A RESOLUTION AUTHORIZING THE ALLOCATION OF
$1,808,024.00 FROM THE CITY OF MIAMI LAW ENFORCEMENT
TRUST FUND, PROJECT NO. 690003, TO THE CITY OF MIAMI
GENERAL FUND FOR REIMBURSEMENT OF OPERATIONS AND
ADMINISTRATIVE FEES INCURRED RELATED TO INVESTIGATIONS,
SEIZURE AND FORFEITURE EFFORTS AUTHORIZED PURSUANT TO ;
THE U. S. DEPARTMENT OF THE TREASURY "GUIDE TO
EQUITABLE SHARING" (THE "FEDERAL GUIDE"); SUCH
EXPENDITURES HAVING BEEN CERTIFIED BY THE CHIEF OF POLICE
AS COMPLYING WITH SAID FEDERAL GUIDE.
WHEREAS, the U. S. Department of the Treasury's "Guide to Equitable Sharing" (the
"Federal Guide") authorizes the expenditure of forfeited cash or proceeds for certain law
enforcement purposes, including payment of salaries and overtime for those officers and support
staff involved in investigation, seizure and forfeiture operations; and
WHEREAS, said forfeiture proceeds are deposited in the Law Enforcement Trust Fund,
Project No. 690003; and
WHEREAS, the Chief of Police has recommended this allocation to the City of Miami General
Fund as reimbursement for operations and administrative fees incurred relative to the hereinabove
investigations and operations ; and
WHEREAS, funds to cover this expenditure are available from the Law Enforcement Trust
Fund, Project No. 690003, such expenditure having been certified by the Chief of Police as
complying with the Federal Guide;

NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI,
FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this Resolution are
hereby adopted by reference thereto and incorporated herein as if fully set forth in this Section.
Section 2. The amount of $1,808,024.00 is hereby allocated from the City of Miami
Law Enforcement Trust Fund, Project No. 690003, to the City of Miami General Fund for
reimbursement of operations and administrative fees incurred related to investigations, seizure and
forfeiture efforts authorized pursuant to the U. S. Department of the Treasury "Guide to Equitable
Sharing" (the "Federal Guide"), such expenditure having been certified by the Chief of Police as
complying with the Federal Guide.
Section 3. This Resolution shall become effective immediately upon its adoption.

RECOMMENDATION:
It is respectfully recommended that a Resolution, authorizing the reimbursement of monies to the
General Fund towards the City of Miami's Recovery Plan, and allocating funds therefor, in an
amount not to exceed $1,808,024.00, be approved. Funding is to be provided from the Law
Enforcement Trust Fund, from Project Number 690003.
BACKGROUND:
The City's Recovery Plan provides for $1,808,024 in Law Enforcement Trust Funds to be allocated
toward eliminating the City's deficit. These funds are available to reimburse the General Fund and
will be applied towards the salaries, fringe benefits, and overtime costs of officers and civilian
support personnel assigned to investigations and operations that have resulted in seizures and/or
forfeitures. The Chief of Police has determined that this is a permissible use of shared cash or
proceeds of forfeited property as outlined in the Department of the Treasury's, "Guide to Equitable
Sharing for Federal, State and Local Law Enforcement Agencies."

I, Donald H. Warshaw, Chief of Police, City of Miami, do hereby certify that this request
for expenditure from the City of Miami Law Enforcement Trust Fund, for the reimbursement to
the General Fund as part of the City of Miami's Recovery Plan, in an amount not to exceed
$1,808,024.00, complies with the guidelines set forth in the Department of the Treasury's,
"Guide to Equitable Sharing."
