FROM : Q inn O es, III REFERENCES: Commission Meeting 4/25/96 City Atto y ENCLOSURES: I J-96-214 _ 3/23/96 Lej"I Zi�►CoLi►li� AN ORDINANCE RELATED TO THOSE COMMUNITY BASED ORGANIZATIONS (CEOs) AND COMMUNITY DEVELOPMENT CORPORATIONS (CDCs) WHICH SOLICIT FUNDING FROM THE CITY; ESTABLISHING RESIDENCY REQUIREMENT'S FOR MEMBERS AND.KEY PERSONNEL OF SAID ORGANIZATIONS; FURTHER, PROVIDING THAT SAID RESIDENCY REQUIREMENTS MAY BE WAIVED BY A FOUR -FIFTHS AFFIRMATIVE VOTE OF THE CITY COMMISSION; CONTAINING A REPEALER PROVISION, A SEVERABILITY CLAUSE AND PROVIDING FOR AN EFFECTIVE DATE. BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The residency requirements for board members and key personnel of those Community Based Organizations (CBOs) and Community Development Corporations (CDCs) which solicit funding from the City of Miami shall be as follows: As a condition precedent to being eligible for funding by the City of Miami, all Community Based Organizations (CBOs) and Community Development Corporations (CDCs) shall show proof that, (1) at least ninety percent (900) of the CBOs' or CDCs' board of directors and key personnel reside in the City of Miami; and (2) at least seventy-five percent (750) of the CBOs' or CDCs' board of directors and key personnel reside within the boundaries of 3 96- 319 the community represented by said CBO or CDC. For purposes of this Section, the term key personnel shall be defined as to include the following persons: the chief executive officer, the executive director, the chief financial officer, the president, the vice-president, the secretary, the treasurer and any other officers or directors of the organization. Section 2. The City Commission, by a four -fifths affirmative vote of its membership, may waive the residency requirements established pursuant to Section 1 of this Ordinance. Section 3. All ordinances or parts of ordinances insofar as they are inconsistent or in conflict with the provisions of this Ordinance are hereby repealed. Section 4. If any section, part of section, paraTcaph, clause, phrase or word of this Ordinance is declared invalid, the remaining provisions of this Ordinance shall not be affected. Section 5. This Ordinance shall become effective thirty (30) days after final reading and adoption thereof. PASSED ON FIRST READING BY TITLE ONLY this 23rd day of March, 1996.
