A RESOLUTION, BY A FOUR -FIFTHS (4/5THS) AFFIRMATIVE VOTE OF THE MEMBERS OF THE CITY COMMISSION, RATIFYING, APPROVING AND CONFIRMING THE CITY MANAGER'S EMERGENCY ACTIONS IN WAIVING THE REQUIREMENTS FOR COMPETITIVE BIDDING PROCEDURES AND APPROVING THE ACQUISITION FROM VARIOUS VENDORS OF NECESSARY EQUIPMENT AND SUPPLIES, IN THE AMOUNT OF $150,000.00, FOR USE BY THE URBAN SEARCH AND RESCUE ("U.S.A.R.") TEAM WHICH WAS ACTIVATED AND DEPLOYED TO ASSIST IN THE RESCUE EFFORTS IN PUERTO RICO FROM NOVEMBER 21ST TO DECEMBER 1ST, 1996; ALLOCATING FUNDS THEREFOR FROM ACCOUNT CODE NO. 280601.840 FOR SAID PROCUREMENT, SUCH FUNDS TO BE REIMBURSED AT 100% TO THE CITY BY THE FEDERAL EMERGENCY MANAGEMENT AGENCY ("FEMA") FOR SAID PURPOSE. WHEREAS, the Department of Fire -Rescue received Federal Emergency Management Agency (".FEMA") authorization for the emergency procurement of equipment and supplies identified on the FEMA Task Force Equipment List on November 23, 1996, in an amount not to exceed $150,000, to be utilized by the Urban Search and Rescue (U.S.A.R.) Team deployed to Puerto Rico to assist in the rescue efforts relating to the explosion of a gas pipeline in a six -story building which caused eighteen deaths and more than fifty injuries; and WHEREAS, pursuant to a Memorandum of Agreement between FEMA and the City, the costs of said equipment and supplies are 100% CITY Colowsm Kmma OF SEP 0 9 Remiution.Pbo.- 97- 612 reimbursable to the City by FEMA, providing the City applies for reimbursement within a limited time period; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are hereby adopted by reference thereto and incorporated herein as if fully set forth in this Section. Section 2. By a four -fifths (4/5ths) affirmative vote of the members of the City Commission, `after a duly advertised public hearing, the City. Manager's finding of an emergency is hereby ratified, approved and confirmed, the .requirements for competitive bidding procedures are hereby waived and the acquisition from various vendors of necessary equipment and supplies, in the amount of $150,000.00, for use by the Urban Search. and Rescue ("U.S.A.R.") Team which was activated and deployed to assist in the rescue efforts in Puerto Rico from November 21s to December 1st, 1996, is hereby approved, with funds therefor hereby allocated from Account Code No. 280601.840 for said procurement, such funds to be reimbursed at 100% to the City by the Federal Emergency Management Agency (FEMA) for said purpose. - 2 - �'�- 612 Section 3. MEMORANDUM TO Honorable Mayor and Members of the City Commission FROM ; d and Marquez City Manager 0 RECOMMENDATION: 32 DATE July 28, 1997 FILE j s a i ication ergency Procurement of US - ._ Equipment REFERENCES: ENCLOSURES: It is respectfully recommended that a Resolution be passed ratifying, approving and confirming the City Manager's emergency action waiving of required competitive bidding procedures and authorizing the purchase of specific Urban Search and Rescue (US&R) equipment from various vendors at a total cost not to exceed $150,000.00. Funding is available from account code 280601.840. BACKGROUND: The Department of Fire -Rescue received Federal Emergency Management Agency (FEMA) authorization for the emergency procurement of equipment and supplies identified on the FEMA Task Force Equipment List, on November 23, 1996, not to exceed $150,000.00 as part of the Puerto Rico Disaster deployment. Under agreement with FEMA, .purchase orders must be issued and submitted to FEMA prior to reimbursement. The equipment purchased is 100% reimbursable, but funding is available for a "limited time only". Our inability to promptly procure these items will result in the loss of $150,000.00 for the purchase of equipment. The purchase of the recommended equipment will not only enhance the capabilities of the South Florida Urban Search and Rescue Task Force to respond to disasters, it will also increase the local capabilities of the City of Miami Department of Fire -Rescue. 97- 612
