RESOLUTION NO. 9 896
A RESOLUTION, WITH ATTACHMENT, AUTHORIZING THE
CITY MANAGER TO EXECUTE THE "EASTWARD HO!
BROWNFIELDS PARTNERSHIP AGREEMENT", IN
SUBSTANTIALLY THE ATTACHED FORM, FOR THE PURPOSE
OF FACILITATING THE REHABILITATION, REVITALIZATION
AND REDEVELOPMENT OF CONTAMINATED AND
ABANDONED OR UNDERUSED SITES IN SOUTHEAST
FLORIDA.
WHEREAS, the City of Miami has sought to redevelop City neighborhoods through a
community planning and revitalization strategy; and
WHEREAS, much of the City's industrial areas have suffered from massive
employment loss during the past fifteen years that was due, in part, to environmental
contamination perceived or real; and
WHEREAS, the City obtained a U.S. EPA Brownfields Demonstration Pilot grant in
October 1996 that was targeted at addressing these issues in the redevelopment of a very
depressed industrial area in Wynwood; and
WHEREAS, in September 19097, the State of Florida awarded the City of Miami a
Brownfields Redevelopment grant in the amount of $500,000 to further BROWNFIELDS
redevelopment activities; and
WHEREAS, the "Eastward Ho! Brownfields Partnership" was established in October
1997 to support and coordinate the rehabilitation, revitalization and redevelopment of
Brownfields in Southeast Florida; and

WHEREAS, the "Eastward Ho! Brownfields Partnership" submitted an application for
designation as a Brownfields Showcase Community, which will bring financial and
technical resources from 17 federal agencies to the region;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF
MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this Resolution
are hereby adopted by reference thereto and incorporated herein as if fully set forth in this
Section.
Section 2. The City Manager is hereby authorized to execute the "Eastward Ho!
Brownfields Partnership Agreement", in substantially the attached form, for the purpose of
facilitating the rehabilitation, revitalization and redevelopment of contaminated and
abandoned or underused sites in Southeast Florida.
Section 3. This Resolution shall become effective immediately upon its adoption.

The "Eastward Ho! Brownfields Partnership
Agreement"
I. Pu rpose
The Purpose of this Partnership Agreement is to provide a framework to support the
signatory agencies, organizations and governments to work in coordination to facilitate
the rehabilitation, revitalization and redevelopment of contaminated and abandoned or
underused sites in Southeast Florida.
II. Background
The Eastward Ho! Initiative. The Eastward Ho! Initiative grew out of a 1995
recommendation of the Governor's Commission for a Sustainable South Florida. The
Commission recognized that efforts to protect and restore the Everglades ecosystem
would have limited effect without a parallel effort to curtail the westward spread of urban
sprawl from the metropolitan area to the east. Eastward Ho! is a sustained and
comprehensive effort to influence market conditions so as to redirect a greater percentage
of projected regional growth back to southeast Florida's historic urban corridor.
Ultimately, the purpose is to ensure human, environmental and economic health for all
communities in South Florida.
The Eastward Ho! Brownfields Partnership. Because actual or perceived environmental
contamination in urban infill sites — along with the risks and costs associated with
addressing it — is a significant barrier to promotion of development in the Eastward Ho!
corridor, the identification, assessment, rehabilitation and redevelopment of brownfields
sites is an integral part of the larger Eastward Ho! strategy. Modeled after the EPA
Brownfields National Partnership concept, the Eastward Ho! Brownfields Partnership
was initiated in February 1997 to return abandoned and underutilized sites in the corridor
to productive use. The Partnership has sponsored two conferences, successfully bringing
together federal, state, regional and local governments, the non-profit community, and the
private sector to forge a collaborative approach to addressing brownfields in the Eastward
Ho! corridor. This agreement formalizes that collaboration to set the foundation for
future accomplishments.
III. Agreement
Whereas, sites perceived to be contaminated are a significant barrier to infill development
and urban revitalization in the Eastward Ho! corridor;
Whereas, there is a community need For a coordinated, collaborative, and regional effort
to address the thousands of sites throughout the Eastward Ho! corridor whose reuse is
complicated because of actual or perceived environmental contamination;

Wherreci.s, any community organization, governmental entity, or intermediary agency that
bears responsibility for or has an interest in brownfields redevelopment may be a
signatory to this agreement;
Whereas, each of the signatories to this agreement bears responsibility for or interest in
some aspect of brownfields site identification, assessment, rehabilitation and
redevelopment in the Eastward Ho! corridor;
Whereas, each of the signatories to this agreement understands urban revitalization and
promotion of infill development in Southeast Florida to be environmental, as well as
social and economic, strategies, advancing the dual benefits of site specific
environmental remediation and restoration of the Everglades ecosystem;
Whereas, each of the signatories to this agreement is committed to the following guiding
principles relating to brownfields site identification, assessment, rehabilitation and
redevelopment in the Eastward Ho! corridor:
Promoting environmental justice, consistent with the recommendations of
the Florida Environmental Equity & Justice Commission;
• Coordinating the implementation of existing statutes, programs, and other
efforts relating to brownfields to maximize their efficiency and
effectiveness;
To the extent that brownfields sites are designated, establishing processes
to achieve timely, productive and sustainable re -use of targeted sites;
• Approaching brownfields in the context of broader economic
development, neighborhood development, environmental protection, and
urban revitalization objectives; and
• Collectively implementing participatory solutions involving residents and
neighbors of sites perceived to be contaminated at each step, from site
identification through redevelopment.
Now, therefore, this Agreement is established to create a framework for coordinating
efforts relating to brownfields rehabilitation and redevelopment in the Eastward Ho!
corridor.
Focus of Cooperative Activities
The signatories to this Agreement share a mutual interest in the following issues and will
use this agreement to expand their cooperation to:
Establish an Eastward Ho! Brownfields Partnership Coordinating
Committee, which provides for voluntary participation by all stakeholders,
including residents and local businesses, among others.
Complete a workplan strategically identifying and describing tasks to be
undertaken by the Partnership within the first year of this Agreement

taking effect, and to complete subsequent workplans for future periods, as
appropriate, for the life of this agreement.
Complete a regional inventory of potential brownfields sites, in
cooperation with local environmental regulation agencies, the South
Florida and Treasure Coast Regional Planning Councils, institutions of
higher education, and other appropriate entities. The results of this
inventory will provide data about sites perceived to be contaminated
throughout the corridor, and will be used in conjunction with social,
economic, and demographic, and public health data, as these are available.
The Partnership will develop a common standard for identifying and
displaying the information included in the regional inventory.
• Undertake more detailed assessment of targeted sites, to be used to
categorize and prioritize sites for coordinated attention from Agreement
signatories. These assessments will also be used for securing additional
resources for the rehabilitation and redevelopment of the targeted sites,
and for the development of future.programs and proposals relating to the
Eastward Ho! Brownfields Partnership and to the Eastward Ho! Initiative.
• Cultivate a link between the prioritization, rehabilitation and
redevelopment of potential brownfields sites and access to and
expansion/further development of public transit systems in the Eastward
Ho! corridor. The redevelopment component of targeted properties should
include enhancing the accessibility of the finished project, preferably by
multiple transportation modes.
Support and promote redevelopment activities that are consistent with
such Eastward Ho! principles as infill development at appropriate
densities, good urban design, bicycle, pedestrian and transit oriented
design, crime prevention through design, urban greenways, mixed use, and
mixed income development.
Seek to access funds and other incentives, both internally and externally,
public and private, for the rehabilitation and redevelopment of targeted
sites in the Eastward Ho! corridor.
Cooperate to submit competitive applications by the Eastward Ho!
initiative for enhanced federal involvement and assistance. If selected to
receive such involvement and/or assistance, the parties to this Agreement
will cooperate to implement the relevant federal program or initiative, and
to make the best use of any resources that may be made available to
forward the principles of the EPA Browntields National Partnership, the
Eastward Ho! initiative, and this Agreement.
Coordinate the activities of the Eastward Flo! Browntields Partnership

with the other relevant ongoing activities carried out by the respective
signatory entities.
• Actively seek the involvement of the wide range and diversity of
stakeholders in public participation for the targeting and prioritization of
potential brownfields sites, as well as in the planning, implementation, and
follow up phases of site -specific projects. Tie these community
participation activities to broader Eastward Ho! public outreach efforts.
Support and promote a viable public health improvement effort within the
Eastward Ho! corridor, which maximizes the use of available government
and private resources to address human health needs of medically
underserved and economically disadvantaged people affected by
brownfields.
Support and promote the use of innovative technologies which ensure
environmentally and economically sound, and healthy, remediation of
contaminated sites.
IV. Programming, Budgeting, Funding and Reimbursement Arrangement
A. This Agreement is neither a fiscal nor a funds obligation document. Any
transfer of funds between parties may take place through existing
authorities and procedures.
B. Generally, any endeavor involving the transfer of funds will follow normal
procurement or other appropriate processes and will be effected in writing
by representatives of the organizations involved.
C.. This Agreement in no way restricts the signatories from participating in
similar activities or arrangements with other entities or agencies.
D. Nothing in this Agreement shall obligate the signatories to expend
appropriations, obligate funds or enter into any contract or other
agreement.
V. Effective Date
This Agreement will become effective upon signature by any two parties. Any Party may
terminate its participation in this agreement upon written notice to the other Parties. The
Agreement's provisions will be reviewed periodically, as appropriate, and amended or
supplemented as may be mutually agreed upon.
VI. Other Agreements
There are no superseding Agreements on this topic among the Parties hereto.

This Agreement may be executed in one or more counterparts, each of which shall be
deemed an original, but all of which together shall constitute one and the same
instrument. Each member of the partnership has signed this five -page agreement on a
separate page. The original signature pages are on file at the South Florida Regional
Planning Council.
