Dear Mr. Odio:
We request the Commission issue us permits to place a four or five piece band on
two parking spaces immediately adjacent to our property line in front of the Taurus
at,3540 Main Highway, Coconut Grove. We have a long history of renting these
parking spaces from the Off Street Parking Authority specifically for this purpose for
special events five or six times a year.
We are specifically asking for permission to do this at the request of the Police
Department, and the Net Office as a way of formalizing this practice. The specific
events we are requesting for 1996/97 are:
Halloween, Thursday night October 31, 1996, from 8:30pm to 12pm.
Mango Strut, Sunday afternoon December 29, 1996, from 2pm to 6pm.

Taste of the Grove, Sunday afternoon January 19, 1997 from 2pm to 6pm.

Coconut Grove Arts Festival, Saturday, Sunday & Monday afternoon {
February 15, 16 & 17, 1997 from 3pm to 6:30pm.

fThe N/E Coconut Grove Net Office requests denial for the following reasons:
1. Placing a band in the street is a safety hazard to motorists, bicyclists and
pedestrians.
2. This request would require conditions such as street closures, permits and
insurance. This would fall under the guidelines of Coconut Grove Special Events.
3. The musicians would need to adhere to the noise ordinance.
4. The residential neighbors are strongly against this request due to the noise.

Dear Mayor Carollo and City Commissioners:
I have been retained by Mr. and Mrs. Phillip Corey who reside at
a3507 Main Highway to represent them in the referenced matter. My
_ clients live across the street from the Taurus Restaurant in the
Camp Biscayne single family subdivision. They, along with
residents representing 24 of the 28 properties in Camp Biscayne
oppose the request to place a band in the two parking spaces in
the public right-of-way in front of the restaurant.
Their objection to this requst is based upon the following:
• As residents in this community, they have a right to the quiet
enjoyment of their property.

• The City should not allow public right-of-way to be used for
the sole purpose of insuring a profit for a private entity.

• The City Code establishes regulations to insure that noise
from any source is limited. There is no compelling -reason to
increase the noise level in this area at the expense of the
surrounding residents.

• Granting this "permit" opens the door for establishments all
over the business district to request and get the same use of G
the public right-of-way. This could lead to the loud noise of E
competing bands up and down the streets of Coconut Grove.

Dear J.L.
This agenda item deferred from the meeting of October 10, 1966 with the request by
Commissioner Plummer that we get together with the Net Office, the Police, and the Neighbors to
come up with an acceptable alternative. The modified request is attached and has been furnished
to the agenda coordinator although not in sufficient time to be modified on the agenda. In February of '1996, prior to the last time we had a band outside, we met with the Police and the
neighbors in an effort to resolve the complaints of a few neighbors who live on Main Highway.
Since that time, over 180 nights of music have occurred without any complaints regarding noise
levels. We took the necessary measures, and enforced them to insure this good neighbor policy.
Now a few neighbors object to us having a band outside on the four special occasions requested
on the attached agenda item. They do not represent all our neighbors. We have letters from
other neighbors who live next door saying we have never been intrusive to them. A number of
other neighbors have told me that we do not intrude but are staying out of the issue, as can be
understood, since they live next door to the few that complain. The net office is siding with the few
neighbors by saying we are in a residential area. Yes residences are adjacent to our property but
we are clearly in a commercial area, and taxed on a commercial basis. The Taurus and it's
predecessors have been a commercial endeavor continuously since 1919.
The Taurus is a pillar of law and order, and provides entertainment and service to the community
in general. The Taurus has contributed its own special flavor to special events in the Grove, since
its inception. As you are aware many commercial spaces in the Grove are vacant and for sale or
rent. In order to have a vital Grove, you have to have vital participating merchants who contribute
in their own unique way to these special occasions.
We ask for your support on this issue so we may continue to enhance the ambiance that is special
to the Grove on these four special occasions.

Dear Mr. Stierheim:
This agenda item was deferred at the meeting of October 10th, 1996. Commissioner
Plummer requested we meet with the Police, the Net Office and our Neighbors. Based on the
input garnered from those meetings we alter our request to the Commission as follows.
A resolution to declare an exemption from the prohibitions contained in Miami City Code
Chapter 36-4 (a) and declare them inapplicable on the following special occasions as provided for
in Chapter 36-4 (b).
The special occasions in 1996/97 are:
• Permission to have a band outside on our patio Halloween night, Thursday October 31,
1996, from 8:00pm to 11 pm.
• Permission to have a band outside on our patio immediately following the Mango
Strut, Sunday afternoon December 29, 1996, from 2pm to dark.
• Permission to have a band outside on our patio during the Taste of the Grove, Sunday
afternoon January 19, 1997 from 2pm to dark.
• Permission to have a band outside on our patio during the Coconut Grove Arts Festival,
Sunday afternoon February 16, 1997 from 3pm to dark.
We would like to point out that Sunday February 18, 1995, (the second day of last years
Arts Festival) we had a band that played on our patio and no complaints were received from
neighbors or the Police. This special occasion followed soon after our meeting with the neighbors
and Police at which time we promised to take the necessary measures to keep our sound at
acceptable levels. Based on this performance we believe we can contain our sound on the
special occasions above.
We are asking for this resolution at the request of the Police Department as a way of
formalizing the activities we have practiced for many years on special occasions..
