RESOLUTION NO.
A RESOLUTION RATIFYING, APPROVING AND CONFIRMING
THE CITY MANAGER'S EMERGENCY ACTION IN -ENGAGING
THE PROFESSIONAL SERVICES OF THE REPUBLIC
APPRAISAL COMPANY, INC. AND J.B. ALHALE &
ASSOCIATES, INC., AT COSTS OF $8,995.00 AND
$9,000.00, RESPECTIVELY, TO APPRAISE THE
PROPOSAL SUBMITTED BY GROVE HARBOUR MARINA AND
CARIBBEAN MARKETPLACE TO DETERMINE IF SAID
PROPOSAL OFFERS A FAIR MARKET RETURN TO THE CITY
OF MIAMI; ALLOCATING FUNDS THEREFOR FROM ACCOUNT
NO. 660101-220, ENTITLED: "PROFESSIONAL SERVICES
- APPRAISALS", SUCH COSTS TO BE REIMBURSED TO
THE CITY BY GROVE HARBOUR MARINA AND CARIBBEAN
MARKETPLACE AT THE TIME OF EXECUTION OF THE
PROPOSED LEASE; FURTHER AUTHORIZING THE CITY
MANAGER TO EXECUTE THE NECESSARY DOCUMENT(S), IN
A FORM ACCEPTABLE TO THE CITY ATTORNEY, FOR SAID
SERVICES.
WHEREAS, the City of Miami is interested in developing a
multiple use commercial and recreational facility including a
full service boat yard, marina, marine related retail use and a
public market including the adaptive reuse of two existing
historic hangar structures on a 13.5 acre site (6.9 upland acres
and 6.6 submerged acres) at Dinner Key; and
WHEREAS, the design strategy includes both the restoration
of the historic hangers and the construction of two new
structures on the site; and
WHEREAS, the provisions of Section 3(f)(iii)(B) of the
Charter of the City of Miami, Florida, as amended, require that
the terms of a contract result in a fair return to the City,

based upon two independent appraisals, for any lease or contract
of the City's waterfront property with private firms or persons;
and
WHEREAS, the City Manager directed the Department of
Planning and Development to procure two appraisals so that the
proposal submitted by Grove Harbour Marina and Caribbean
Marketplace can be appraised to determine if it offers a fair
market return to the City of Miami; and
WHEREAS, proposals for said appraisals received from Gabriel
Garcia-Menocal, MAI, for The Republic Appraisal Company, Inc., (a
Hispanic/Dade County appraiser) and Joseph Alhale, MAI, for
J.B. Alhale & Associates, Inc., (a non-minority/Miami appraiser)
were determined to be the most capable of providing appraisal
services to the City; and
WHEREAS, funds to cover the costs of said appraisals are
available from Account No. 660101-220, entitled "Professional
Services - Appraisals", such costs to be reimbursed to the City
by Grove Harbour Marina and Caribbean Marketplace at the time of
execution of the proposed lease;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the
Preamble to this Resolution are hereby adopted by reference
thereto and incorporated herein as if fully set forth in this
Section.
Section 2. The City Commission hereby ratifies, approves
and confirms the City Manager's emergency action in engaging the

professional services of The Republic Appraisal Company, Inc. and
J.B. Alhale & Associates, Inc., at costs of $8,995.00 and
$9,000.00, respectively, to appraise the proposal submitted by
Grove Harbour Marina and Caribbean Marketplace to determine if
said proposal offers a fair market return to the City of Miami,
with funds therefor hereby allocated from Account No. 660101-220,
entitled "Professional Services - Appraisals", such costs to be
reimbursed to the City by Grove Harbour Marina and Caribbean
Marketplace at the time of execution of the proposed lease.
Section 3. The City Manager is hereby authorizedY to
execute the necessary document(s), in a form acceptable to the
City Attorney, for said services.
Section 4. This Resolution shall become effective
immediately upon its adoption.

The administration recommends that the City Commission ratify, approve and confirm
the City Manager's emergency action in accepting the proposals of The Republic
Appraisal Company, Inc., (a Hispanic/Dade County appraiser) and J.B. Alhale &
Associates, Inc., (a non-minority/Miami appraiser). Each was hired to appraise the
proposal submitted by Grove Harbour Marina and Caribbean Marketplace to determine if
it offers a fair market return to the City of Miami. The fees of said proposals are
$8,995.00 and $9,000.00, respectively. Funds for the appraisals are available from the
account entitled "Professional Services - Appraisals", Account No. 660101-220, such
costs to be reimbursed to the City by Grove Harbour Marina and Caribbean Marketplace
at the time of execution of the lease.
BACKGROUND:

Pursuant to Section 3(f)(iii)(B) of the City Charter of the City of Miami, Florida, as
amended, the City of Miami is required when leasing City waterfront property to procure
two independent appraisals to determine if the terms of a contract result in a fair return to
the City. The City Manager has directed the Department of Planning and Development to
procure two appraisals of the proposal submitted by Grove Harbour Marina and
Caribbean Marketplace to determine if it offers a fair market return to the City of Miami.
As the City Commission has indicated that they want this lease executed in an
expeditious manner, it was necessary to obtain these appraisals on an emergency basis.
