RESOLUTION NO. 9 843
A RESOLUTION, WITH .ATTACHMENT(S), CLOSING,
VACATING ABANDONING AND DISCONTINUING FOR
PUBLIC USE THE WESTERLY 20 FEET OF PUBLIC
RIGHT OF WAY ON THE WEST SIDE OF NORTHWEST
8th AVENUE BETWEEN 16th AND 17th STREET (MORE
PARTICULARLY DESCRIBED HEREIN); MAKING
FINDINGS; AND PROVIDING FOR AN EFFECTIVE
DATE.
WHEREAS, the Miami Zoning Board at its meeting of
June 2, 1997, Item No. 1, duly adopted Resolution No. ZB 54-97 by
a five to one (5-1) vote, recommending APPROVAL, as set forth
herein; and
WHEREAS, The Public Works Department and the Plat and Street
Committee have studied the subject vacation and closure and
determined that it will not affect pedestrian or vehicular
traffic circulation or access for public service vehicles since
the roadway is not the right-of-way which is being closed by this
action; and
WHEREAS, the Plat and Street Committee has reviewed the
subject tentative plat and determined that all technical
requirements have been met, and vacation of the subject
right-of-way would benefit the general public; and
WHEREAS, the Department of Public Works and the Plat and
Street Committee recommend approval of this vacation request; and

WHEREAS, the City Commission finds that it is in the best
interest of the general welfare of the City of Miami and its
inhabitants to grant the vacation and closure of a portion of the
subject right-of-way, and deems it advisable to do so;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the
Preamble to this Resolution are hereby adopted by reference
thereto and incorporated herein as if fully set forth in this
Section.
Section 2. A portion of public right-of-way being the
westerly 20 feet of the west side of Northwest 8th Avenue
between Northwest 16th Street and Northwest 17th Street, and
more particularly described as "Tracts A and B, Medical
Subdivision", according to the plat thereof, as recorded in
Plat Book 129 at Page 76 of the Public Records of Dade County,
Florida (see Exhibit "A", attached hereto and made a part
hereof by reference thereto), is hereby closed, vacated,
abandoned and discontinued for public use.
Section 3. This Resolution shall become effective
immediately upon its adoption.

Request: Official vacation and closure of a public right of way, being Track "A" and "B",
the portion of NW 8th Avenue between 16th and 17th Street of Medical
Subdivision. Continued from Zoning Board of April 28, 1997.

The Public Works Department and the Plat and Steet Committee have
studied the vacation of the westerly 20 feet of right of way on the west
side of NW 8th Avenue between NW 16th Street and NW 17th Street
and determined that the vacation of this right of way will not affect
pedestrian or vehicular traffic circulation or access for public service
vehicles since the roadway is not being closed. All vehicular and
pedestrian traffic will continue to utilize NW 8th Avenue between NW
16th Street and NW 17th Street. In anticipation of more intense
development on the subject property, the underlying plat entitled
"Medical Subdivision" dedicated an additional 20 feet of width along NW
8th Avenue along the westerly side. The original zoned width was not
expanded to include the additional right of way. The owner, Jackson
Memorial Hospital, now desires to develop a mental health facility on
the site and the additional 20 feet of right of way width is no longer
needed or utilized by the City. The proposed vacation of right of way
was originally dedicated by the underlying plat of "Medical Subdivision"
and the reversion rights for this dedicated portion of NW 8th Avenue, as
stated on the "Medical Subdivision" plat, are to the owners of the
"Medical Subdivision" property. This vacation returns the dedicated
width at NW 8th Avenue to its current zoned width. The plat and street
committee has reviewed this tentative plat and determined that all
technical requirements have been met and the vacation of this portion
of the right of way and development of the mental health facility would
benefit the general public. The Public Works Deaprtment and the Plat
and Street Committe recommend approval of this vacation request.

plat. They are now requesting, by plat, the return of the 20 feet of width that is no longer needed for
street purposes. NW 8th Avenue will remain open to through traffic and the curbs and gutters and
pavement will not physically change.
