The meeting was called to order at by Mayor Joe Carollo with the following members of the Commission found to be present: ALSO PRESENT: Mayor Joe Carollo Vice Mayor Wifredo Gort Commissioner Tomas Regalado Commissioner J.L. Plummer, Jr. Christina Cuervo, Assistant City Manager IvNlalter J. F'oeman, City Clerk Maria J. SWEAR IN NEW CITY MANAGER, MERRETT S'TIERHEIM. Mayor Carollo: 'Phis is a brief and short ceremony to have the Clerk of the City of Miami swear in our now City Manager. Mr. Walter J. Foeman (City Clerk): Raise your right hand please, sir, and repeat after me. Mr. Merrett Stierheim: I Merrett Stierheim do solemnly swear that I will support, protest and defend the Constitutions and Laws of the United States of America and of the State of. Florida and of the Chaster of the City of Miami. In all respects faimilly discharge the duties of City Manager of the City of Miami. Mr.Foeman: Congratulations. (APPLAUSE) I September 13, 1996 [i OR Mr. Merrett R. Stierheim (City Manager): Thank you, Thank you very much. Mayor Carollo: Congratulations. Welcome atxiard. Go ahead and say something. Mr. Stierheim: I obviously don't have very much to say. I kind of expressed myself yesterday. I am very appreciative for the confidence, Mr. Mayor, from you and from your colleagues on the Commission. Mr. Plummer joining us and I... 'Yeah, I commit to spending the next 50 days or whatever it is, hard at work here in the City and trying to assist this fine Commission as much as I can, and the people of this: City. Thank you. Commissioner Plummer: You always have, and let me gust say to those who don't know. I have had the pleasure of working with this than in at least four or five different capacities through the Tourist Development Council, through ether activities that we have had that we. worked together, and I am very proud and I am sure that they have already expressed to you that any office is open in any way shape or form to assist you as you will assist us. And I am so glad to have you here. Mr. Stierheim: Thank you. Thank you very much. ! Commissioner pegalado: I just want to say what we said yesterday. We are very glad to have Merrett Stierheim with us. He, I think will bring to the City what the City needs urgently and... stability and I, which I am the new face here, I am very enthusiastic, about working with him and the rest of the Commission of course, the Mayer. So, welcome, Merrett: Mr. Stierheim: 'Thank you,Commissioner. Commissioner Plummer: I only have one regret in life with Merrett Stierheim. And that is, he would not let me get involved with him when he was in charge of the Womens' Tennis Association. Mayor Carollo: Well, welcome (sack to Miami City ball, Mr.. Manager. Mr. Stierheim: Thank you. Thank you very much. Commissioner Plummer: Turn your cameras off because we need to discuss an issue that's been duly advertised about the meeting to select a new Commissioner. Is the City Attorney here? I j „assume we can talk about it on the record since we. Can we talk about it or we can't? Mayor Carollo: Well, is this on the Sunshine, gentlemen? We've got enough cameras here; enough media people. Commissioner Plummer: Well the media is here so I. The problem is, that I am going out of town and we are uTing to arvange a meeting. t Ms. Christina Cuervo (Assistant City Manager): We are going to get Quinn on the phone-. Commissioner Plummer: All right, And we are trying to schedule this meeting (bank and forth, 4layor Carona: What I have done Commissioner Plummer is, I got your schedule Comm, Mioner Plummmen He's got more than F have. Mayor Carollo:... and Nice Mayor Gert's, since I knew you were going out of town... 2 Septemtvr 13,1996 i4a n Commissioner Plummer: Oh, wait a rninute, you might have to call a special meeting to further discuss this matter... Come back here, don't run out saying you',ve got a scoop. Mayor Carollo: The only thing we are discussing Is the time when we'll be rneeting and I've got in ► schedules of the respective members of the City Commission and next week we will have a special commission meeting to deal with the matter of filling in the vacancy we have its th City Commission. So, some time next week and I will venture to say it will either be on Monday or on "Airsday, we will have a meeting. Cvno.mNsioner Plummer: Joe, OK. There's got to be. Ms. Cuervo: I've got Quinn on the line. Cbmmissioner Plummer. All right, well I am riot Talking to him. There is a legal question that I would ask that be proferred, that when we meet, whenever it is. And that question is a concern. That concern is if in fact, because I know the law. If the commissioner whose seat is being filled is in any way cleared, he has the right to come back to that seat? Mayor C'aroilo: Absolutely. Commissioner Plummer- OK. Mayor E.:arollo: Absolutely. Commissioner Plummer: Now, the second part of that questions is, if this goes to an election, is 'the person who takes the election fully, got to be aware; of that, that he could have to give up th...t seat prior to when it was vacant, next November. The seat was vacant next November anyhow. And if our colleague was still here he wand have had to run if he chose. So my question is, can it go to an election, I don't know or in fact, it can. go to an election? Ms. Cuervo: It can go to'an election it has to before the remaining... well, I g►.iess the election will be until he comes back. Commissioner Plummer: What happens if the colleague is cleared and comes back. Ice's ,entitled to the seat. Manor. C arollo: He is. That person will have to step down. Commissioner Plummer: He's going to have to give it up. That's why I asked the question. Mayor Carollo: That person will have to step down. Ms. Cuervo: The election will have to be for the balance of the term. If the Commissioner is cleared prior to the term being terminated... Commissioner Phimmer: Completed. Ms. C-uervo:... prior to the end of the term, then he comes back. If the term is ended... Commissioner Plummer: So the person who had to run for election would have to give it up and give it tack to him. That's, yes. Could we have a legal, a written opinion on that plemc? M4 or orcllo: Sure. For the benefit of the media that's been wandering what the procedure wilt +t be. Whether we appoint someone by next week or not, the seat will have to go to an election, November 5... 3 September 13, 1996, 1 Commissioner Plummer: Yes. i Mayor C:arollo:... which is our next general election. Commissioner Plummer: Correct. i Mayor Carollo: The only question and the only difference then will on whether we are going to 1mve. a runoff or not. Now, if we appoint a replacement to the Commission seat then there will be most likely, a runoff a *week after the general election - November the 5th. Mayor Caroilo: If we do not appoint someone, then it's the same type of election as we have had twice already when I was selected Mayor and when Commissioner Regalado Was selected that. whoever gets the most votes will win, without any kind of runoff. Commissioner Pluninter: OK So what's actually being said regardless, there is going to be an i election in November, right. 'That would be November the 5th. Mayor Carollo: November the 5th will be the next general election. ' Commissioner Plummer.. Regardless of whether we appoint or we don't. Mayor Carollo: Exactly. For the benefit for the Spanish media and... What? There is a special election if you do not name a replacement. If you name a replacement then it's not called a special election, it will be a itgular election. Unidentified Speaker: But the Special Election will be November 5th or before November Sth? However, if we name someone to the seat then there has to be a, runoff according to our City Charter. If. we do not name anyone then it's a one shot election. Whoever, ! gets the most votes wins.
