A RESOLUTION ALLOCATING $1,215,478.00 FROM FISCAL
YEAR 1997 HOUSING OPPORTUNITIES FOR PERSONS WITH
AIDS (HOPWA) PROGRAM GRANT FUNDS (ACCOUNT #
194005.590605.6860.94654), TO METROPOLITAN DADE
COUNTY, DEPARTMENT OF HUMAN RESOURCES, OFFICE OF
COMMUNITY SERVICES (OCS), FOR THE PROVISION OF
SHORT TERM HOUSING ASSISTANCE TO VERY LOW
INCOME PERSONS WITH AIDS; FURTHER, REALLOCATING
UNCOMMITTED AND UNEXPENDED HOPWA PROGRAM
FUNDS, IN THE AMOUNTS OF: $97,373.69 FROM THE 1995
HOPWA PROGRAM (ACCOUNT NO
194003.590603.6860.94654), $898.61 FROM THE 1994
HOPWA PROGRAM (ACCOUNT NO.
194002.590602.6860.94654), AND $197.61 FROM THE
1993 HOPWA PROGRAM (ACCOUNT NO.
194001.590601.6860.94654); AUTHORIZING THE CITY
MANAGER TO EXECUTE THE NECESSARY DOCUMENTS, IN
A FORM ACCEPTABLE TO THE CITY ATTORNEY, WITH
METROPOLITAN DADE COUNTY, DEPARTMENT OF HUMAN
RESOURCES, OCS, TO EFFECT SAID TRANSACTIONS.
WHEREAS, the Housing Opportunities for Persons With AIDS (HOPWA) Program
was created under the AIDS Housing Opportunity Act, and revised under the Housing and
Community Development Act of 1992; and
WHEREAS, Section 606(d)(2) of the Housing and Community Development Act of
1992 stipulates that the City of Miami, being the most populous unit of general local
government in an eligible metropolitan statistical area (EMSA), not including county
government, must be the applicant for the HOPWA Grant and be allocated the related

funding; and
WHEREAS, in March of 1997, the City of Miami submitted a Consolidated Plan to
the U.S. Department of Housing and Urban Development (HUD) for funding the 1997
HOPWA Program; and
WHEREAS, in April of 1997, the City Commission, pursuant to Ordinance No.
11477, established a special revenue fund entitled "Housing Opportunities for Persons
With AIDS (HOPWA) Grant Program FY 1997", and appropriated $8,832,000.00 from the
U.S. Department of Housing and Urban Development funding for the implementation and
administration of the 1997 HOPWA Program; and
WHEREAS, in August of 1997, the City's HOPWA Advisory Board (HAB), at a duly
noticed public hearing, unanimously recommended that the City Commission allocate
$1,215,478.00, in fiscal year 1997 HOPWA funds, and which is the amount contained in
the Consolidated Plan, to Metropolitan Dade County's Department of Human Resources
(Office of Community Services), for the provision of short term housing assistance to very
low income persons with AIDS; and
WHEREAS, at the same HAB meeting, the HAB unanimously recommended that the
City Commission reallocate the uncommitted and unexpended HOPWA funds from the
1993, 1994 and 1995 HOPWA Program Years to Metropolitan Dade County's Department
of Human Resources (Office of Community Services), for the provision of short term
housing assistance to very low income persons with AIDS; and
WHEREAS, the City Administration agrees with, and supports, the allocation and
reallocations recommended by the HAB;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF
MIAMI, FLORIDA:

Section 1. The recitals and findings contained in the Preamble to this Resolution
are hereby adopted by reference thereto and incorporated herein as if fully set forth in this
Section.
Section 2. The amount of $1,215,478.00, from the 1997 HOPWA Grant
Program funds, Account No. 194005.590605.6860.94654, is hereby allocated to
Metropolitan Dade County, Department of Human Resources, Office of Community
Services (OCS), for the provision of short term housing assistance to very low income
persons with AIDS.
Section 3. The amount of $97,373.69, in unexpended and uncommitted funds
from the 1995 HOPWA Grant Program, Account No. 194003.590603.6860.94654, is
hereby reallocated to Metropolitan Dade County, Department of Human Resources, OCS,
for the provision of short term housing assistance to very low income persons with AIDS.
Section 4. The amount of $898.61, in unexpended and uncommitted funds from
the 1994 HOPWA Grant Program, Account No. 194002.590602.6860.94654, is hereby
reallocated to Metropolitan Dade County, Department of Human Resources, OCS, for the
provision of short term housing assistance to very low income persons with AIDS.
Section 5. The amount of $197.61, in unexpended and uncommitted funds from
the 1993 HOPWA Grant Program, Account No. 194001.590601.6860.94654, is hereby
reallocated to Metropolitan Dade County, Department of Human Resources, OCS, for the
provision of short term housing assistance to very low income persons with AIDS.
Section 6. The City Manager is hereby authorized' to execute the necessary
documents, in a form acceptable to the City Attorney, with Metropolitan Dade County,
Department of Human Resources, OCS, to effect said transactions.
' The herein authorization is further subject to compliance with all requirements that may be imposed by the City
Attorney, including but not limited to those prescribed by applicable City Charter and Code provisions.

Section 7. This Resolution shall become effective immediately upon its adoption.
