WHEREAS, Florida Homeowners' Insurance rates continue to escalate at an alarming rate, skyrocketing premiums to unrealistic heights and affected homeowners are in need of fiscal relief from these burdensome rates; and WHEREAS, Florida Insurance Commissioner Bill Nelson plans to introduce a Homeowners' Relief Act at the 1998 legislative session that would ultimately bring insurance premiums into a realistic realm by, among other provisions, putting rate request increases under the sole jurisdiction of the Insurance Commissioner by repealing current provisions in the law that empower an appointed arbitration panel to overrule the peoples' elected insurance commissioner on rate requests; and WHEREAS, the Homeowners' Relief Act would also amend Florida's property insurance law so that computer -model projections of potential hurricane losses are no more than advisory; and WHEREAS, the Miami City Commission strongly expresses its support for the passage of the Homeowners' Relief Act; crry COMOSSIOAit MEETING OF. DEC 9 1997 Resolution No. 97- 898 NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and .findings contained in the Preamble to this Resolution are hereby adopted by reference thereto and incorporated herein as if fully set forth in this Section. Section 1. The Miami City Commission hereby supports the Florida Insurance Commissioner's proposed Homeowners' Relief Act to be introduced at the 1998 Florida legislative session. Section 2. The City Manager is hereby instructed to direct Miami's Tallahassee lobbyist to immediately relay the Commission's feelings to the members of the State Legislature. Section 3. The City Clerk is hereby directed to transmit a copy of this Resolution to the members of the Miami -Dade County Delegation, the Florida Insurance Commissioner, and President of the State Senate. EXPRESS CITY COMMISSION SUPPORT FOR STATE'S PROPOSED HOMEOWNERS' RELIEF ACT -- INFORM CITY LOBBYISTS AND MIAMI-DADE COUNTY DELEGATION OF COMMISSION'S SUPPORT. Chairman Hernandez: Commissioner Regalado, any pocket items? Commissioner Regalado: Yes, I do. I have one. And this is an issue that will be discussed in the legislature, and it's important that this City supports this issue. And I was hoping if the Commission approved the pocket item, we will direct the lobbyists from the City of Miami to work on this direction, and also to direct the City Clerk to communicate to the Dade County delegation the contents of this pocket item. And it's... basically, it's in support of the Homeowners' Relief Act. Commissioner Bill Nelson is trying to eliminate a board, repeal provisions in the law that empowered an appointed arbitration panel that has been overruling the people's elected Insurance Commissioner on rate requests. And because of this panel, we have had two raises recently in South Florida. It's about the only thing that we can do to alleviate the problems that we have with the insurance companies raising rates for homeowners in the City of Miami, and I think that it's worth a try to lobby for the Homeowners Relief Act. Earlier this year, the state's largest insurance company attempted to increase the rate of homeowner insurance on average of 24% statewide, including a 33% increase in Miami - Dade County. Insurance Commissioner Bill Nelson denied this request, deeming the action as excessive and unfair. In June, 1997, a three -member arbitration panel overturned Commissioner Nelson's decision, and allowed the insurance company to raise homeowner premiums in the State of Florida. In the `98 legislative session, Commissioner Nelson is proposing the Homeowners' Relief Act, which will include a repeal of provisions in the law that empower an appointed arbitration panel to overrule the people's elected insurance commissioner on rate requests. The successful implementation of the Homeowners' Relief Act is beneficial to every homeowner in the City of Miami. Therefore, I believe it to be pertinent that we lend our support to the Homeowners' Relief Act: 97- 898
