HomeMy WebLinkAboutR-97-0663J-9=7-695 9/23/97 RESOLUTION NO. 9 7- 663 A RESOLUTION APPROVING WITH CONDITIONS THE REQUEST OF THE CENTRAL SHOPPING PLAZA MERCHANTS' ASSOCIATION TO 'RELAX NOISE RESTRICTIONS BY WAIVING. THE PROVISIONS CONTAINED IN SECTIONS 36-4 AND 36-5 OF THE CODE OF THE CITY OF MIAMI, FLORIDA, AS AMENDED, FOR THE PURPOSE OF OPERATING A TEMPORARY EVENT WITH MECHANICAL RIDES IN THE CENTRAL SHOPPING PLAZA PARKING LOT, FROM OCTOBER 23 - NOVEMBER 2, 1997, SUBJECT TO: THE OPERATOR OBTAINING A CLASS 1 SPECIAL PERMIT; A PROHIBITION ON GAMBLING AND PERSONS LIVING ON SITE; AND A REQUIREMENT FOR SECURITY GUARDS. WHEREAS, representatives from the Center Shopping Plaza Merchants' Association requested City Commission approval to relax certain requirements in order to, facilitate a promotional event, including amusement rides, to be held in the parking lot of the Central Shopping Plaza from October 23 - November 2, 1997; and WHEREAS, the City Commission after careful consideration of this matters deems it advisable and in the best interest of the general welfare of the City of Miami and its inhabitants to adopt the herein Resolution; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are hereby adopted by reference thereto and incorporated herein as if fully set forth in this Section crry comasS101 MEETING OF S E P 2 3 1997 Resolution No. Section 2. The request of the Central Shopping Plaza Merchants' Association to relax the noise restrictions by waiving the provisions contained in Sections 36-4 and 36-5 of the Code of the City of Miami, Florida, as amended, for .the purpose of operating a temporary event with mechanical rides in the Central Shopping Plaza parking lot from October 23 - November 2, 1997, is hereby approved, subject to the following: (a) Class 1 Special Permit shall be obtained for the event; (b) there shall be no gambling or persons living on site; and, (c) security guards shall be provided on site during the event. Section 3. As a consequence of the foregoing, the restrictions in Sections 36-4 and 36-5 of the Code of the City of Miami, as amended, shall be in applicable during the above special event period. Section 4. This Resolution shall become effective immediately upon its adoption. PASSED AND ADOPTED this 23rd day of September, 1997. ATTEST WALTER J. We are planning to host amusement rides as a promotional event from October 13 thru November 2, 1997. However since this includes Monday, Tuesday and Wednesday, we have been advised that this has to be approved by the City Commission. We would appreciate anything that you cando to help us host this traffic building promotions. Request To hold a temporary event with mechanical rides on Monday, Tuesday, and Wednesday. Article 9, Section 906.9 of the City's Zoning Ordinance stipulates that such events are only permissible Thursdays through Sundays. Recommendation Approval of this request. The Flagami NET Administrator, Ruben Avila, concurs with this recommendation. 2. Request The relaxation of City Code Sections 36-4 and 36-5 which set prohibitions and limitations on the creation of noise. Recomendation Since this is a residential neighborhood, it is recommended that the noise prohibitions and limitations be relaxed on Fridays and Saturdays, only until 12:00 midnight. 9 r - 663 '3
