in the restaurant and banquet areas, this would be an
unnecessary expenditure at this time.
3) Approval of Mr. Molina's request for the non-exclusive use of the patio area
located on the east side of the clubhouse for the purpose of serving
refreshments subject to said use not interfering with the golf course
operations and said gross receipts being included as part of the gross receipts
for the restaurant. Providing an area for eating outside would minimize further
destruction of the carpet in the restaurant and common areas by minimizing golfers
wearing golf shoes walking on same, and is desirable as an added feature to the golf
course particularly at this time of year when the weather is favorable.
