HomeMy WebLinkAboutR-97-0924J-97-888 12/26/97 RESOLUTION NO. 9 ` — 924 A RESOLUTION, WITH ATTACHMENT, ELECTING TO USE THE UNIFORM METHOD OF COLLECTING NON -AD VALOREM SPECIAL ASSESSMENTS LEVIED IN THE INCORPORATED AREA OF THE CITY OF MIAMI, FLORIDA, TO PROVIDE FIRE RESCUE SERVICES AND FACILITIES; STATING A NEED FOR SUCH LEVY; DIRECTING THE TRANSMITTAL OF THIS RESOLUTION; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the City Commission of Miami, Florida, is contemplating the imposition of special assessments for the provision of fire rescue services and facilities; and WHEREAS, the City Commission intends to use the uniform method for collecting non -ad valorem special assessments for the cost of providing fire rescue services and facilities to property within the incorporated area of the City of Miami, Florida, as authorized by Section 197.3632, Florida Statutes, as amended, because this method will allow such special assessments to be collected annually commencing in November 1998, in the same manner as provided for ad valorem taxes; and WHEREAS, the City Commission held a duly advertised public hearing prior to the adoption of this Resolution, proof of publication of such hearing being attached hereto as Exhibit A; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: jATTACjjMEtj,T (5) ;.�Q�tiA�HED -------------- My COMMISSION MEETING OF 0 E C i n 1997 Resolution No. 97 924 Section 1. The recitals and findings contained in the Preamble to this Resolution are hereby adopted by reference thereto and incorporated herein as if fully set forth in this Section. Section 2. Commencing with the Fiscal Year beginning October 1, 1998 and with the tax statement mailed for such Fiscal Year, the City intends to use the uniform method of collecting non -ad valorem assessments authorized in Section 197.3632, Florida Statutes, as amended, for collecting non -ad valorem assessments for the cost of providing fire rescue services and facilities. Such non -ad valorem assessments shall be levied within the incorporated area of the City of Miami, Florida. A legal description of such area subject to the assessment is attached hereto as Exhibit B and incorporated by reference. Section 3. The City Commission hereby determines that the levy of the assessments is needed to fund the cost of fire rescue services and facilities within the incorporated area of the City of Miami, Florida. Section 4. Upon adoption, the City Clerk is hereby directed to transmit a copy of this Resolution by United States mail to the Florida Department of Revenue, the Miami -Dade County Tax Collector, and the Miami -Dade County Property Appraiser by January 10, 1998. Section 5. This Resolution shall evidence the City of Miami's written agreement to reimburse the Miami -Dade County Tax Collector and the Miami -Dade County Property Appraiser for all necessary administrative costs and the actual collection costs - 2 - 97- 924 associated with the City of Miami's use of the uniform method of collecting non -ad valorem assessments as provided for and authorized in Section 197.3632, Florida Statutes, as amended. F 1, 2 flogging of an elderly gunner's mate. The man was crippled for life, and Levy was horrified. This was the man who walked on board the Vandalia in 1838, with the authority to try his own methods of running a ship. Within a year, the Vandalia was in good repair, its crew in high spirits and Levy ordered the guns painted blue to make the ship distinctive. Levy's methods astounded many officers and captains. Remembering the flogging he had witnessed, he abolished flog- ging on his ship. In its place, he used ridicule. Men convicted of theft had to wear placards read- ing "Thief," while drunks had that appellation hung about their necks. The abolition of flogging dis- turbed the officers, who feared a mutiny, but Levy felt he was on solid moral ground. At that time only three classes of people could be flogged: convicted fel- ons, sailors and slaves. Flogging had been abolished in the Army, and several abor- tive attempts had been made in Congress to end flogging in the Navy, the earliest in 1820. where slavery was hotly debated. "Never let American citizens in the northern states rail at slav- ery, or the punishment inflicted on slaves, or say that it is wrong, so long as their own sons, their own flesh and blood, their own seamen, their own free citizens and the men to whom they look for protection in case of war are daily subject to the same treat- ment of slaves, whose degraded situation in the southern states calls forth, so justly, the warmest sensibilities of the heart and nature of the philanthropists," McNally wrote. Linking flogging in the Navy and slavery may have chilled plantation owners. They could probably see an attack on their lashes coming next. Levy also published a pro- posed manual for the conduct and operationof ships of war and their crews, as well as arti- cles in the New York Evening Star and the Army and Navy Journal. Adding support for Levy's cause was the book Two Years Before the Mast by Rich- ard Henry Dana, which detailed the abuse of the lash. But in April 1842, . Levy was before the Senate Committee on Naval Affairs, chaired by Sen. Yulee of Florida. Yulee called the proposal "radical" and said it should become an "accidental amend- ment." He sidetracked debate through parliamentary proce- dures and kept the matter from reaching a vote. In 1850, on the Senate floor and beyond Yulee's control, Hales attached a rider ending flogging to the naval appropria- tions bill. Despite spirited debate, the rider stayed. In the House, Rep. Jacob Thompson, a Mississippi Demo- crat, introduced a simplified version, which passed. Levy's goal had been achieved — flog- ging was banned in the Navy., Shortly thereafter, a second measure ended alcohol rations, except for medicinal purposes, on U.S. warships. Upon his return to the United States, Levy made a fortune in Manhattan real estate and bought the deteriorating man- sion of one of his heroes — Thomas Jefferson..
