RESOLUTION NO. 9 7- 688
A RESOLUTION AUTHORIZING THE FUNDING OF THE
DADE COUNTY ASSOCIATION OF CHIEFS OF POLICE,
COURT OVERTIME REDUCTION PROJECT, IN AN
AMOUNT NOT TO EXCEED $53,250.00; ALLOCATING
FUNDS THEREFOR, FROM THE LAW ENFORCEMENT
TRUST FUND, PROJECT NO. 690003, SUCH
EXPENDITURES HAVING BEEN CERTIFIED BY THE CHIEF
OF POLICE AS COMPLYING WITH FLORIDA STATE
STATUTES, CHAPTER 932.7055, AS AMENDED.
WHEREAS, the Miami Police Department, as most police departments in Dade County,
faces rising court overtime costs; and
WHEREAS, the costs are significant and difficult to continue to absorb; and
WHEREAS, the Dade County Association of Chiefs of Police ("Association"), along with
the State Attorney's Office, have determined that a standby system ("system") should be instituted;
and
WHEREAS, members of the Association must share in the cost as they will all benefit from
a reduction in court overtime costs, and
WHEREAS, the Chief of Police has recommended adoption of this Resolution and has
determined that the proposed expenditure complies with Florida State Statute 932.7055, as
amended; and

NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF
MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the preamble to this Resolution are hereby
adopted.
Section 2. The funding of the Dade County Association of Chiefs of Police, Court
Overtime Reduction Project, in an amount not to exceed, $53,250.00, is hereby authorized, with
funds therefor hereby allocated from the City of Miami Law Enforcement Trust Fund, Project
Number 690003, such expenditures having been certified by the Chief of Police as complying with
Florida State Statutes, Chapter 932.7055, as amended.
Section 3. This Resolution shall become effective immediately upon adoption.

It is respectfully recommended that a Resolution authorizing payment to the Dade County
Association of Chiefs of Police, for the Court Overtime Reduction Project, and allocating funds
therefor, in an amount not to exceed $53,250.00, be approved. Funding is to be provided from the
Law Enforcement Trust Fund, from Project Number 690003.
BACKGROUND:
The Miami Police Department, as most police departments in Dade County, faces rising court
overtime costs which are not easy to contain. There are several inherent problems arising from this
issue. On any given day, an officer can be subpoenaed but not actually needed be in court. It is
not unusual for officers to be scheduled for court during the morning or early afternoon and remain
there until late in the afternoon. They then must report for their regular tour of duty that evening
thus creating safety concerns because of extended working hours. Finally, on -duty officers must
wait in court until required to testify when they could be patrolling the streets.
The Dade County Association of Chiefs of Police, along with the State Attorney's Office, have
studied this problem and have determined that a standby system should be instituted. The system
uses a victim/witness coordinator to ascertain officer as well as victim and witness availability,
thus allowing the State Attorney's Office to plan accordingly. Officers will be notified that they
are being placed on a "standby" basis and will only be called when needed. All police departments
in Dade County are being requested to financially support this program based on the number of
officers the department is budgeted for.

During the Pilot Program (January 1997 through July 1997) there was $300,685 of savings realized
in court overtime in one courtroom alone. The Department of Police projects a total of $1,166,695
in savings per year with the full implementation of the standby system in all eight courtrooms.
